basically, the judge this morning was saying, look, you can't necessarily stop all criminal proceedings, even if it doesn't necessarily have to do with you but it might involve associates with you. this isn't some blanket coverage that no investigation can proceed. what we're talking about here is that tax records or tax documents get turned over to a state district attorney office or a state prosecutor in this case. that doesn't mean that he's going to be indicted imminently. that doesn't mean that this is the last stop in the judicial process. let's take a look at the clinton case. now granted that was a different set of parameters, a civil lawsuit, and it didn't have to do with criminal allegations. but president clinton was required to take a deposition in a civil suit much along the same lines of saying, look, the president can't be burdened with these things while he's the president. the judge here today is following this kind of idea of look that's one step in the process, not necessarily the final outcome. to your point, i'll conclude with this, the office of legal counsel, their determination is the ultimate determination from a standpoint of impeachment in th

judges of that court described him -- and as i quote -- unqualified. and as you heard at the confirmation hearings yesterday, the american bar association, which provides ratings for judicial nominees, gave him a rating of not qualified. now, that's worth repeating. the a.b.a., the american bar association, spoke with 60 lawyers and judges across four states and concluded that he wasn't suitable for a position as a judge on the court of appeals. the people with the objections are his former colleagues. as far as records show, not a single federal judicial nominee has been appointed to the federal bench who was lacking both a qualified or well-qualified a.b.a. rating and the approval of the nominee's home state senators. if confirmed, mr. vandyke would be the very first federal judge who was judged not qualified and whose blue slips were not returned by the home state senators. i don't think that's a precedent this chamber should be proud of. mr. president, the ninth circuit court of appeals is the last stop for cases that affect nevada before they reach the supreme court. it's vital that the ninth circuit nominees know the state of nevada and its issue

associated press. also joining me ross garber who teaches impeachment law at tulane university and is a cnn legal analyst. good to see you all. ross, what is the significance of the judge's ruling ordering all the redacted grand jury information from the mueller probe be released to inquiring lawmakers and how might it impact this impeachment inquiry? >> it could be very significant. there could be a lot of material and stuff we don't know about if that information is actually released. i would be surprised if there weren't an appeal here and who knows what happens on appeal? the judge's ruling was long and well thought out but there were some controversial pieces to it. what it really relies on is this notion that an impeachment trial as judicial proceeding. everything sort of turns on that. and it is a concept that the supreme court certainly hasn't weighed in on and so this could be a decision that winds up getting reversed on appeal. i think for now the thing to look for is whether it gets appealed. i think it will. and what an appeals court does. >> but then when you appeal if you appeal there needs to be an argument. what would be the argument? you're talking about
