john roberts. john, how did this all go down? >> reporter: sandra, good afternoon to you. it did not all go down this morning. it wasn't something that suddenly happened today. this has been in the works for some time. we have heard, via "the new york times" that steve bannon may have tendered his resignation as early on as august 6th. i'm told that that timeline might be a little bit aggressive. but that this has been going on for at least a few days. we do know the chief of staff john kelly has been reviewing, evaluating a lot of the positions at the west wing. steve bannon's was among them. i'm also told by an administration official that the interview that bannon did with the american prospect, quote, didn't help his case, in terms of staying on at the white house. while bannon was definitely a darling of many conservative, he was also seen in the white house as something of a divisive figure. though it was also said to be aoeud logically very much along the same lines as the president. here's official statement from the white house saying, quote, white house chief of

john roberts has that live on the north lawn. john? tively new member of the president's white house counsel team, ty cobb, noted lawyer around these washington parts. he said they have not been notified whether or not robert mueller has in fact empanelled a grand jury. cobb told me "we favor anything that brings this investigation to a swift conclusion." other folks that i've talked to said, you know, this isn't a big deal. it's a routine investigatory tool. but we have seen in the past this these grand jury investigations can go different directions. the white house is accepting this of what they thought the process would be. i don't know that anybody thought that robert mueller would engage in this investigation and not at some point empanel a grand jury to hear some sort of evidence and perhaps testimony on top of that. but folks that i've been talking to have been playing this idea down, suggest that it's really no big deal. something that they expected and again to quote ty cobb saying they favor anything that brings this investig

john roberts is live at the white house. but first we start with doug mcelway live from the department of justice. doug, we understand the administration wants to potentially look at reporters roles in these leaks. what did they say exactly about that? >> reporter: this may not be all that surprising, sandra, given that the president repeated the same for what he calls the quote unquote fake news media. there are many constitutional scholars who will tell you that reporters are protected by the first amendment and that the first amendment is sacrosanct. but there are many cases where reporters have been jailed for refusing to divulge their sources. judith miller was jailed for 85 days for refusing to divulge a source of course, demanded by federal judge thomas hogan. our colleague james rosen was named an unindicted co-conspirator by the obama justice department, eric holder. but this treacherous road is one of the reasons that attorney general jeff sessions may have worded this so carefully when it comes to reporters. here

i gave you a teaser with my comment about samuel alito and john roberts. there have been two important cases. and i mention them to bring us up to speed with the exclusionary rule and also to end with comments before where i think we're going to go from here. there's a case in 2006 called hudson versus michigan which dealt with what's called knock and announce when people have to nong for a pefrt before they enter into the room. what's important in the decision although it was a smaller part of the decision is justice scalia as's comments that he thought it was pretty much time to evaluate the exclusionary rule. and one of the reasons earned re-evaluate it is ironically because the need tore is it no longer existed because the police had been professional iced and because the police were acting professionally you don't need the exclusionary rule. he also suggested there were other remedies that you could use if people had their evidence seized from an illegal search. so criminals could always sue the police or maybe the mills can police themselves. and the
