the san jose city council voted today to create pilot programs for curb cafes known as parks. kris sanchez joins us from city hall in san jose. kris, these are popular when and where in san jose? >> reporter: well, you can expect to see them within the next year or so. they have been champing at the bit to make this a reality and even before the vote was cast today there were business owners who had their plans ready to go. not a bad day for a steaming bowl of soup in san jose but most days in san jose are sunny and warm enough to step outside. that's one of the reasons the owners of 569 want in on san jose's curb cafe program to turf select parking spots. >> i think it's a conflict between here and downtown but certainly beautify the street and small business as well. >> reporter: a few year's back the city did something similar along south first street only that time the redevelopment agency footed the bill to the tune of hundreds of thousands of dollars. this time businesses who want the curb cafe must pay to maintain them without a cent from the city allowing the businesses to customiz

sanchez, nbc bay area news. >>> nonstop to tokyo on hold in san jose, al nippon is canceling more of its dreamliner flights. they're canceled through january 28th. the airline said more cancellations are still possible. the faa grounded every boeing 787 dreamliner last week after a string of problems, including fuel leaks and battery fires. ana is rebooking passengers on ana and other airlines through other west coast airports. >>> a four-month repair job on the bay bridge began after an oil tanker side swiped it. would thers gathered at the base of the eastern-most tower to begin work. the actual pier isn't damaged but the fenders were. they absorb the impact on january 7th when the ship scraped the system made from steel and recycled plastic. cal trans said the repairs will cost up to $3 million. it hopes to recoup some of that money there the tanker's owner. depending on the outcome of the ntsb and coast guard investigations. >>> the week takes a chilly turn. >> after rare winter warmth today, areas of 70s down in the south bay, los gatos at 73. santa cruz at 68. we have the system lining up offshore. we

sanchez. diane dwyer is off tonight. we begin with new details on a car that plunged into a perklation pond in san jose. tonight one woman is dead because of that accident. the pond is located near the almaden expressway exchange. the latest and why this might have happened. kimberly? >> reporter: kris, emergency crews cleared out of here about a half an hour ago after doing an exhaustive search of the lake for any other potential victims. as it stands, one woman was pulled out of the water after that crash and was pronounced dead at the hospital. the accident happened about 2:40 this afternoon at a busy intersection of highway 85 and almaden expressway. the california highway patrol says according to witnesses, the driver was speeding, blew through a red light, and the car went through a fence and right into the pond. a san jose firefighter without dive gear went into the cold water to attempt a rescue. he was able to swim out about 20 feet and down about eight feet, but had zero visibility in that water. by touch he was able to locate the car, but then had to get out of the water because of the frigid
