john maclean who was from ohio. he is sort of filling that seat. miller from iowa, just as john mclean, who was from ohio. he was filling that seat. miller from our, this is what was happening. is that basically, the circuit that had been represented in circuits, the slaveholding states had basically been spread over five ircuits and they were down to a.hat which made it possible for miller from iowa to hold the seat made possible by daniel. very significant that they didn't want to put illinois and iowa in the same circuit. it would mean these two individuals would be nominated. lincoln wanted to nominate davis because davis had been his campaign manager in 1860. that is a political favor, part of what is happening in the 19th century, this system of patronage and cronyism. andrew jackson did the same thing back in 1830. that is why we end up with davis. there was a brand-new seat on the court in ,hat they add a 10th circuit and therefore, a 10th justice. so what happens is not only do they reorganize these circuits, which explains what happens here. what happens is they add an extra circuit to deal with
