joe johns. joe joins us from washington. joe, no charges today for sure. does it have anything to do with the fact that they haven't been able to talk to him. >> that's an interesting question. you are right. it could be soon for the charges. it may be important to say that the authorities are reporting that they are not able to interview the suspect. he is in serious condition at the hospital but important also to say, don, that not is being able to interview a defendant hasn't stopped the feds from filing charges before. it could still happen. that's a pretty common practice, because sometimes defendants have lawyers who intercede and say investigators can't talk to this defendant. it is not that different a situation necessarily, don. >> we have heard about a number of different charges that could happen including federal charges, murder charges. what are some of the likely charges that he might face, joe? >> well, we've heard as recently as yesterday that authorities were contemplating a terrorism charge most likely, something related to use of a weapo

we also have been learning from joe johns who we'll go to in a second that one of the reasons for all the concern is it's thought that suspect number two might be wearing some sort of explosive device. joe, what have you learned? >> exactly right. and that's been the big concern. apparently the suspect who was killed, according to authorities. he did have explosives on his body. and the big concern and the reason why we're seeing this unprecedented manhunt and police going door to door, shutting down the transit system, asking businesses not to open, is because of the concern that the other suspect, the suspect they're looking for, may also have explosives on his body. talking to law enforcement officials just a little bit of color and background. one of the things that a couple law enforcement officials have said to me is that they were frankly quite surprised that these individuals they were looking for, actually maintained their presence in the community after this bombing occurred. and if you put the whole thing together, there was a report of a robbery this morning which would in

our crime and justice correspondent joe johns joins us now from washington. morning, joe. >> good morning, john. the supreme court said it was letting new york's strict gun laws stand. the justices rejected an appeal from gun owners who argued the law was unconstitutional. the issue was whether the second amendment allowed individuals to carry guns outside their homes for self-defense. new york passed some of the strictest gun laws in the nation following the massacre in newtown, connecticut, since the high court refused to get involved, the state law will stay in place. john? >> a lot going on today. joe, you have new details on a story out of florida where this police sergeant was fired over the weekend because he had targets that resembled trayvon mart martin. what's the latest on that? >> absolutely. there are new details there. this police sergeant has taken to youtube to defend himself after being fired from the port canaveral police department for possessing shooting targets that some said looked like the florida teenager gunned down last year. sergean

. >>> first, though, we want to check in with joe johns, on the deadly poison letter arrest. joe, you have some news on the arrest. what are you hearing, what is the latest? >> reporter: anderson, this is an individual from tupelo, mississippi, we're told, the home state of senator roger wicker. actually, his hometown, as well. he's one of the people who got one of the mailings. we know of two suspicious letters, a lot of confusion at the united states capitol today. a mail delivery to the capitol has been stopped, while authorities try to figure all of it out. of the suspicious letters that were field tested, and initially deemed positive, one was addressed to the white house. another, an earlier letter, as i said, addressed to senator wicker. these are only field tests, false-positives are known to occur. according to law enforcement authorities, anderson, both of the letters were detected at an off site facility. authorities say there was a message contained in the letters. that message said, "to see a wrong and not expose it is to become a silent partner to its continuance

joining me now is susan candiotti and joe johns in washington.have been working their sources. susan, you got new information about the behavior of the suspects. what is it? >> reporter: that's right, anderson. as chilling this is to watch the video moments before the bombing and to see these two suspects walking down the sidewalk but we're wondering about when it happened and afterwards. a federal law enforcement told me and shared this information with me and he said they acted differently than anyone else. they stood and they watched and after it happened he said they casually walked away. it's almost unfathomable when that happened, when all of the other people were running around and attending to casualties, these people just turn around and casually walked away. anderson? >> and a lot of attention is being paid to what the suspects are wearing in both images. both are wearing baseball caps, certainly not unusual in boston. what are you hearing about that? >> reporter: that's right. these baseball caps -- look, we're all staring at them time

i want to go to joe johns in washington. we are learning -- this is perhaps a crucial detail, everyone, a big development. russia warned not only the fbi about tamerlan tsarnaev but they also then warned the cia. and so i know you've been working this story. what you have learned about the information that the russians gave to u.s. intelligence agencies? >> erin, the headline here is that we now have two u.s. government agencies that say they were warned about alleged boston bomber tamerlan tsarnaev. we already knew that fbi was told about him and investigated him in 2011. tonight we learn that the cia, the central intelligence agency, got basically the same information about tsarnaev from russia later the same year. it's important because tsarnaev was allowed to fly to russia, stay there for six months and fly back to the united states in 2012. the question being asked all over washington right now is why federal authorities didn't start watching tsarnaev like a hawk when he got back? the fbi says it already checked him out

joe johns is in washington tonight with the latest. joe, what does this development mean exactly?erin, everything you said is on point. sources tell cnn that, yes, female dna was discovered on a fragment of one of the bombs of the boston marathon. they're obviously trying to figure out whose dna it was. they took dna samples at the home of katherine russell, tamerlan tsarnaev's widow. what could this mean? we don't know. experts we spoke with stress that dna that they found at the location of the bombing could be belong to anyone who came into contact with virtually any of the consumer products used to make the bomb. so it may well not implicate anyone of anything. it could have ended up on a battery. there was a battery there, a remote control there. obviously, as far as we can tell, there was certainly something on the pressure cooker. there were probably a lot of handlers in the chains of commerce as all these products went to market. it's not to speculate. all we know is that they have dna. they're not sure what it means and it belongs to a female. erin? >> joe johns, thank yo

