and alison this was before the jury came in yesterday morning, kind of a surprise, the attorney john mccarthy got up and said he had two motions to address with the judge one was this motive, issue, and basically he is saying, that on the night murray was killed, she apparently had checked norwood's bag and found some merchandise in her bag brittany didn't have a receipt for as she left, she got on her cell phone and called a woman who works at the store and asked, if in fact she had sold this merchandise to brittany because that is the story brittany told her. she said no, she did not sell any merchandise to brittany and then, the state's theory is norwood called murray and said she left her wallet back at the store and this is where the premeditation came in. the state believes she lured her back to the store. the judge says he will not allow it, it is hearsay, murray is gone she cannot testify to this. the only person who can is chioma. the judge said this is classic hearsay i won't allow it. >> a big part of this story was both of these women had been attacked and the jury heard evidence
