jesse matthew jr.s set to appear in court for a bond hearing coming up on thursday. >>> so, walmart is claiming that actor tracy morgan and the other passengers inside that bus-limousine that was rear-ended by one of its trucks are at least partly to blame for the injuries they sustained because they weren't wearing seatbelts in that vehicle. it's the retailer's response to the lawsuit that was filed by morgan and the others involved in the accident on the new jersey turnpike back in june. the plaintiffs' attorney called the company's claim "surprising, appalling" and not what they said they were going to do initially, which was take full responsibility. the lawsuit claims that walmart should have known its driver hadn't slept in the 24 hours before that crash that also killed morgan's friend. that driver pleaded not guilty to charges of assault and death by auto. a spokesperson said monday that walmart "continues to stand willing to work with mr. morgan and the other plaintiffs to resolve this matter.

we have a report from jr stone. >> reporter: i was with the dogs this afternoon and you can tell theytill recovering from the way they were treated and, in fact, one dog had to be taken to the hospital. these are the pictures showing some of the eight malnourished dogs found by san francisco animal care and control. dogs suffering from -- >> malnutrition, parasites, loss of skin. >> reporter: friday we visited the dogs now in the care of city officials. animal care officers tell us that the dogs' former owners were evicted and left them behind in a dirty home in the outer mission. >> no animal deserves that. >> reporter: the eviction took place on wednesday. later that day, the dogs were found abandoned meaning that the owners of these animals kept them malnourished and filthy. while it is obvious the dogs have a long way to go, those with animal care and control believe they are going to be okay. >> we are more focused on bringing them to health and so they are away from that situation, they are now in our hands and getting the care they deserve. >> reporter: the ongoing investigatio

jr? >> the good news in this story is that no one was hurt and that is good news after you hear about what exactly happened. you look directly behind me. park rangers tell me this swimmer was caught in a current between those two rocks. i do want to go to some of the video because you can see the emergency crews that spent the day out here. according to park rangers a gentleman 22 years old and his girlfriend. he decided to go further out and was caught in a rip current. at one point he told park rangers he couldn't swim anymore. he was that tired but there was a surfer in the area able to help him. the catch is emergency crews went out there when in fact this man had been caught in the water was already on the shore. she was watching some of these search efforts and during that time life guards went out and had a very hard time getting back when they finally learned he was safely on shore but the good news here those life guards were also able to get back to shore. i did speak with one o
