owens corning ecotouch attic insulation is only $9.97 a roll. jon: president obama called it the signature achievement of his first year in office, america's new healthcare law. well that law could soon see a big legal test. the supreme court will decide -- could decide i should say the law's constitutionality if it's next term which begins next week. there could be a landmark decision handed down right at the height of the 2012 presidential campaign. steve centanni has that live from washington. steve, what are the prospects here? >> reporter: yeah, the justice department has made an important decision that will most likely see the new healthcare law going to the supreme court in its current term, or it's next current term that begins in october. the administration decided not to seek an appeal before the full 11th circuit court in atlanta after a three-judge panel on the same court ruled against the healthcare law in august. by a vote of 2-1 that panel said the government is over stepping its bounds by requiring people to buy health insurance, but

jon: right now, republican presidential candidate mitt romney is rolling out his plan for jobs and economicrowth. one day before president obama presents his new jobs package to a joint session of congress. joining us now is a senior adviser to mitt romney. former missouri senator jim talent. senator talent, what is the number one item mr. romney proposes? >> i think in a word, jobs and jobs by getting the government of off the back of the free market. it is a comprehensive and detailed proposal that we estimate will produce 11 1/2 million jobs in four years and very much an energy-type led recovery. there are three proposals in it, energy proposals by themselves would produce 1.6 million jobs. jon: in what way? are you talking about drilling? >> yeah. the keystone pipeline, exploring for natural gas in the shale gas and offshore drilling we estimate 1.6 million jobs just with that alone. but there is also dramatic capital gains and dividends, relief. waivers for all the states from obamacare. regulatory relief, regulatory balanced budget, repealing dodd-frank. it is bold but comprehensive.

jon: and those numbers are obviously going to play a key roll in this next presidential election when electoral college. >>> right now the issue the democrats and republicans can agree on, the senate pushing a bill urging china to stop manipulating its currency, this after critics have long complained that china's juan is -- yuan is greaty underpolled -- undervalued. congress' wishes, putting it on a potential collision course with the white house. our chief congressional correspondent mike emanuel takes a look at that. >> reporter: president obama has been pushing congress to pass this jobs plan, but senate majority leader harry reid, and fellow democrats, say he has a different priority now. take a listen: >> i don't think there's anything more important for a jobs tpherb euroo measure than china trade. that's what we're going to work on next week. china trade is a jobs bill, it's a long -- it's long, long overdue, it's a bipartisan bill and i feel very comfortable we're going to pass that. jon: republican leadership says this is senator reid giving members something they can vote f
