what do you make of that, joyce?this supreme court, with the six three supermajority, they can even afford to lose the chief justice on occasion when he votes with the more progressive wing of the court, and so many of the cases the court will hear this term are cases that involve long-settled law. affirmative action is a good example of that where the court has agreed to hear a pair of cases, one from harvard, one from the university of north carolina, the importance of that is that one ruling will cover public universities, the other private, and there is no reason to hear an affirmative action case. that law is settled unless this court intends to reverse precedent and prohibit or severely restrict the use of racial criteria as one of many criteria used in making these decisions about who gets university admission. >> so speaking of kind of this conservative supermajority, you think about what's already taken place, the rejection of the challenge to the bump stock ban. you compared that to what happened in the las

joyce, i want to start with you. you got a suspect in custody. literally caught red handed in the act with the weapon in his hands by police. so what's next in this investigation? >> so you have to stop. you have to sort of slow your roll a little bit. and investigate thoroughly. rumors start to circulate about the evidence. the important thing here will be talk to all witnesses because the details will matter here. for instance, whether this now defendant was using the hammer as a weapon, trying to use it as a dangerous weapon or using it to break in for a burglary, that will matter when we think about whether this should be exclusively a state prosecution or a federal prosecution and to that latter point determining whether the federal government will get involved will require some insight into the intent that this defendant had. was he hoping to intimidate or interfere with nancy pelosi's official work? that seems extremely likely based on what we're hearing today. the odds are we will see federal indictments in the next hours or days, but the

barbara mcquade and joyce vance are back with me.he supreme court rejection shock anyone? >> no, not at all. the whole idea of a special master was really absurd from the start. trump threw up a hail mary requesting one. it landed in the lap of judge cannon who granted that order. every other judge that has looked at this has immediately rejected it. the 11th circuit court of appeals, and now the u.s. supreme court. there is no basis for it. the justice department has argued the court lacked jurisdiction. there is no argument for executive privilege to be asserted against the executive branch itself. there is simply no need for a special master here. i think ultimately donald trump is going to lose these challenges. even the supreme court, three of whom as you mentioned are his appointees followed the law here. i think although it was expected, it was refreshing. >> we've been clear on this since day one. i have to ask you, the supreme court's order means the trump's legal team is not going to have access to the classified documents

joyce, if you were a lawyer for the committee, what would you want to hear from hope hicks?, i think that assessment of hicks' value is accurate. what you would like to get from her -- she's under oath for this formal interview with the committee -- is more detail about her conversations with the former president. she is on record and there's reporting in at least four books that we've all read that suggests that she told trump point-blank that he had lost the election. and on at least one of those occasions when she told him to tend his legacy, he said he wasn't interested in his legacy. he wanted to hang on to the presidency. so what you really want to hear from her is any suggestion that he was aware that he had lost, but that he was continuing to fight using the tactic that is we're all familiar with involving the big lie. whether hicks who is notoriously close to the former president would reveal those sorts of details i think is an open question. maybe the committee got lucky here. but we don't know for certain that she's a valuable witness. >> joyce, what does it tell

joyce i want to start with you. the 11th circuit court decision in the favor the doj wasn't a surprise here? >> it wasn't much of a surprise, and i wasn't all that quick. you'll remember the first time that they encountered this case when they were asked to pass on an earlier motion, they actually filed an order late on a saturday evening. this time they waited a little bit longer before they ruled, but ultimately they decided to expedite the case along the lines the doj had requested. this is a very clear case where the issue should be expedited. there is no factual development, no extensive record that needs to be reviewed. the parties have already briefed the legal issues in the lower court, and alicia, it's important to remember the context here, which is that this is an ongoing criminal investigation which is now been slowed down because the former president has filed this very unusual civil lawsuit. entirely appropriate and not very surprising for the 11th circuit to expedite. it >> joycelyn, the ask you a que

joyce, let's talk about trump's other legal troubles.nswer questions under oath today in the e. jean carroll defamation case. we do not know what he said. but we do want to know what happens next. >> well, this case is on the fast-track. it is scheduled for trial in february. the judge has indicated he will not tolerate any additional delays. that is why he has scheduled that deposition to take place today, because there is still a big legal issue that is hanging over this case. and that is an issue that has been located in the second circuit court of appeals. it involves whether or not the former president should have sovereign immunity, because he was the president of the united states when he made these comments. and he has argued that he was acting within the scope of he is duties, as an employee of the gunman when he allegedly defamed carroll. so, that issue is now being decided in the appellate courts. nonetheless, this case is speedily progressing towards trial. and if that legal issue plays out in carroll's favor, this will be a

