joining me now is defense attorney jonna spilbor. thankfully this girl has survived.oday they're talking about competency. talking about two 12-year-old girls who allegedly did this criminal act. what are they looking for? >> competency is often confused with insanity. we don't care about the reason behind the crimes they committed. the judge cares about today as they sit there, today, are they able to understand the charges against them and assist in their own defense? a couple of things if i'm the defense attorney i would raise to the judge. number one, they're 12. but oddly in wisconsin, apparently you can be charged as an adult if you're as young as 10, which is crazy. but anyway, the second thing is the motive behind their crime was they said this fictional character drove them to commit this crime because if they didn't try to kill this young girl, that fictional character was going to kill their families. so they might have an insanity defense down the road and an incoi incompetency going on. >> the judge makes the decision? >> the judge makes the decision wher

i agree that jonna that the situation on the border for minors. comprehensive reform, it bolstered the argument that the current situation and way that the immigration is bad and not helping the situation. it further entrenches people on either side. and i am not seeing change on the hill in the equation as the future of immigration. >> at the same time, the administration is turning to congress and asking for 1.4 billion to deal with the problem. the number could be 100,000 unaccompanied children corder b this year. does congress approve the money? in the end of the day, they are kids and have to be dealt with in some way, but is money the way to go? what do you do is the question? >> it is a great question, and i am not sure what will happen. i know it will create a lot of arguments and yelling. it is it a terrible position that the obama administration has gotten itself in to. the kids need to be dealt with. they could be sent to new york? and they are swamping a system that doesn't know how to deal with the refugees. it is not their fault they
