continuation of the preliminary hearing, the judge will decide whether steinle's accused killer juan francisco lopez sanchezocumented immigrant will go to trial. during the hearing yesterday, the judge rejected a defense motion to toss out a confession from lopez sanchez that he accidentally shot and killed kate steinle. defense attorneys were arguing that police did not have a good reason to arrest him an hour after the shooting. they also argue that nobody actually saw lopez sanchez fire the gun back on july 1st. several people did see him walking briskly away from the scene. and some took pictures and investigators use that as well as a confession that he accidentally shot steinle. the judge ruled that all of that will be allowed back into evidence and police acted appropriately on his arrest. as we take you back out here live, the continuation of this preliminary trial. the judge will decide whether lopez sanchez will be standing trial for murder charges or he might be facing lesser manslaughter charge. we'll be waiting to hear that. but again this trial scheduled to start at 9:00 this morning. dave, ba
