why chief justice john roberts has even come out in what i would say kind of veiled criticism against kagan and others in ruling against some of the cases. i want to stay on roberts. dickurbin has tried to have him have an enforceable code of conduct. where does chief justice roberts fall in this? >> i think he falls between a rock and a hard place. i think on the one hand, he is as attuned to and sensitive to the institutional problems the court is facing and the costs of an erosion of public trust in the court that he really wants to do what he can to push back against that. on the other hand, he is just one among nine. he can't force his other eight colleagues to do much of anything. his real power over his colleagues is simply the power of persuasion. i think the real question is, how can he get everyone from -- you mentioned justice kagan and jackson all the way to alito, on board with the idea that whatever the supreme court is deciding, it is important, it is essential that the court's decisions be per perceived as legi legitimate, not because we all agree, but the idea is we should all at least agree that there are principles there. i think that's the real task
