i yesterday asked professor john yoo about that january 6 case and played analysis of jeffrey toobin. the former president. he says that january 6 case is gone because of the rules of evidence put forward in the immunity case. he agreed. what say you? >> i think it is very, very difficult to do this. after the opinion came down at the court had ripped the wings off this case. smith is still trying to get it off the ground. he has a very favorable judge. i can imagine a more favorable judge. she is very motivated. she was working to get this trial on a rocket docket before the election. she is likely to continue to try to do that. that was part of the problem. she was moving so fast, she never bothered to create a record. there was no record for the court to decide these questions. it has to be sent down. if she comes back and says these are private actions that are not protected, that can be appealed. i think that the supreme court saw this development. they gave her some very clear navigational beacons to stay with him. they were very clear that when he spoke on the... , he was doing
