does any of that surprise you, john yoo? >> i was really surprised.you go back to the time before these indictments, donald trump didn't have over 50%, and ron desantis was pretty close. i think he was within 7-8 points of the former president. but what donald trump did which i think was an amazing feat of political jiu-jitsu as he turned the courtrooms into a political forum to make his case for reelection. remember, he didn't show up for the debates with the other primary candidates, but he went into courtrooms, he confronted the judge in new york city, he's been giving speeches out in front of the courtrooms in washington, d.c., and he managed to turn that into the message of the campaign so far, that the establishment and the biden administration are persecuting him and trying to prevent him from getting on the ballot. >> trace: you talk to some legal experts, and maybe you agree with this, they believe the georgia case might be the most perilous for the former president. but now you have the fulton county d.a., fa willis, accusative hiring her pr

to john yoo, the u.c. berkeley law professor. , i read a lot in to some of the questioning that donald trump's team was getting as well as questions indeed for prosecutors, but it seems like they would err on the side of not allowing that immunity, which seems to trigger taking this up to the supreme court. what do you think? >> i think neil, you have a good read on it. if you look at the transcript, listen to the clips. i didn't hear any judges say that they thought there was presidential immunity here. the questions were pretty hostile to the president's position even from what you played in the clip even from judge henderson, the most conse conservative. if i had been president trump's lawyer, i would have not said show up in court. clients are not allowed to speak in this kind of proceeding, this is a high level argument with three very smart judges. the d.c. circuit is sometimes thought to be better in terms of the quality of judges and they ask tough, hard questions. so when the you listen to clips, look at the transcripts,

john yoo joins us now. where do you think this goes? we'll get an idea how the justices are feeling about this. you need a pretty strong majority in either case, don't you? >> there's two big deadlines coming up, neil. next week is when the briefs are due not just from colorado but if we're going to hear from the biden administration. they've been quiet about how they're going to come out on this question. you can see that they might not want presidents being disqualified by 50 different states under 50 different standards. then as he said, neil, february 8, oral arguments. we'll get a good sense of where they are when they press the lawyers for trump and for colorado. i expect to be an opinion by the end of february. that is light speed by supreme court standards. they usually take almost a year to go from when they first hear a case to when the issue the opinion to get an opinion out in three weeks, that's them working around the clock. i hope like you do, neil, that it's a unanimous decision for the good of the country and good of th
