you've got one judge, john leon, saying this was an unchecked, unbridled, limitless in scope invasion of fourth amendment issues. that's the idea that you have some rights of expectation of privacy with data. then you have the judge today deciding that, in fact, this was the government's attempt to counteract al qaeda. the problem is from a legal standpoint it's limitless and the nsa program as it is now isn't focused. it's limitless. to apply these basically huge data gathering without any evidence that the person engaged in -- that you are getting information on may have ties to a terrorist group or is making calls that meet a data requirement, those limits aren't in place. it's troubling from a constitutional perspective. these are close calls. i'm in favor of the patriot act. this is going to be a close call in the supreme court i suspect. >> there is a conversation about finding balance between protecting the country and the privacy of americans, things embedded in the fourth amendment on search and seizure. and something that americans guard closely. it's an important bedrock an
