john rawlins is live outside of the camden county courthouse. what are the deal tails? >> reporter: the news came at 4:00, the judge pointed out that jurors in this case took a significant amount of their time not deliberating but rather in open court replaying evidence, given that he is hoping they will come back tomorrow and engage in trying to find consensus. >> it's your juries to consult with one another to reach an agreement. can you do so without violence and individual judgment. each of you must decide the case tore yourself. >> following that formal charge, the judge said. >> i contact that you return tomorrow to make an effort to reach a verdict if you can. >> they began deliberating the case a week ago but due to a scheduling issue and memorial day they deliberated a little over three days. it's not clear what is dividing the jury. they asked three times in the last three days to replay this video of the video of the defendant creato reacts to being told that his 3-year-old son brendon was found dead in cooper park. >> he answers questions in an hour and once

"action news" reporter john rawlins live outside of the courthouse with a look at what the jury has to consider. >> reporter: hi sara, this trial began on april 20th and since then the jury has seen a lot of evidence and heard a lot of testimony about the toddler who went missing in october of 2015 but whose body was quickly discovered. it's a circumstantial case and to dna and no witnesses and no video tying the defendant, the little boy's father to the crime. >> the jury is deliberating an extensive but circumstantial case against david creato. the prosecution's case is that he killed his little boy, brendon in order to maintain a relationship. and she said she considered breaking up with creato because she was upset with the 3-year-old's presence when the couple spent weekends together. >> this defend got out of his bed and went into the living room and took brandon's pillow and put it over his face while he was sleeping and held it there until brandon died. but there is no actual evidence of what ended his death. they say it was consistent with oxygen deprivation and ruled it a hom

john rawlins is live at courthouse in camden where the jury asked to review more evidence this morning. >> reporter: hi rick, actually the request for the evidence came last week, it was a rather large request and they only got to the last part of it this morning it was an audio replay of testimony. and the jury spent 45 minutes listening to an audio replay of earlier court testimony from a detective and display of a powerpoint log of social media contents between david creato and his girlfriend. and it lists contacts through phone and snap chas and texting. after the little boy was reported missing by the defendant. the jury requested this last week among other things, the recording of the 2015 interrogation of creato where detectives first told creato his son was found dead. >> no no no no! no no no. >> follow that emotional out burst it shows he regained his compositioner. the prosecution says he killed his son to maintain a relationship with his then girlfriend, who the prosecution says didn't like children. >> after listening to the replays of the testimony the jury retired to the
