. >> jacqui: joining us now is jonathan turley, law professor at george washington university.ball, but watching this trial and knowing there is an outcome -- we have been told about a verdict -- what outcome do you expect and why? >> is a criminal defense attorney, i had the same reaction as her counsel when the judge reread the instructions to the jury, when the deadlocked. that you have to go back in and try to reach a verdict. that re-instruction happens in virtually all cases. but it tends to really grate on defense counsel, it tends to push a jury to reach a verdict even though they clearly didn't feel comfortable before coming to the court and reaching a verdict. the feeling among defense counsel is that it often tends to favor the prosecution. but it's not clear here. it's possible the jury may have sent a note to the judge saying we remain deadlocked, and the court hasn't revealed that, or it may resolve these issues. "12 angry men" is a wonderful movie, but it also does capture the dynamics of the jury. it is possible for people to evolve in their views of evidence if

let's bring in jonathan turley and brian claypool. great to have you with us today. two big trials. h the ghislaine maxwell trial. the prosecution has painted a picture of her as a dangerous predator that recruited and groomed underage girls to be sexually exploited epstein. but she says she's innocent. how did each side do? >> well, the defense had a very difficult case to bring here. they couldn't just put maxwell on the stand and have her rebut these type of allegations. very high risk. but i thought the prosecution carried the day in the end. i think they presented a compelling case against maxwell. she didn't come across as this vulnerable, even likable figure. she came across as an enabler of horrific acts. that's going to be hard to overcome. that's why i think that the prosecution may have carried the day. >> all right. brian, jeffery epstein had a lot of famous friends. bill clinton flew on his plane many times. there's pictures of him with former president trump, bill gates was an acquaintance and so was prince andrew. so a lot of people are watching this trial. if maxwell

let's bring in george washington university law school professor jonathan turley. d evening. >> bret: you have followed this case five of six counts. we don't know what the sentence is going to look like but your thoughts on how it transpired? >> well, we know it's going to be a long one. people talk about the maximum sentence of 65 years. that's not really what's going to be driving this. this will go under the guidelines. there are what are called aggravating factors and that's going to push up what would normally be about a 12-year sentence. it's going to push it up higher. but the jury got it right. you know, i thought that the maxwell defense, as hard as it tried to make something out of the defense, really had an impossible task. it was just implausible that she was assisting in putting underaged girls on flights to an island and suggesting that there was anything but sex trafficking involved. the jury obviously reached that conclusion on five out of six counts. but, in some ways, bret, the eviction is going to raise a lot of questions as to the other side of

let's bring in george washington law professor and fox news contributor jonathan turley himself, joiningiate response, which was what? >> well, unfortunately this is not surprising. we are seeing very strong anti-free-speech movements taking hold across our college campuses. a lot of students are learning about free speech in this echo chamber where it's presented not as the right that defines us, but as the scourge that threatens us. something that has to be controlled, has to be criminalized. the threat here goes beyond. to free the one right that guarantees the other rights. these other rights, everything from freedom of religion to free press, one to exist you have the right to free speech. but what professors like this arguing is to convert the first amendment from a protection to an obligation. that is, instead of being guaranteed free speech, it expressly allows the government to prosecute you for speech that is viewed as harmful. we are really having this crisis of faith today in our country where people have lost the sense of ourselves, and what defined us all along as americans

attorney and george washington university law school professor jonathan turley. nathan, this seemed like sort of a hail mary the way that the defense was operating. explain how to look at it and what nine hours with six men and six women on the jury means. >> well, bret, i think calling it a hail mary is actually being charitable. i think this is what you normally refer to as a jury nullification. i don't think smollett really expected the jury to believe what he was saying. the evidence is overwhelming against him. they have to discard every eyewitness, a videotape, two cooperating alleged co-conspirators. they have to discard all of that i don't think smollett thinks that's going to happen. he was asking for nullification. he was asking them to disregard his guilt, or at least one of them to give him a hung jury. and the question is, will they buy it? you know, he was able to persuade people in politics like vice president harris and speaker pelosi. he was able to get many members of the media, based on these assumptions. that's tougher in a court of law. >> bre

jonathan turley joins me now.hope that the president takes under consideration. why is it so important, jonathan for this kind of thing to be treated with seriousness by the commander-in-chief? >> well, you know, this has a deeply corrosive impact on our justice systematically because the president is that voice of reason. the president is the person that obviously people listen to because he was elected by the majority of voters. and he needs to use that capital to really dampen down passions on occasion, to speak to the process of justice, not the result of the justice system. and that's something that president biden has failed to do. repeatedly, and that is contributed, in my view to a lot of the tensions that we have. in the case of kyle rittenhouse, the president came out and called him a whims and treated him as guilty. then you have the facts being reported where disproven and obviously the jury ultimately acquitted him. when it did, the president came out and said how angry he was with the president. that

