you are on with representative john fleming. good morning. caller: good morning. thank you very much for taking my phone call. i do have a question for representative fleming. i honestly feel that this individual mandate is so illegal and so long wrong. i'm a 51-year-old male and i work and i don't have insurance. even though i don't have insurance right now, i do not think that government should -- can legally force me to pay a private company to cover me. i just think this is criminal. i agree with you, representative fleming, i think this whole thing should be thrown out, put in the trash can of history, and start from scratch. i would like to get your response to this. guest: thank you. many americans, i think, agree with you on that. of course this went to the supreme court. it was very interesting. the government argued, the obama administration argued, that under the 10th amendment individuals could be required to purchase insurance. and it turned out that the court agreed. that they decided, well, let's do a little twist here. we'll put this law into a pre

brought the issue up, i brought an amendment to the floor, the louisiana colleague in the house, john fleming, did the same thing in the house. because of the attention we focused on that issue, there was a limited provision in the law that said members of congress and their direct staffs would be in the exchanges. however, very conveniently, some of the details were jiggered around so that members of the leadership and their staffs and committee staffs would somehow be in a different, higher category and they would not be subject to the same obamacare rules. they would benefit from the very generous and very lucrative federal employee health benefit plan that congress has traditionally been under. i think we should undo that. i think we should again be one of the american people, relate to the american people and get the same treatment through the exchanges that the great majority of them will do under obamacare. the problem is, here on capitol hill, again, behind closed doors, the effort is largely in the opposite direction. louisiana congressman john fleming is sponsoring that amendment and joins us now.stifying its opposition to what seems pretty straightforward defense of the first amendment? an individual's right to practice his religion. >> tucker, that's a great question. to be honest with you, the white house really is not defending their position. for some reason they don't want military members to be able to freely express their religious beliefs. and we've seen with this administration a broad front not just in the military but in other areas as well. >> it doesn't really add up. i mean, this is an administration that put a premium on protecting the rights of the individual right is beefed up, enforcement of various civil rights laws in the civil rights division of the justice department. you'd think they would be interested in protecting the most basic of all civil rights which is the right to practice your religion. how are they getting in the way? >> ways we've seen during the obama administration, tucker, a lot of things have happened. we've seen bibles taken from the roo
