i've come to meet jose's family they live just blocks from where jose was killed. >> his brother diego worked at a shop in the center of town. jose would often meet him to help mop the floor before closing. that night, he never made it. jose antonio was shot to death, right on this street corner. the walls on this doctors office are still riddled with bullet holes. now, the border patrol's explanation for what happened hinges on the fact they say their agents were threatened by somebody throwing rocks on this side of the fence. but standing here, the first thing you ask yourself is: could a 16 year old boy really threaten somebody standing on top of what's at least a 20 foot cliff, and on the other side of that fence? whatever took place here that night, there's video cameras right there which recorded everything that happened. but the border patrol and federal investigators have refused to share that surveillance video, so we're left to piece together the clues. on the night jose died, the nogales, arizona police report describes border agents pursuing two different young men as they

in different parts of san jose. the last was at a condo complex yesterday evening. the condo fire at trevino terrace started just before 6:00 last night. it took more than an hour to get that out. investigators blame a malfunctioning dryer inside as firefighters rush to each scene they still had other emergencies to answer, as well. >> on top of that, we are still running medical calls, vehicles accidents, service calls throughout the city. so crews are really strung out. >> investigators still trying to find out what started the fire that swept through that warehouse on east julian street and closed two schools in the area. a house fire on south 17th street now under investigation. >>> and it was that warehouse fire on julian street that really bogged down the morning commute on 101 yesterday. now we have an accident, this time actually in the same location as where we saw all the slowdowns yesterday. of course, this is not involving a fire. this is a four-car accident blocking the left lane. northbound 101 approac

christie smyth is live in san jose where san jose regional set up a tent just to deal with flu patients. >> reporter: that's right. good morning to you. to give you an idea how seriously they are taking this, this is the first time they set up tents in the parking lot to handle all of the people coming in complaining of flu-like symptoms. they have two tents, popped up another. stanford hospital doing the same thing. they have a tent outside of their e.r. this morning. the idea is that these patients may be able to be seen here, treated and then sent home. and we're told that with the second tent here up in san jose they can handle three times as many patients as before. and they also increased their staffing. as you said, nine people have died in seven bay area counties in sonoma, one patient healthy young man was just 23 years old. what dock tocker sass even younk healthy people in san mateo county at least six parents were in the icu at last count. one woman in her 40s has died but health officials say she had underlying conditions. still this season the h1n1 strain is spreading. >>

cate caugiran is in san jose. cate, the outbreak is so severe, treian tents have been set up at regional medical centers. >> reporter: yes, they have, they are going to be setting up tents and hopefully treating those not so critically ill inside though tents sending them home the same day hopefully. that is the intent. san jose regional medical center says this is just how bad it's gotten. the influx of patients of being treated for flu symptoms forced the hospital to set up four hospital beds in these tents next to the e.r. so far, the hospital says it's seen up to 70 more patients a day with flu-like symptoms and added extra staff to deal with the spikes. >> this tent we plan to see patients of all ages who present with flu-like symptoms. these are patients who we can hopefully see safely and quickly and discharge home. we'll save the emergency department for patients who might be a little bit sicker and require hospital admission. >> reporter: today there have been five flu-related deaths across the bay area.

. >> now to breaking news in san jose. police surrounded a strip mall searching for two burglary suspects. it's happening right now at the intersection of hillsdale and camden near lee avenue off highway 85. bob redell is live at the scene. what can you tell us? >> reporter: well, you can see the police have this area surrounded and moments ago they brought a man, one of two people that they had been searching for, they brought him out of this building. if you want to look at that video and see this man had been hiding from police. he it appears he was in one of the businesses inside this strip mall. not sure where but they did find him. this is after police called the fire department, had the fire department bring a ladder truck so they could get on top of the roof. they had canines out here and also about 30 units. you come back out live you can see get a sense of the resources they have. after they pulled this man out, took him into custody police drew their guns and started doing a search to the left heart of the scree

chase cain live in san jose.nvestigators think this started with a fight. >> reporter: scott, they do. what started that fight that is still a question for police as is the whereabouts of the person responsible, although this was a party that was invite only so essentially everyone knew each other. the party started saturday night and went into yesterday morning. san jose were at the home most of the day yesterday collecting evidence and talking to people at the party. we're told there were 20 or 30 people at this 21st birthday party for the victim's girlfriend. the victim is richard fan, 22, he was a physicology student. we did talk to a relative how fan got involved and then ended up getting stabbed. >> around 1:00, some of the girls get into competition, so my brother tried to break up the party. after he leave he try to be a peacemaker, tried to break up the fight. and somehow he got stabbed. >> the 22-year-old was rushed to the hospital but doctors were not able to save him. he did die at the hospital about

breaking news in san jose. east san jose, police investigating a deadly shooting. it is the city's first homicide of the new year. it happened hours ago near 33rd and east san antonio street, that's just north of the highway 101 and 680 interchange. bob redell is live at the scene with an update to the investigation. good morning, bob. >> reporter: good morning. in the past 30 minutes the homicide detective with san jose police have arrived and focusing on a driveway a couple houses down here on the 1600 block of east san antonio where a man is lying dead. someone driving by around 1:30 this morning called 911 to report that he was in that driveway when the paramedics arrived he was unresponsive. they performed cpr. they were not able to revive him. he was pronounced dead making him the first person to be murdered in san jose in this new year, 2014. what make this is story a little odd is that residents actually heard gun shots about an hour to 45 minutes prior to that 911 call, they also heard a car driving off but for whatever reason, no one bothered to call 911.
