hi, folks, i'm in for josh judge this morning, delighted to be here. we're not talking about the coldest weather of the season because it came last weekend. it's chilly out there, but we have clouds starting to surround new hampshire. they're up to no good. they're going to start to close in on us, but not be that productive, temperatures in the lower 30's, places like manchester out to the coast and of course, with our growing season done as of last weekend, it's not quite as big of a story. we're talking about the cloud surrounding us. we have some high clouds off to the west and these are moving in this direction and these clouds moving in this direction and they're going to squeeze us during the day today. you might ask, why are the clouds at least some of these clouds over the ocean moving to the west. usually they move west to east. that's because an area of high pressure is moving, and on the ground pushing them in and at the same time an approaching storm is bringing clouds at a higher altitude from the west. it's kind of a crossing pattern and

chris: good morning, in for josh judge this morning. it's going to feel more like mid we have some clouds banked up, and a few scattered showers across new hampshire. 20's north and 20's and low 30's south. in fact, the 32 the officially mildest temperature in new hampshire. that's at the manchester airport. we have a few snow showers off to the west. in fact, a few snow showers showing up here on radar and i mean very few here through the white mountains. but it's in this area and points off to the north where the wind is going to bump in during the day today, that will create home grown clouds and snow showers. and that will be on through the afternoon. the stuff to the west, lake effect snow that's localized to that region and will not affect our weather. however, just off to the west of there, milder weather and that will affect our weather for late on monday. if you have clouds going along with it. it's back to normal for the upcoming week. it will be unsettled, but i think we could handle that. for the day today, blustery and chil

the judge will issue the full in portsmouth, jennifer crompton, wmur news 9. josh: right now several people remain hospitalized after an amtrak train derailed in vermont. this happened in north field this morning. tom griffith is in the newsroom to explain what went wrong. tom: federal investigators are on the scene. that train was headed from d.c. when it derailed with 98 passengers on board. at least seven people were hurt, one seriously. investigators say rocks from a ledge fell onto the tracks, causing the train to derail. one locomotive, the one passenger car, went over an embankment. three other cars left the track but remained upright. vermont's governor calling this crash a freak of nature. >> there's no belief that there's any wrong doing here. a freight train went through late last night, it passed without any incident. so the ledges had to have fall then the last several hours. tom: the most seriously injured has been air lifted to dartmouth hitchcock in new hampshire. six others went to local hospitals in vermont. live from the newsroom, we'll have the

jennifer: josh judge is here with a closer look to check out the best spots. josh: it is looking really good in a lot more spots. every day, we have been noticing big changes. let' s take a look at some specifics. the latest state report just came out. we will take a look at where the as you might expect, it is hampshire. but the northern parts of the state from the white mountains north and west, 75% to 90% peak. getting closer to the lake region, 50% to 75% of color. as you get closer to the seacoast, the numbers decrease but we are hearing about a lot of color in places like the seacoast. back north, routes 3, 16 -- 110 is beautiful, 112. route 10 and 12a along the connecticut river. 103 and 103a, we are hearing great things. as well as route three in holderness. it is looking good. a plethora more locations to check out as well. we are in really good shape and only getting better as the days go along. the warm days and cool nights has been forcing the colors much faster. let' s check out how things are looking for the rest of the week to maybe do some leaf

judge. jennifer crompton, wmur news 9. josh: tom: now to franklin where a man walking his dog made a disturbing find. the fire department quickly set up a perimeter after taking one look at some suspicious looking bottles and federal investigators were called in. wmur' s shelley walcott joins us live with details of this investigation. >> this is dangerous stuff. somebody was cooking meth in individual bottles. a resident walking his dog spotted the strange bottles. some of them had tubes sticking out of them. the area was sealed off and called in the fire department. we spoke to the police chief and here are some details he offered. >> last night in individual walking their dog happened to it was a plastic bottle and it was smoking, or had some ingredients he did not recognize. he called us and we were able to identify it as methamphetamine production. in mind and expect to make some arrests shortly. >> a man was taken into custody last night at the econo-lodge in manchester, charged with selling heroin. manchester police work

judge napolitano is here. josh just said war crime has a distinct legal meaning and it does. >> yes, he's right. and the physician or the executive director of doctors without borders for whom you ran a clip essentially summarized the law correctly, a war crime is the knowing and intentional targeting of a civilian target. the question is, was this a mistake. if it was, it is not a war crime, even though innocence died. if it was knowing and intentional, hard to believe, but has to be an explanation for that and the government would have to prove it, a prosecutor would have to prove it is a war crime. a war crime does not charge a country or a military with the crime, it charges individuals. it charges the people who commanded it and the people who carried it out. the question is what was commanded, why was it commanded, who carried it out, did the united states use its extraordinary satellite capability to identify structures on the ground, did the pilot in the sky, did the person who commanded it, know that struc

josh: jennifer vaughn is in the newsroom with the emotional statements that were made in the courtroom today. reporter: the judge heard from the victim herself by videotape mother, father and sister. all of them expressing the immense impact this case has had had on all of them and their entire family. the state focused on what it called the other side of owen labrie, the crude language he used to describe the victim and how seriously he took the game of the senior salute. then the victims mother told the judge she had been unsure sending her two daughters away to a boarding school, but because her husband has been a proud alum she felt they would be safe and nurtured. she said the actions of owen labrie stole all of that away. >> by all appearances he is international, articulate, attractive and engaging, but we'd also like to note that these are often the same qualities that we see in their dangerous sexual predators. our experience has told us that great people in positions of members of the clergy, are also sexual offenders. >> all those memories of our children's academic, cultural and athletic successes ha

josh: attorneys for owen labrie are appealing his conviction and a day after being sentence he's now home with his family. this comes after a judge jail. the sentence for using a computer to lure the 15-year-old victim was suspended, and as heather hamel reports as the law reads, he is allowed to be released. reporter: yes, in the court yesterday the county attorney read the state law and says since labrie was sentenced to serve time only on the misdemeanor charges, he could be released penning appeal but still has to register as a sex offender. sentenced to one year in jail, la pree is still free on bail adhering to a curfew while the appeal process goes on. >> it's not uncommon that somebody in this circumstance would be on bail pending appeal. reporter: legal experts say sometimes that can take up to to years. in court the judge told labrie's legal team he encourages them to appeal but made it clear that if successful it would coming vacate his suspended felony tonights and would still have to serve 12 months for the misdemeanor sex sought conviction. but the biggest concern is over his name being placed on the sex offender re
