joining me, former nixon white house counsel john dean. good to see you. your reaction now to the fact that there is an indictment, that bannon is expected to appear monday. how does this perhaps impact the ongoing probe involving the january 6th committee? does it give them now some teeth as they continue forward? >> it certainly does. it means you can't ignore a subpoena. fred, the statute under which bannon was indicted has two parts. one is willful default, what bannon did, didn't show or make effort through his attorney. said i'm not coming. the statute has another part that says also you can be indicted if you failed to answer pertinent questions. so you just can't play with the committee, show up, and stonewall it. you have to have a legitimate privilege, otherwise you, too, can be held in contempt for refusal to comply with the committee. this sends a deep message into the ranks of the trump people that think they can brush it off and that's not going to happen. >> if he finally appears and says i am pleading the fifth to everything. >> that's okay

let's go to john dean, former nixon white house counsel. right, their -- the argument that the trump lawyers are making about not handing over this information, right, is that congress will increasingly, inevitably, use this new weapon to perpetually harass its new rival. don't do it, because when the shoe is on the other foot, it will happen to you. right? it's the most compelling argument they can make, yet as everyone points out, this is extraordinary. does their argument have any grounds to hold up, do you think? >> evan is correct that they have reframed it by stomping their feet a little bit louder and verbally, if you will,inate brief. but it really is the same old brief they just lost on at the lower court. by a very well-reasoned opinion by a very good judge who had a lot of amicus brief to draw on as well and some very sophisticated lawyers being the friends of the court in this case. so, it is not a new brief and it's really not a new argument. trump's lawyers are just saying you got it wrong at the lower court and that's -- so we

woodward's and my papers down at the university of texas, what happened in watergate was we got to john deanore he testified. we knew he was going to name the president of the united states as the head of the conspiracy in watergate, and he was going to turn on the president of the united states. our job in the press right now, above all others, is to unravel this conspiracy before the republican party captured by donald trump is able to suppress what happened here. it is the business of the nation, and this committee might have a shot. i keep coming back to this idea of, in watergate we got a list of everybody who worked for the president of the united states in his re-election. the committee is trying to do the same thing and find a couple of these people. there are indications from republicans i talk to -- it's not just the republicans on the committee, but there are other republicans in the house, in the senate particularly who despise trump, who believe this conspiracy can be unraveled if other republicans talking to each other, is happening now to some extent, keep pursuing this. it do

let's talk to somebody who knows a little bit about executive privilege, john dean, white house counseluring president richard nixon's administration, obviously a key figure in the watergate investigation. mr. dean as always, great to have you here. so the judge criticized the trump team's executive privilege claim. give us a quick background on executive privilege. do you think it can be successfully invoked in this case? >> executive privilege comes from the separation of powers that the fact we have three branches of government and each branch can do its own thing within its own powers and the other branch has limited rights to look at what they're doing. for example we can't look at what the judge's law clerk is doing. the president is saying even though i'm no longer president this is stuff that happened while i was so therefore i have a right to withhold it. well, i don't think that is going to hold up. i think the judge sounds like she was trying to narrow the breadth of the inquiry or the request for documents a little bit but she is not buying that because this was a very unusu

what this committee needs clearly is some kind of witness to be the john dean of the january 6th committeey tell a story and detail if there was a criminal conspiracy in any way. >> so that day the vice president was obviously very much in danger in the capitol. and you now see the committee zeroing in on his inner circle, including his former national security counsel, keith kellogg, among others. what is your expectation what they can learn from keith kellogg and whether he will tell them something? >> general kellogg is someone very close to president trump. as a reporter, my assessment would be low expectations about kellogg. he is someone with trump on january 6th. he witnessed the president in the oval office. but this is someone who many pence allies would say privately and publicly is very cozy with trump politically and personally. >> at the time, though, those around pence, those who would be more loyal to pence than to trump, were very upset with the president for not intervening, right? >> they're over at the capitol. and there's still some confusion among pence associates why
