jon tester is a member of the homeland security and government affairs committee that will hold that a second, senator. do you think some of your colleagues are using it for information to get in their jobs to make money for themselves like in the stock market? >> i'll make no assertions whether they are guilty or innocent or have done anything wrong or not, but what we will do with the stock act and with the help of senator gillibrand and others in the senate is make sure we do not allow people who are members of congress or their staffs to use insider information to personally profit. that's not right. that's not why people serve in congress. and we just need to make the rules clear. shine a little sun light on it and the issue should go away. >> you have not used insider information, right? ? >> gosh, no, you've got to have money to be able to invest. >> there's a bill in the house also that really hasn't gone anywhere. what's happening there? >> well, you know, we're getting ready to drop the bill into the senate and basically what it's going to do is prevent members of congress

senator ben nelson and senator jon tester both now saying they will at least think about now not siding with the republicans to filibuster infrastructure again. they will at least think about voting to allow a vote on the bill. instead of joining the republican blockade. which is progress. really, really, really conservative democrat joe manchin of west virginia signed on to the bill as a co-sponsor with senator klobuchar. we expect republicans to be unified against jobs bill at this point, even on infrastructure which they used to support, but if the democrats stop splintering on this side of the issue, that frankly is a big political leap forward for the democrats. and for the record, as a matter of strategy, democrats getting together on this 100%, no defections, is a necessary step toward getting some republicans to peel away from their own party and vote for this thing. everybody says a jobs bill cannot pass. even roads and bridges. keep your eye on this one. it is moving. democrats making a ruckus these last couple days about republican efforts in the states to make it harder to v

i know jon tester and a couple other people are on it.g on it now. this could garner good bipartisan support and it'sç common sense. it's what the american people expect. they see washington is broken. if we are going to restore confidence in the government this is a good first step. >> there is a real confrontation looming especially tomorrow with occupy wall street. new rules from the bloomberg administration and elsewhere around the country there have been evictions. where do you stand on what's happening happening happening in zuccotti park. >> this is a sense of anger and frustration the american people have about the economy, about where it's going, the lack of economic opportunity for everyday americans. that has to change and that's what's incumbent upon us in washington to work on legislation that can create a better environment for job creation. >> and the super committee, time is running out and the leadership has gotten involved. is there any kind of indication from your inside information that they are getting to an agreemen

claire mccaskill and jon tester, both of them are going to have -- those races are going to be fantastic to watch. i don't know why people are pulling a lot of the races these days. they will be two-point race is no matter what. if tim kaine and virginia is up by one or george allen is up by one and it's basically the only result you were going to see from now until the end of the election. the partisan polls that actually get into the issues and why people are voting for one or the other, those would be the ones that matter. the democratic open seats are largely in the states that are going to be competitive in the presidential election and in the states like wisconsin, which is perpetually it part of what we call the blue wall but may in fact be a little more competitive this year. we saw the big republican swing in wisconsin in 2010, in mexico perpetually a swing state moving away from republicans i think, but a chance for the former congressman heather wilson if she remains unscathed largely in the republican primary to steal a democratic senate seat and i already mentioned tim kaine