joe johns is joining us now from washington.ndering if the fbi missed something when the russians first tipped them off about tamerlan tsarnaev, the older brother. what's the latest there in washington? >> reporter: that certainly is the question right now. some of this is about the federal databases. the issue is whether tamerlan tsarnaev's movements between here and russian slipped through a security net. >> reporter: he first hit the fbi radar in 2011 when the russian government told the agency they should check him out. >> the russian fsb sent a letter to the fbi and other agencies that we think this guy has become radical. >> reporter: the fbi said it was based on information that he was a following of islam, a radical believe, he changed drastically in 2010. fbi says it checked u.s. government databases, telephone km communications and online activity. the fbi says it did not find any terrorism activities, so it gave that information to russia and ask for but did not receive additional information. >> because additional in

crime and justice correspondent joe johns joins me from washington, d.c. what is the fbi telling us about their prior questioning of the older deceased suspect? we know they put out a statement saying a foreign country, which we believe to be russia, expressed an interest in him. what exactly is the fbi describing about that event? >> they say they questioned him in 2011. they looked at telephone records. they looked at travel records. they did what they could, they say. and they went back to that country who asked for questions and said we haven't found anything. can you give us some more information? no more information was forwarded to the united states, so the fbi pretty much dropped it. this is pro forma, it happens again and again and again from year to year to year. so it's not unusual for this to happen. it's not unusual for that person to walk away because the fbi says they didn't find anything. >> joe, an intelligence source told me today that while it it may not be unusual for people to do this when it comes to al qaeda, it is rare for the russi

joe johns is in washington with new information. joe, what are you learning? >> anderson, a federal law enforcement official briefed on the investigation tells our producer that the current thinking is that the devices were remotely detonated, but that official would not go into any details. the official would not say if they were set off by a cell phone or by some other method. now, this official also said the bulk of the material recovered by the authorities apparently came from the black bag you've heard so much talk about. the official added that bag showed up in a lot of pictures yesterday, showing something next to a mailbox which appears frankly to have nothing to do with the explosions. the official also said it is accurate that the fbi has video showing the reaction as you just heard of suspect two to the explosion from the first bomb. the official said you can see the reaction of suspect two along with others around him, but the official was pretty vague as to how revealing that reaction was and said it's subject to interpretation. so a little more d

. >> joe johns joins us now from washington.t's the fbi telling us about their priority questioning of the older now dead suspect? >> they did question the older now dead suspect two years ago and this was an individual who actually had a foreign government request that they question this individual. they went to see him. they talked to him and then they let it go pretty much. there's going to be a lot of questions about that. why they actually got this guy red flagged and then ended up pretty much letting him walk given all that's transpired over the last week. >> he was not read his miranda rights which a lot of people are talking about today. explain the reason why. >> well, in the law there's what they have called a public safety exception to miranda. everybody knows what miranda is. you have the right to remain silent. anything you say can and will be used against you. the police don't have to say that to you if they are in hot pursuit of something relating to public safety. maybe worried about bombs in this case. they're w

tom, just stand by been we want to go straight to joe johns, what are you learning?ral bureau of investigation is expected to release a statement shortly that i'm told will relate to an investigation of multiple letters with suspects ricin. i asked if this had to do with a letter to the white house, i was told that field tests have been conducted now on more than one letter, and i was told that that letter, the substance in that letter, was being forwarded to a laboratory for more testing. and also told that conclusive results could take to a week to determine positively if ricin is included. so we're waiting for them to release a statement on the situation, and i think it's important to say that we do know that ricin is the type of substance that can be manufactured relatively simply. it's from the kas per plant. so there is -- authorities want to be very careful to make sure what nay got is the active substance ricin. >> we will be awaiting for that statement from the fbi here. thank you so much. >> we're joined now by julette k keynan. they're now investigating mu

joining me now is cnn crime and justice correspondent joe johns.ed about how dzhokhar tsarnaev has responded to hearing these charges? >> this is pretty interesting stuff, ashleigh. these are the clerk's notes from the proceeding held before the magistrate. we now know her name is mary ann bowler. an initial appearance in federal court, according to this, when the defendant was advised of his charges, the defendant declined to answer bail questions, he ascented to a probable cause hearing which is supposed to occur on may 30th of this year, and it also says, interestingly, the court is satisfied that the defendant is alert and able to respond to the charges. so that would suggest to us that this defendant actually understands what's going on here, and we do know that he has been communicating with authorities who have been asking simple questions. so that adds to the knowledge a little bit, ashleigh, of what is going on in that hospital room. >> but, joe, still that critical question, has he ascented to the miranda rights, has he retained counse co

joining me is jessica yellin and cnn crime and justice correspondent, joe johns. welcome to you both. jessica, the president was very careful with his words. he didn't mention terror or terrorism but i believe the white house has been briefing, and they view it as a terror attack. >> reporter: that's right. shortly after the president made his statement in which you're correct, he avoided using that word, i spoke with a white house official who said that they want to be clear that the white house clearly views an event like this in which multiple explosive devices appear to have been used, that was their language, this is as clearly a terror attack. that was their exact phrase. but investigators have to determine whether it was carried out by a terrorist or terrorist organization. so they are differentiating between what they call an act of terror in which individuals, americans are killed, and harmed, and an investigation that determines that terrorists are individuals involved with those organizations were engaged in this activity. so they're trying to make a po
