as chief justice john roberts described it, he said where racial imbalance is a product not of state action but of private choices, it does not have constitutional implications. in other words, if we have a system which is not established by the government, then we have no obligation to undo that system even if we can prohibit discrimination going forward. this view that we have de facto segregation has been a dominant view of the supreme court for the last almost 40 years and it has taken over all our conversation in the public policy realm. in 1974 justice potter stewart in which in a case in which he was joining a majority that said that we do not need to desegregate on a metropolitanwide basis because he said the segregation of metropolitan areas -- in this case he was talking about detroit, of all places. he said the segregation of metropolitan areas was created by unknown and perhaps unknowable factors such as immigration, birthrates, economic changes, or cumulative acts of private racial fears. that's the dominant narrative in this country still today. now, as you heard earlie
