joyce, good to see you.ed defense information and subpoenaing these reporters was a last resort. what do you make of doj's approach here? >> it will be important to learn more details here. doj certainly has the authority to do this. the real question is whether it's a good practice. and one thing that seems certain is that under attorney general barr, doj strayed from the guidelines that were put in place by eric holder when he was the attorney general, around 2013, after investigations like this came under scrutiny. i'll tell you the doj point of view is that if you don't know who's leaking information, one way of finding it is seeing who talks to reporters. of course, there's also a finite universe of people who have access to this type of information, so it would also be a legitimate investigative strategy to focus on those people without focusing on journalists, which obviously carries an extraordinary risk of trampling on the first amendment and chilling the investigative access that journalists have.

joyce, the doj is supposed to be politically neutral.elations like this, does it suggest that these acts can be used in a political way, be weaponizing for political gain? >> you know, that's a possibility. we saw a lot of things that, frankly, made people uncomfortable during the trump administration. it was clear that the attorney general, for large parts of the -- the last attorney general, bill barr, was acting as the president's lawyer, not as the people's lawyer. that's why it's so important that president biden has put in place someone who's strongly apolitical, a former judge as the attorney general, and we see that in increasing ability the public has to have confidence in what's going on under this new administration at doj, which, after all, this entire story about "washington post" reporters came to light because doj permitted notification to go forward that these accounts had been scrutinized. it might have just been an accident of timing. i don't know. i do think it's curious that notification wasn't made earlier to these j

joyce, welcome, my friend. it's good to see you. what do you make of this view being taken by roger stone, donald trump, others that giuliani is being treated unfairly? >> well, as they know, it's just talk. it's nothing more than that, because there's no one person inside of the justice department who's making a decision to go, and as they put it, raid giuliani's house and office. what really happens is the agents and prosecutors have to put together a detailed affidavit. the agent swears it's true under oath, under penalty of perjury, and they have to present that affidavit to a federal judge who scrutinizes it to make sure there's probable cause to issue a search warrant. it's only after that judge, who's independent of d.o.j., not, you know, no telling who that judge was appointed by, but certainly an independent actor, only after that judge signs off on the warrant is a search executed. so this is not a witch hunt. it's not the obama or the biden justice department. it's established procedure for investigating a criminal case.