attorney joyce vance and andrew weissmann.l level, let's storm the capitol in ohio. how convincing are the emails and messages? what do you make of this? >> zimmerman is a 27-year army veteran who lives in north carolina and was once a member of the oath keepers. he testified that he believes stewart rhodes may have a contact with the secret service. he heard one side of a conversation between rhodes and someone rhodes claimed was a secret service agent. this was in september 2020, before a trump rally in north carolina. as you mentioned, this is just developing. we don't know whether the fbi tracked down who rhodes may have been talking to. that's to be continued. zimmerman followed two days of testimony by the lead witness, the fbi agent. he was at the capitol guarding senators on january 6th. he became one of the supervising agents in the oath keepers investigation. prosecutors used him to introduce recordings and text messaging showing how the oath keepers planned to use violence to stop the lawful transfer of power. prose

. >> joyce, your thoughts on the committee's choice there?>> well, i hear her keeping the option open. really, there is no other alternative. at some point, mike pence is going to have to testify if there is going to be full accountability for january 6th. i'm not certain it matters as much, whether that is for the january 6th committee, or for the justice department grand jury. and perhaps ultimately, at trial. mike pence, in some ways is the victim of the former presidents efforts to obstruct congress's functions on january 6th. in many ways, is a material witness. he had personal, 1 to 1 conversation with trump, which you will recall some of the lawyers in the room declined to testify about, asserting executive privilege. and so essentially, he is the point person. he can put the finishing touches on the story. the public is entitled to know it happened, and i think that one way or another, mike pence will be telling it at some point. >> hugo, thank you so much for getting us started. barb, joyce you are sticking with me, because january 6

attorney joyce vance. an fbi special agent was on the stand this morning.hts. >> reporter: essentially what we are learning is there's a lot of tension within the oath keepers organization in the months leading up to the january 6 attack, particularly after the election and of course certification date on january 6. the north carolina oath keepers broke away from the larger organization because of the concern with the extreme rhetoric that we saw coming from elmer stewart rhodes, who is as you said, showing really aggressive tendencies and was talking about opposing the peace peaceful transfer of power with force. there are events in d.c. that the oath keepers took place in. we saw the million maga march in november and again with another event in december. we have seen some communications revolving around that. what the defense is trying to say is that a lot of these communications, particularly for the non-rhodes defendants, they were focused on providing security operations and security services for some of the speakers, for individuals in trump's orbit

talk about this, ali vitali, "washington post" national investigative reporter, carol leonnig, and joycece a law professor at the university of alabama and co-host of the sisters-in-law podcast. the committee says it's unlikely trump will actually appear before the committee. what's the reasoning behind issuing a subpoena? >> reporter: and you read that letter, jose, that he just sent to the chairman of the committee, bennie thompson, where you're right, he doesn't say "yes" or "no," but continues to perpetuate the lie he's been telling over the course of the last year and a half since the 2020 election was lost by him. after multiple hearings where it's clear that trump was the central focus, even as they told other pieces of the narrative around january 6th, the question that we were asking members during that time was, what happens when you do your job successfully and you tell the public that trump has blamed to be born here for what happened on january 6th? now it seems the committee has found at least one of their answers to that which is going to subpoena him, trying to get more i

joyce, talk to us about this reported deal that trump was proposing? what does it tell us about how he views the rule of, law's responsibility and all of it? >> it has a very extortionate feel to it whether or not it would technically amount to criminal conduct as an entirely different question. it speaks to trump's mindset, it speaks to trump, to what he knew because he had in his possession. and that point in time, and i think something else that's really important in this reporting alicia, the fact that his aides did not go any further with this. they knew it was, wrong they knew it was a bad idea. ultimately, this becomes evident that doj can use against trump in a prosecution. >> i would like my producers to put extortion e and one of these banners. not really sums it up so well. luke, this week we learned the doj thinks trump might still be holding on to other government documents. how is that impacting the justice department investigation as well the damage assessment that was requested by congress? >> right well it shows we are not yet even clo
