i expect jonathan will spend a little bit more time. as far as we know, no one has researched this issue as much as we have. far from being a typo, these provisions of the statute and limitations of the subsidies established by states are consistent and tightly worded. the eligibility rules for the subsidies refer solely to subsidies established by the state. they use that phrase explicitly twice and never deviate from that language. whereas in other parts of the statute authorizing tax credits for small businesses who give their access -- their employees access through an exchange use that phrase, "an exchange." this provision of the law does distinguish between the two consistently. the law also defined for those who are not sure what "state" means, the law include the definition. the defined to mean the 50 states, plus the district of columbia. we have an example of congress deeming a nonstate to be a state, and thereby authorizing the subsidies within that policy. similarly, the statute says if a territory create such an exchange, s
