joining me now jonathan turley, george washington professor and constitutional law expert. >> cut tohe chase. how will this turn out. >> on the issue of whether this is a tax or penalty the justices seem very skeptical, as you've noted, that there is this threshold barrier that would prevent them from ruling. the fascinating thing about this is that all of the parties in the case basically pleaded with the court not to apply the anti-injunction act and yet the court went out and got an independent lawyer saying we want you to argue this issue. we'll give you all this time. but when he finally got up there, they gave him a pretty hard time and said, what are you talking about? this doesn't look like a tax to us. >> is that what the lawyer representing the 26 states opposing this law were kind of a practical joke that the court is playing on the public? >> i was really surprised. it's not a good idea when you're going in front of the court to say that they gave the nation some wet willie as a joke. he's going to have to appear in front of these people. that's not going to be a subject

reason that george zimmerman has avoided being charged so far i'm joined by countdown contributor jonathan turley. let me ask you about a special prosecutor. is there hope that this was a really good move with angela cory and her staff being quite familiar with circumstances similar to the trayvon martin case, that it might be a value to advancing this and getting the state of florida and indeed the nation through this? >> i think it's a good move. this is the type of thing that special prosecutors are good at, in that they reset the scene from the prosecution and police side. you have someone coming in who is not tainted by the earlier decisions in the case. wewe have a lot of mistakes made by the police. so, just bringing in somebody who's independent can offer assurance to folks that there's not this past dependency that you see in some cases. >> to the to the statute: >> does what we know about the factual of this case you justify sanford police department and prosecutor there and their decision to not charge george zimmerman, is it reasonable to use deadly force to prevent death or great bod

reduces cost for those participating: >> joining me now to help us figure out what went on today jonathan turley, george washington university law professor. thanks for your time again tonight. >> hi, keith. >> it seems the justices were not heading toward a ruling that might find part off all of this unconstitutional. today looked like a different court with a completely different case. what happened today? >> we talked about this yesterday, i things that had really the two justice that were being watched most closely by most of us were justice kennedy for the obvious swing vote but also justice scalia. many people did not realize that scalia had said things in past cases that made his vote somewhat in play. i think that the administration was trying to see if they could nudge him to stay consistent with that prior statement. what we sauteed is that scalia does not appear to be in play, which means it's a greater burden for the administration. they really need kennedy. and kennedy's questions seemed quite skeptical if not hostile. he really hit all the themes that were coming out of the briefs

host: jonathan turley, what did you hear they're from and justice alito?st: he is viewed as one of the solid votes for states. he is very allied with the states' rights. i would be astonished not to have him out with justice thomas, for example, in support of the states. you capture an aspect of the the courts have- changed dramatically, when marshall handed out marbury v madison, reconstructing the court into a much more powerful image. justice jackson said it best -- we are not final because we are infallible, we are infallible because we are final. after marbury v madison, they are final. whether you agree with them not, this court renders the final decision on what the law means. justice alito is correct in stating the values that motivate many of the justices. in terms of his own vote, he is a very predictable justice, one of the most predictable. he tends to vote consistently on of the right. justice kennedy is cut from a different bolt. he tends to vote with conservatives in many areas, but he is more of an unpredictable swing vote on issues of this
