but let me just ask you this again, john roberts said that roe v. wade is the settled law of the land. do you believe it is the settled law of the land? >> roe v. wade is an important precedent of the supreme court. it was decided in 1973, so it's been on the books for a long time. it has been challenged on a number of occasions and i discussed those yesterday and it is my -- and the supreme court has reaffirmed the decision. sometimes on the merits, sometimes, in kc, based on stare decisis. i think, that when a decision is challenged and it is reaffirmed, that strengthens its value as stare decisis for at least two reasons. first of all, more often a decision is reaffirmed, the more people tend to rely on it. second, i think stare decisis reflects the view that there is wisdom embedded in decisions that have been made by prior justices who take the same oath, and are scholars and are conscientious. and when they examined a question and they reach a conclusion, i think that is entitled to considerable respect. of course, the more times that happens

i don't know exactly what john roberts can do about it in these cases.-- i'm the wrong person to have on to talk about what the powers of the chief justice are in toto. there are so few cases in which the chief justice has been called upon to use all of the powers the chief justice has. but i think in some cases there's not much that he can do. now, there is some question obviously about whether roberts could step outside the traditional role and decide to do things that no supreme court justice has ever done, like try to call on clarence thomas to recuse himself from cases where he seems to have a conflict. but i do think that one of the things that the poison fruit at the center of all this is as we've learned more about ginni thomas and her role we've never gone back really and had a full accounting of clarence thomas's role on those cases that he's ruled on where he now seems to have been obviously conflicted. we had -- there's been so much news around all of this. now have an understanding about her. but at the time when we learned about her role at

one of the things i both of and hate about john roberts is he has approached the constitutional reform that gets you every so often until he gets you where he is going and that is what is going to happen this fall. the chief justice has already signaled he has real opera henchmen -- apprehension to the 14th amendment the correct view of the 14th of movement so i think this fall he is ready to deal the deathblow. we are not concerned that things are moving to the right. we expect that. we lost the election. what we are concerned about is the court doesn't seem to be following the precedent set for itself. guest: i will tell you another president, a foundational decision that lasted for over 50 years. that was plessy versus ferguson. that was an 8-1 supreme court opinion saying separate but equal. was the law of the land. it was an erroneous decision it was wrong the day it was decided you and i would both agree that think god that decision was overturned. the same with the case with roe and which the supreme court made up the constitutional right host:. our guests are with us for the ho

host: last month, john roberts spoke about the legitimacy of the court. this is chief justice john roberts from september 9. >> the court has always decided controversial cases. the decisions are subject to intense criticism. that is entirely appropriate. citizens feel free to criticize our opinions and how we do our work. lately, it is phrased in terms of questioning the legitimacy of the court. i think it's a mistake to view those criticisms in that light. the legitimacy of the court rests on the fact that it satisfies the requirements of the statute and the constitution needs somebody to say what the law is. that doesn't change because people disagree. obviously, people can say what they want. they are free to criticize the supreme court. if they want to say it's legitimacy is in question, they are free to do so. i don't see the connection between opinions and the legitimacy of the court. if the court doesn't retain its legitimate function, i'm not sure who would. you don't want the political branches telling you what the law is. you don't want public
