. >> sandra: joining is now by phone is jonathan turley. jonathan, jump on in here on the breaking news, as the former president, as we learned weeks ago, moved to delay the sentencing for this hush money scheme until after election day. it looks like the judge has decided to do so. your reaction? >> forgive the background, i am on campus. it is not signaling this opi opinion. the decision is not surprising in two respects. one, it was always controversial to have the sentencing before the election, and the judge clearly did not feel comfortable that he was ready to do so. the second reason is the reason for that discomfort. the supreme court decision presented some very serious questions about this trial, and the judge knew he would be subject to an appellate review. it is clear that parts of the trial did run afoul of the supreme court decision. he allowed testimony of people like hope hicks to be entered, and that clearly fell within the privileged aspect of the immunity decision. so he has to essentially get this cat to walk backwards. h

adding to it, jonathan turley.than. >> it's a very interesting development with the refusal of the alford plea. i would expect them to get the alford plea if they had pushed for this months ago. it is granted in cases. it is an exception in the sense that you need higher approval. but i actually think the reason it was turned down here is because of the timing. every indication is that the defense did not inform the prosecutors that they were going to change their plea. it was really very unusual. it is something that does not go over well with the prosecution. i'm a criminal defense attorney, and i would never have done that. even if i don't get along with the prosecution, i don't want to have this type of jump scare in the middle of the courtroom with the judge watching. i think that probably poisoned the well for the alford plea. i think that, months ago, if they had gone back to the table, they probably could have secured the alford plea as part of a global agreement. they could not have handled this case worse

and if you think it doesn't matter to you, professor jonathan turley estimates that the average american is ten times more likely to wind up appearing in front of administrative judge than a judge in a court of law today. so on the subject of federal administration, i'll ask you to indulge me by answering a nixon question, because we're here in the nixon library and actually an interesting note of historical significance. today is the 50th anniversary of president nixon's resignation as his legacy is being reevaluated literally today. 50 years on, we recognize that a significant expansion of the federal administration occurred during the nixon years. i would wager that this is a case of good expectations that ballooned into something that he never could or would have imagined, because there were real pleas. there were real pleas for environmental reform measures in the 1970s, some pushes for workplace safety measures. but we might say today that the growth of the federal administration that we saw then and that we are now living with is not exactly what the framers had in mind. could the

jonathan turley joins us again, this time in person. it's good to see her smiling face, professor. we went over this last hour. we may have an entirely new audience this hour, so give us your thoughts on the prudence of what the judge did in this case. >> well, it was the right decision, because judge merchan might have ended up not just the judge who imprisoned donald trump. he could have been the judge that reelected donald trump. if he actually did impose jail, as karl rove noted, that could have been just the catalyst needed to put trump over the top. that is an example of how curious this calendar is for any type of sentencing. it also means that, because of the dates selected here, that the election is going to have a huge impact on sentencing. if donald trump is reelected as president, then it seems very unlikely that merchan would sentence him to jail. it is also unlikely that he could succeed in keeping him in jail because of the conflict with his presidential duties. if trump loses the election, then indeed that might make it easier for merchan to do precisely that. so th
