john malcolm is at the heritage foundation, also a former deputy assistant attorney general.you. >> good to be with you. mike: how much do you assess the lengthy interviews don mcgahn with special counsel mueller played into the president announcing his expected departure on twitter? >> i'm not sure there was any connection. don mcgahn, it's an exhausting job being white house counsel. of course, he was his counsel during the campaign as well which also have to have been exhausting. he's been an outstanding white house counsel, giving political and legal advice to the president. what he's done on judges is spec tack spectacular. he is the lawyer for the office of the president, he's not the president's personal lawyer. his conversations with the president clearly could be subject to executive privilege, depending on what they discussed. i'm sure when he went in with his discussions with special counsel he did it in consultation with the president and the president's personal lawyers. the mueller investigation is ongoing. i don't see it wrapping up any time soon. i'm not sure

joining us now with what we can expect, john malcolm, director of the me center and senior legal fellowwith us. you know, there is a pro and con to a candidate like kavanaugh. he has written approximately 300 opinions during 12 years on the bench. pro is you know where he stands on a judicial basis, the con is that perhaps anybody who seeks to block this nominee has a lot to work with so what are you expecting? what are some of the opinions that you would point to and say dems will latch on to that and make it an issue >> after you've authored 307 opinions and joined 391 other, there will be some case that somebody is going to object to kneel go gorsuch had the frozen trucker case and certainly there are cases where brett kavanaugh has ruled against or with administrative agencies he's ruledagainst the epa on a number of occasions. he wrote a dissent in a case involving a trainer at seaworld who was killed when dragged under water and drowned by one of the killer whales and osha held that she was entitled to damages and that the employer should have been fined. and brett kavanaugh disse

. >> a few months ago i told john malcolm i would talk tonight about the separation of powers. i suppose that was not really a limiting selection of a topic for me, because if you were in my judicial chambers at really any point, you would hear me often saying to my clerks, every case is a separation of powers case. and i believe that. who decides is the basic separation of powers question at the core of so many legal disputes, and the bread-and-butter of our docket on the d.c. circuit is interpretation of statutes, usually when deciding whether an agency exceeded statutory authority or statutory limits. that question of policing the balance between the legislative and executive branches constitutes one of the most critical separation of powers issues in america. if you sat in our court room for a week or two come a listening to case after case after case, and i do not advise that for anyone who wants to remain sane, [laughter] you would hear judge after judge across the ideological spectrum ask counsel about the precise wording of the regulation or issue. statutory interpretat
