i'm jon kelley.> i'm laura garcia-cannon. the state is suing operators for taking donations accusing them of lining their pockets. now call for the removal of the board and millions in penalties. >> the state attorney general is suing help hospitalized veterans, it wants at least $4.3 million returned from the charity. according to a complaint filed by the ag office, both the current and former president squandered millions. officials say much of the money afforded them and board members a lavish lifestyle. specifically former president robert chappen accused of inflating his salary to retire with an almost $2 million pension plan and his successor accused of spending $80,000 in golf memberships for his board. according to its website the primary mission is to provide hospitalized veterans with therapeutic arts and craft activities. a watchdog group says only 35% of the group's funds actually go toward programs designed to help veterans. attorney general says her investigators spent the past year bui

i'm jon kelley. >> i'm laura garcia-cannon. claims now pouring in after nearly 1,000 people sought medical help in the wake of a smoky three-alarm fire at chevron's richmond refinery. christie smith is live in richmond where the legal problems are just beginning for the oil giant. good morning. >> when that black cloud of smoke sat over the city of richmond people started showing up at hospitals complaining ever breathing problems and eye irritation. today we expect to learn more about this claims processing center in the city that chevron is setting up. they could open their doors as early as today. we expect to learn more about repairs to the refinery's only crude oil processing unit. so far we've not been given a timeline of when it may come back on line after monday's fire that sent a huge plume of smoke over richmond and beyond. industry experts believe that the repair could take months and that it's possible that some of the work could possibly begin today or tomorrow but only after everything

i'm jon kelley. >> i'm marla tellez. we continue to follow breaking news happening now in the east bay. a car has gone off the road and into a dorm at the uc berkeley campus. the driver has been detained? >> reporter: yeah. they are still trying to figure out what went wrong and that's why the driver was detained. but not arrested. i was briefed by uc police and a much calmer scene out here right now. we're on college avenue right near channing. it it was around 2:56 this morning and a driver jumped the curb and lost control and crashed into the building. this is putnam hall, a dorm. students start school tomorrow. the dorm was filled with people. someone hit the fire alarm and the students evacuated. everyone got out okay. but that driver actually hit a gas meter outside and fractured the gasoline. there was a gas leak for some time but i spoke with pg and e and they told me that was capped within about 20 to 30 minutes so the latest we have here is that those students that were evacuated and brought to another hall her

i'm jon kelley. we get going with developing news out of lake county where wild fire this is hour are burning and threatening homes. these flames have scorched thousands of acres already and forced evacuations. marla tellez is in the newsroom, she has the latest information on this developing story. good morning. >> jon, good morning. we're talking about two separate fires, the wye fire also the walker fire as you said, they are burning in lake county. so far they have burned at least 5,000 acres. both are close to clear lake off highway 20 north of santa rosa, west of ukiah to give you more perspective. the two have been burning more than 12 hours. the wye fire is the bigger of the two, it has burned about 3,000 acres, and taken down three structures. it has the entire community of spring valley evacuated. that is about 480 homes. those are immediately threatened right now. joining me on the phone is the division chief with cal fire, todd durham, thank you for being with us this morning. can you hea

. >> i'm jon kelley. good morning everybody. we're learning more about that breaking news we've been following out of san francisco. a deadly early morning house fire in the city excelsior district. christie smith just arrived on scene with something that firefighters found inside that home that made this fire so tough to put out. what's happening? >> reporter: good morning to you, jon. we have a real tragedy here in vienna street. two people dead in a home, firefighters have the street blocked off this morning. what they tell us, neighbors, that they believe two elderly people live inside the home, when they came out neighbors say it was already burning. this is the excelsior district and firefighters say when they arrived there was heavy smoke and flames coming out of the front of the building. there is a huge window in front. they say that when they got there they ran into a big problem. i think that's what you were talking about, there was piles of debris all over the home. they say in some cases it was six feet high and tha

