[ applause ] >> thank you very much, jeff and good morning and welcome to our panel this morning on forced treatment and constitutional rights. can they coexist? i am john diaz, the editorial page editor from the san francisco chronicle and i'm moderating this modern's discussion with our distinguished panel. forced treatment as jeff node is one of the most contentious issues of mental health. as you look at our discussion there are informed and panelled views from both sides. there has been many debates on how to implement lawyer's law which consist of outpatient treatment. it was named after laura wilcox, a mental health worker who had been shot to death by a man who refused treatment. the county r remains the only county to implement the law. there have been other counties in los angeles county and other counties who are considering it. >> why have they not adopted the law. what is it about forced treatment and the consequences for an all

but i think what congressman diaz-belart is referring to once they get spo the system and the pipeline and their legalization begins. >> johni appreciate you saying illegal status because no person could be illegal. but let's talk about marco rubio with all of this. he's kind of in a tenuous position. he co-authored the bill and is now threatening to walk away because he's sort of in an immigration quagmire. supporting the bill will cost him. failing to drag it right will cost him. abandoning him will definitely be damaging to him. >> he is walking a very tight line on this one. to a certain degree some of this is him trying to make the case that he has been out there pushing for conservative amendments to it as a way to bring along conservatives for the final vote. for him and for members of the senate, the big question is how close to 70 votes can they get. democrats like senator durbin have tried to push back on this, but realistically to have any kind of a possible hope for a vote in the house, they need to get as close to 70 votes as possible. that means bringing along some of the conservative republicans in the senate

john: i want to switch gears. it look like we're not going to have congressman diaz with us. there is power failure there in florida. let me switch gears to the irs. you wanted lois lerner back before your committee. let's go back and let's listen to what she said. >> i have not done anything wrong. i have not broken any laws. i have not violated any irs rules or regulations and i have not provided false information to this or any other congressional committee. >> john: she made a statement and then promptly took the fifth amendment declining to testify which is her right. you say, congressman, the way she did she waived her fifth amendment rights. you are a former prosecutor. what do you plan to do about it? >> well, you say that is her right. it is her right to remain silent. it is not your right to offer a lot of exculpatory information and say i'm not going to be subjected to cross-examination. the right to confront witnesses and cross-examine witnesses is also in the constitution. it's in the sixth million and not the fifth. what are we going to do? i would hope that loi
