after the break, what chief justice john roberts and his cohorts in the court said about same-sex marriagen the supreme court today. we have it all on tape, right after this. ♪ john: landmark cases at the supreme court are like vin scully calling a double-header -- you know you're in for a long haul, but you savor every word of it. we will play some of the best bites from inside the supreme court oral arguments on gay marriage today. let's start with what was said by justice anthony kennedy who many consider to be the crucial swing vote in this particular case and this issue. justice kennedy: when you think about these cases, you think about words or cases. the word that keeps coming back to me is millennia, plus time. first of all, there has not been really time for the federal system to engage in this debate. the separate states. on a larger scale, it has been -- it was about the same time between brown and loving lawrence and this case. john: greg, justice kennedy is somebody who people on the pro-gay marriage side have counted on as a safe vote. there he was expressing skepticism about

i think there is a possibility they get justice roberts. johnpeople misunderstand the purpose of the oral arguments. the justices are asking questions. justice roberts asked questions that seemed soto suggest that it could be in the political level. he also raised the point that it is not sexual discrimination. he is trying to persuade people. these are not just expressions of opinion. they are asking questions of better strategic. you can see some things, certain things from what they are asking. you got justice scalia, you can read him pretty easily. the guys in the middle are much harder to note. mark: the fact of the justices double will vote against further expansion of rights for gay lesbians to get married, the fact that all of them are conservative is representative of the divide in america. too much in the media coverage today and of the arguments today is rooting for the court to overturn this. there are millions of americans on that side, too. i think the simplest thing to look at is justice kennedy's stance on these issues. he is not

but john roberts said something today that seemed to make a lot of sense. and tom loves joe sue can marry him, and tom can't. why isn't that a straight forward question of sexual discrimination? do you take heart in the fact that those words are coming from john roberts' mouth as sort of maybe a bellwether of where the court's going to go? >> i think there's some real insight from all of the justices including chief. tough questions come from all of the justices that asked questions. they pose tough questions to all size. but the point that you were just making before alex the other question that our opposition must answer and they couldn't in court is what harm is done? what harm is done to that straight couple that's been married for ten or 20 years, when john and joe or jane and jill next door get married? is their marriage all of a sudden going to fall apart? of course not. but they have to answer and show what harm could possibly be caused by allowing gay marriage. otherwise, there's no legitimate reason to discriminate against our fellow gay and lesbi

charlie: chief justice john roberts had a question about the political power of same-sex couples. did that come up? adam: it sure did. it falls on david's point, society is moving fast. in court, that may cut both ways. if this issue can be resolved democratically, at the polls and through ballot measures, the supreme court could be a little wary of stepping in and putting an end to what chief justice roberts called a fast-moving debate. he referred to public opinion polls. he said, this is getting settled on the ground. is it really for us nine unelected justices, unrelated to the ballot box, to step in and tell the american public what they have to decide, what each state has to decide? that point was echoed by a liberal justice. the enormous societal shift, which is without precedent, is a sign the court is likely to rule in favor of same-sex marriage. it does give rise to an argument that cuts the opposite way as well. david: there is something have to focus on. although public opinion has moved tremendously, there are a handful of states in which realistically we are not goin

senior national correspondent john roberts joins us live from north charleston south carolina. john? >> good afternoon to you. the protestors will be back here at the north charleston city hall about 12:30 today. protests, demonstrations they had this morning were all very very peaceful calling an end to police action saying there's far too many incidents that go on. when you take a look at the videotape, in this particular case at least they make a salient point. it's about 9:30 saturday morning in north charleston. walter scott is pulled over for a traffic violation. he had a broken taillight. scott apparently tried to flee according to his brother. he had some delinquent child support payments didn't want to go to jail for that after being pulled over for a traffic violation. slager tried to hit him with hiswatch what happened immediately after that. sleger fires eight shots, five of which hit walter scott. he died soon after that. slager was arraigned on murder charges. family of walter scott obviously grieving but according to their attorney, taking some solace in the idea

john roberts said this that is the case one state that legalizes and everybody can travel there and go home and recognized in all 49 states and a single state setting policy for the entire country. kennedy has been supportive of gay right in the past and talked about the dignity of the families and children adopted by gay and lesbian couples and he was very hard on both sides and one point, he said is it for us after thousands of years of a certain way and people saying quite, we as a court know better than you do and tell you how to define marriage. and the chief justice said you are not asking to join the marriage institution, you are asking to it redefine it. and there was skepticism from the justices and saying there is a certain dignity and why should the states recognize birth certificates and not a marriage certificate. it will be a tight case and probably a 5- 4 decision and we'll not have a decision until the end of june. and we'll get the audio today that is rare and you can hear the justice's voices for yourself. >> i look forward to that. shannon thank you. >> more ahead on
