i'm greg jarrett in for jon scott. jenna: myself to have you with us today as part of our team. hi, everybody, i'm jenna lee. police are questioning a man they say has implicated himself in the disappearance and death of missing six-year-old edan patz. police dug up a basement a month ago searching for the little boy. he was walking to a pus sto bus stop in 1979. he was the first child to have his face on a milk carton. david miller joins us live from the latest from our new york city newsroom. we know there is somebody in custody, what else do we know about them. >> reporter: there is not a great deal of information being released about this individual. one thing worth notes is that the little boy disappeared exactly to the day 33 years ago tomorrow. as for the individual now being held, his name widely reported as pedro hernandez, the police have not officially named him as a suspect. we have not been able to confirm that is in fact his identity. he was reportedly picked up wednesday, in camden, new jersey. and made admissions. one website quotes hernandez as saying, i did it.

jon: i'm jon scott. the jury is now ibt thering for a third day on charges that could send the former presidential candidate to prison for 30 years. if he convicted of violating campaign finance laws in the effort to hide his pregnant mistress. at issue, whether or not edwards used campaign funds from two wealthy donors, including 101-year-old heiress, rachel, bunny mellon. to conceal his affair with rielle hunter as he tried to win the democratic presidential nomination in 2008. jonathan serrie live outside the courthouse in greensboro, north carolina, now. any indication, john than, how long it will take the jury to reach a verdict? >> reporter: jon, yesterday the judge was discussing logistics with the jury, talking about when the jury would break for lunch and when the jury would break for the day, not specifically that day but days in general. it appears that the court is prepared to deal with logistics for deliberations for the long haul. take a listen. >> this jury in particular asked for office s

jon: i'm jon scott. welcome to a brand new hour of "happening now."ohn edwards facing up to 30 years in federal prison if a jury decides he knowingly broke the law to cover up an extramarital affair while he was running for president. as you know, this involves rielle hunter, his former campaign aide. edwards charged with six criminal counts including conspiracy to violate the federal election campaign act. he also faces up to, faces more than, i should say, $1.5 million in fines if he is convicted. jenna: it's been such an interesting case to watch. as you remember, the prosecution took about 14 days to present their case. they went through andrew young, that is his -- you're looking at john edwards' former top aide. he had several days on the stand and a lot of different testimony not only about campaign finance, but also character when it comes to john edwards, and that's going to be something interesting to see, how the jury takes not only the charges at hand, but also the character of john edwards as well. the defense decided to rest after three

jon: i'm jon scott. we are america's election headquarters. the. the battle between president obama and presumptive gop nominee, governor mitt romney is heating up. new numbers on the head-to-head matchup. "new york times/cbs" poll giving governor romney the edge for the first time since january. 46% of the registered voters saying they would vote for mr. romney. 43% gave their support to president obama. that three percentage point lead though is still within the margin of error. governor romney feigning ground when it comes to key voting blocs though. leads the president among independents 43 to 36%. he is also ahead when it comes to female voters with 46% of the women favoring governor romney to the president's 44%. keep in mind, some cautionary notes from our polling unit. the sample size in this poll is not as large as usual. and there are some concerns with the poll's methodology. still it adds ammunition to the argument that race is very close as it stands right now. chief white house correspondent ed henry live on the north lawn for us. we