. >> i'm jon kelley. good morning everybody. it's often ranked one of the safest cities, now there is concern that san jose police are equipped to deal with escalating crime. in six days, four people are dead, a number of others injured. bob is live with a look at how city leaders now and the community are trying to deal with this problem. good morning. >> reporter: good morning to you, jon. yes, four homicides over the past week. police do not see this as being an upward trend, that's not how they are characterizing it. rather, it's anomaly according to the police chief moore. this map we're putting up on the screen shows the location of where those people were murdered. most of these crimes taking place last monday. there were two men shot in separate instances that day, and a third crime, a woman stabbed to death with a samurai sword. then yesterday morning the fourth homicide of the week, another man shot to death near south winchester. no arrests in that case. police are investigating whether at least some of these murders

jon kelley has the morning off. >>> breaking news. san jose place have now arrested a suspect in connection with a homicide that happened inside a safeway earlier this week. within the last 30 minutes, police announced the arrest of this man here. he is identified as 27-year-old michael howard. howard is accused of stabbing and killing 24-year-old juan miguel moones on monday night. he stopped at the saveway in east san jose on his way home from work. his body found in one of the aisles in the center of the store. they say he was a third-year accounting student at san jose state and had no known gang ties. investigators don't know the motive for the killing. last night, the victim's families and friends and some who didn't know him, lit candles and prayed for him. >> today, unfortunately, was our cousin. but tomorrow could be someone else's child. you know? it could be someone else's family member and, you know, it needs to come to an end and it needs to stop. >> there have been 32 homicide this year in san jose. it tomorrow, san jose

. >> and i'm marla tellez in for jon kelley. a developing story in san francisco where police have given the all clear to re-enter an apartment building evacuated because of a suspicious device. the building located on the 600 block of jones street, this is outside the tenderloin, was evacuated for a few hours after those suspicious items were found in the basement. 75 people were woken up and forced out on the street while officers went in for a closer look. the bomb squad was called in eventually after officers determined the items may be hazardous. >> there are 12 to 15 sections of pipe that had been cut and capped and contained a substance, i don't know the specific substance but the bomb squad working with the hazmat team determined that the contents were not explosive or hazardous. >> several streets were shut down. the streets have just been reopened. >> 6:01. san jose chief chris moore will hold a meeting with the gang task force to talk about with options for dealing with the recent rash of violence. christie smith live

i'm jon kelley. >> i'm laura garcia-cannon. new this morning fire investigators siflt through rubble this morning to find out what sparked a massive blaze at a san jose nursery. we have an update on the three-alarm fire. good morning. >> laura, good morning. that three-alarm fire is now out. fire crews are waiting for complete daylight to get a better look at all the damage. from what we're told what was summer winds nursery out here is lost this morning. you can get a good look for yourself. it's gutted and charred. you can get a look at some of the smoke that is continuing to rise from the interior, so firefighters are still on the scene searching for hotspots. the fire captain says it seems the fire originated near the electrical box. it caught fire shortly before midnight, at it's height about 65 firefighters were on scene, but they had to wait to actually start fighting the flames because of all the garden supplies inside. >> this was a large volume fire and the colors of the flames are hard to describe. the chemicals in t

i'm jon kelley. >> i'm laura garcia-cannon. we're following a developing story out of northern california where scorching temperatures, dry brush fueling a wild fire near clear lake in lake county. >> the wye fire has been burning more than 12 hours and it shut down highway 20 east of clear lake oaks and has people in spring valley community under evacuation orders. several hundred firefighters are there working trying to contain the fire which has charred at least 5,000 acres so far. a smaller fire is burning on the other side of the walker range. both sent up big plumes of smoke visible for miles. >> i went out to do other stuff and happened to see the cloud of smoke and i saw two different ones. it was just a pretty thick area of white smoke. >> great shots there. the weather today expected to make the matters worse. meteorologist christina loren, she's here tracking those conditions. good morning. looks pretty crazy out there. >> yeah, but right now is the time when firefighters will have an opportunity to get a handle on t
