this we will discuss it with chief law enforcement and intelligence analyst john miller. john, when you are hearing katelyn's reporting about what we know so far, what stands out to you about this and the fact that we are seeming to be seeing this sort of thing more now? >> well, we are seeing this threat stream light up with this vitriol because of a couple of factors. one, there is what you could call the trump factor which is that he goes and makes very personal attacks against the judges who rule against him which is pouring gasoline on the fire within the chat rooms where a lot of the threatening language is being discussed. the other factor is simply the anonymity offered by internet platforms where people go by screen names or handles. one of the things that the fbi really brings to this case is their ability to take something that is under the law would be considered an illegal threat, which is more than angry talk, and it is a threat to commit violence against a public official for doing their job and tracing it back to the individual because of the bureau's techn

that all i saw. >> john miller, your reaction? >> as you indicated before, we have done this too many times. the fact that this is familiar to us is a problem. the washington post reported by its count in the last three days, this broke the record for the shootings. i think we had passed 37 for the period they were looking at. this by '39 today. depending on the numbers, i think they define a mass shooting as a shooting incident where four or more people were shot. that a problem. there is also the question, as juliet was talking about, what about the motive here? is this a student? is this somebody from off- campus? is this related to events going on overseas as the fbi director was concerned about yesterday? i say that in the context of, this is las vegas metro. last friday, just a few days ago arrested a 16-year-old suspect who was gathering bomb components and posting on an online message board about following isis propaganda and launching an attack in las vegas that would let the zionists know that i'm here. we still have not

let's dig in deeper with john miller and andrew mccabe. andrew, how do you assess trump's argument that he has absolute presidential immunity in this case and how do you expect this case to play out from here? >> as for his argument, i think most legal cscholars of are in the camp of, it's a real long shot. i think the basic premise of holding the president essentially above the criminal laws of this country, it contradicts everything we know about what the framers intended and captured in the constitution itself. i think they're going to have a really hard time persuading the appeals court and the supreme court if it gets in front of that court eventually. however, what's going to happen as we go forward, who knows. this ball is still in the air. it will obviously go through the schedule that jessica laid out, it will be heard by the d.c. circuit. if trump loses at that level, he has two options. he can ask the d.c. circuit for a rehearing in front of the entire court. he's not entitled to that, so they might turn him down. or he could go

i want to bring in john miller and charles ramsey. police say there's no more threat and the suspect is dead. how will they be working together to piece this potogtd? >> it's good to be with you. what they're doing is processing the scene but also trying to get id on the suspect. now they may already have that. he is deceased. may have had id on him. may have been able to do it through prints. we don't know if it was a student. we don't know anything. at least not on the public side. at this point in time. but obviously, you'd want to conduct search warrants. where the person lives, if he's a student, his room. if he had a vehicle. all those kinds of things. looking for motive. trying to find through social media or something that would lead them to understand why this was done. so this is going to take some time. they're still processing the scene. they're still going through all the buildings which they have to do. once you tell someone to shelter in place, that's what -- be able to locate them, but also make sure we don't have anyo

cnn chief law enforcement and -- john miller here with us. now, john, what we know about what exactly the fbi is looking into? >> what the fbi is doing primarily right now, john, is assisting local law enforcement, because otherwise they have to find the federal violation. under colorado law, making a threats against a judge or an elected member of the assembly is considered an act of retaliation, it's a class six felony. but, it's also spells out that it has to be a credible threat. here is a difficulty for law enforcement. first, identifying these people with their handles and screen names. that campy done. the fbi is really good at that. second, doing the threat assessment which is is just threat real, is this person -- is what they said although a real threat, is it a credible threat through means to carry out? but, the hard part is that we've learned again and again that you can pick your case. judge esther salas whose son was murdered at her home in new jersey, who passed a lot of protective, the nancy pelosi case with the home invasion

with us now is john miller. let's start with the gilgo beach alleged murder.n, how long was that a case where they just didn't think that they had leads? and then all of a sudden this. >> so that was an issue of leadership. rodney harrison, a new police commissioner, came into suffolk county and not knowing anything about the case said one of the things i'm going to do is we're going to solve that case. what he knew was how to solve the case. he brought in the fbi, he brought in the new york state police, he brought in the suffolk county sheriff's office. he sent them all to a place away from their offices to work as a team and said, don't come back until you get this done, and literally within a couple of months 13 years of mystery was unraveled with a suspect. >> donello cabacante. we were sitting on this set when he was captured and got first video of it. the what stood out about that search and the eventual capture? >> what stood out about that search was we think of a fugitive hunt. we think of an urban fugitive hunt and you're in the alleys, streets, you

joining us now is our chief law enforcement and intelligence analyst john miller. >> zboorm. >> let's begin with all of these threatening emails and then also the swatting calls. do they have a sense of who is behind them? >> their only sense of who is behind them comes from prior investigations. but what they have found in these instances, particularly targeting jewish schools, religious institutions have been these have been kids and young adults, both in the united states and outside, using different techniques to mask their computer identity, their telephone identities and so on. >> john, the anti-defamation league said they believe these are hoaxes, but, quote the jewish community doesn't take any threat lightly. we don't have the luxury to ignore them. how does law enforcement both assess the overwhelming amount of threats that are incoming right now and deal with something like swatting calls? >> so it's a complicated question because these emails that went out over the weekend were addressed to multiple locations. so one email would say, there's bombs in yo

let's bring back in john miller and former dhs assistant secretary and cnn national security analyst julia kayam. john, what are the biggest questions you have right now? >> the biggest questions we have are still the fluid ones, which is what is the extent, the human factor here? how many people have been hurt or killed? the good news, if you can call it good news, is that the numbers we're getting are these single digit numbers, maybe three with one deceased being the shooter. we don't know the condition of those other people. those numbers can change. one other factor is about the sheriff, the fire chief and the chief of the university police coming up to the microphone and saying so little is having been in these situations myself, the information changes. the numbers go up, the numbers go down, they're adjusted. the facts shift because different facts are coming in literally as you're walking up to the mike crophone. so you try to stay what you're sure of, but those numbers are reassuring in that we have seen so much worse. the governor has been in direct touch with them, talking
