defendant juan garcia zarate is on trail for second-degree murder in the 2015 shooting. a firearms expert took the stand yesterday, testifying the gun was in good condition and likely would not have fired without its trigger purposely being pulled. zarate's defense team argued the gunfired accidentally. >>> investigators are starting to understand what led to a runaway truck crash in san francisco that injured three people. this happened yesterday afternoon. workers were loading a parked truck with bricks when investigators say the brakes gave out. that sent the driverless truck careening down the hill out of control. it eventually hit an uber car with passengers on board, only after that uber driver says he desperately tried to outrun the car in reverse. >> it was coming and i was backing up into the intersection and just -- it came in front of my car. >> none of the people injured suffered life-threatening injuries, that truck hit nine cars, many of them parked, before it was stopped by a tree at vallejo. investigators also say the workers did not properly curb the tru

now the case has laid out the case for juan garcia zarate. claiming that that july 2015 shooting was accidental and the bullet which killed steinle ricochetted off of the pier at pier 14 before striking her back. of course the prosecution has a different take on this, laying out the case that czar zarate intentionally carried out that shooting, pointing the gun at steinle and deliberately pulling the trigger. of course we've learned throughout this that gun thaad reason stolen just days earlier. the defense says garcia zarate found stashed under a seat at the pier. they initially charged him with second-degree murder, but the judge agreed to a request to request first-degree murder as well. our own nbc bay area sam brock is in the white house. he'll have the latest on these closing arguments at 5:00 p.m. and 6:00 p.m. you can follow us for all the latest updates online on nbcbayarea.com. we're live in san francisco. pete suratos, nbc bay area news. >> you're right, pete. we'll stay on top of this story and bring you the updates as they arrive

while trying to establish that the suspect, juan garcia zarate intended to kill kate steinle, the prosecution had the lead investigator take the weapon and the clothes he wore on the night of the so shooting and showed the jury how the gun could have been concealed in his pockets. the gun barely fit inside the suspect's jeans. here is a district attorney spokesperson. >> whether the gun was concealed in the clothing of the defendant is relevant to whether he intended to pull the trigger and that is the evidence that you saw in court. >> there are a lot of pockets that that gun could fit in, but this is a new theory that they're putting forward. as i pointed out, they never bothered to test the pockets for gun shot residue. >> that was the defense attorney. he'll have his turn, as i mentioned, next week in the case as he presents his case that the shooting was accidental. >>> developing this morning, isis now claiming responsibility for this week's terror attack in new york. though the group did not provide any evidence. a memorial for the victims is growing. thursday night, some new yorkers h