let me go to jonathan turley with your thoughts on all of this as you look at the cross examination andut from that. how do you think this is going? >> what came out today really does prove this is really what is called a jury nullification strategy. i don't think smollett or his lawyers think the jury will disbelieve all the evidence, all the eye witness testimony and accept this as applausable case that he's putting forward. what they're hoping for is one jury to vote on a nullification vote. saying i'm going with the person over the evidence. you can't say that but he pretty darn close. he kept on saying things to the jury that i'm a black man in america. i'm afraid of the police. he was trying to really sort of ramp up this contradiction between -- or this conflict between him and the police. it was so breathtakingly i'm plausible that every person involved in this is involved in a conspiracy to get him. all you have left is a jury nullification strategy. >> martha: very interesting. there were dozens of officers that took his statement and the investigation began and dozens of poli

a feed from jonathan turley saying potter is a complex witness. sounds mechanical and with the prosecutor technical but broke down immediately when returned to that day. the vital element for the jury is whether she evidenced the type of criminal conduct captured by the statute as opposed to simple negligence? >> it's clear she is in crisis reliving that traumatic event. in the video she is in a continue where she is a flight, fight or freeze mode. the portion of your brain that controls how you respond is affected. the prosecutor went over the number of training and powerpoint that involved the taser. what you need to it find out is how often were they taking those off of powerpoint and putting them into action with action drills and transitioning from a firearm to a taser. just because you start with the firearm doesn't mean you will continue using the firearm. might have to transthe firearm out and transition the taser. i suspect if we look at the training records we would not find a lot of under stress training with the taser transitioning. th

"the wall street journal" says it's like an engineer saying, "i just want to remove the tiny piece of the hoover dam." >> what is most striking about the president's position is it is entirely devoid of principle. this is what is demanded today in our age of rage, to be made politician. you have to be willing to sacrifice any principal for politics. whether it is packing the court, or at the filibuster rule. the president's logic makes no sense. he is saying because this is really important is why i'm not going to support the filibuster. that is what the filibuster is for, for things that deeply divided us, to force compromise, to force people to talk to each other, listen to each other. it is particularly disturbing in this case. this country is a powder keg. we are so divided over election, historically are election rules have been set by the states. this would, for the first time, dictate to all the states what their election laws must be acc

jonathan turley joins us immediately. was justice served? >> it was. jury got this right. from the out set the defense was rather implausible. it was a woman arranging the transport of underage girls to epstein's house and flights to his island. it's hard to imagine anything was involved other than sex trafficking or the abuse of these girls. there was no explanation offered by the defense as to why she was harvesting girls from playground and other locations. i think they got it right. the fact is she did not take the stand. i don't think she had anything to say when confronted with these facts. looking at a maximum of 65 years. probably more towards the middle in terms of the guidelines. m if you do a quick calculation probably around 12 to 15 years for a first offender, but this involved under-age girls and their abuse. >> will: the question becomes, what happens next? you have a wonderful analogy on your twitter feed. you saidid this is like prosecuting the get away driver in a bank robbery but letting the robber get away. will she name names? >> t

jonathan turley, george washington university law professor, fox news contributor.se to what you just heard? >> that confidence seems to be based more on hope than experience, when you have four rulings across the country, these mandates are now frozen in amber until they can break them free on some type of appeal but they all have one similarity. they are 3 different areas. all of these judges are saying president biden is exceeding his authority, that he is using these powers to achieve indirectly what he couldn't do directly, to impose a national mandate on the country. president biden has gone back and forth, he suggested he did have that authority, then admitted he didn't have the authority and his chief of staff retweeted a statement they found the, quote, workaround and he announced this to the country, we have a workaround where we are able to achieve a national mandate without the authority effectively. among the people that read that retweet are these judges including the fifth circuit that actually quoted ron klink in a footnote and said this might be a w

let's bring in fox news contributor jonathan turley. st to coast in this country on the pandemic. is that the reason? >> well, this is something we have seen before. politicians love to have this type of pandemic to blame for things that are not going well. there is no evidence of a cause and effect with regards to the pandemic and rising crime rates. crime is usually a decision that is made by rational actors, criminals can be rational actors. they balance the likelihood of being detected were arrested against what penalty they might face. what we have seen in a lot of these cities is not only is the chances of prosecution appalling, but so are the potential sentences. the result is what under classic economics you would predict, rational actors are committing more crime. and this idea that the pandemic is driving these smash and grabs is particularly absurd. these are people going in and stealing gem encrusted purses. that is not a substance deprived population of a pandemic. those are rational actors know the value of that person and

let's pivot now and get some analysis from jonathan turley, fox news contributor, constitutional lawl, this has been a longstanding controversy over these weapon confusion cases, which are really cases of negligence, and we call it culpable negligence, but these laws are really ill-defined and very ambiguous and vague. you saw the jury struggling with that. they were initially a hung jury. they went back to the courtroom to say that they didn't think they could in good faith reach a conclusion. the judge sent them back and said try again, and they did, and they ultimately came out with two convictions, but we really need to have this debate as to whether these types of cases should be handled as criminal rather than civil matters. there's no question in anyone's mind she did not want to kill mr. wright and so this really raises this issue that i think was bothering some jurors, as to if i don't think she thought she was using her service weapon, how can i say she consciously disregarded that risk? steve: right and mr. turley, obviously, the evidence was overwhelming if the jurors fou
