julie carey in the courtroom today when both sides made their closing arguments. julie?porter: well, prosecutors told jurors that andrew schmuhl is a con artist who is blaming his many pain medications and his wife for his violent actions, but his defense team says he is the victim of involuntary intoxication. this is the image of andrew schmuhl his defense attorneys want jurors to remember, looking drugged and dazed at the hospital shortly after his arrest. they say he was taking so many of these prescription meds at the time of the crime he didn't know what he was doing when he savagely attacked a mclean lawyer and his wife. schmuhl testified last week he doesn't even remember the incident. said his attorney, these are not the acts of someone who was in his right mind and these are not the drugs to keep someone's mind right. for three hours on the evening of november 9th, 2014, schmuhl terrorized leo fisher and his wife sue duncan. the couple listened from the front row today as prosecutors recounted theas the attack came weeks after leo fisher fired schmuhl's wife fro

. >> julie carey is near the scene this evening. jules?> reporter: the crash happened about a half mile down the parkway there near mount vernon. it caused the shuttle bus to overturn, trapping victims underneath it, but some good samaritans righted that bus. >> tou dispatch calls sent emergency vehicles racing to the crash near mount vernon. today fresh skid marks, torn sod, pieces of metal, and bright spray paint marked the spot where a shuttle bus full of chinese tourists overturned after a head-on crash with a car. >> we have one vehicle, a bus, that has flipped over. it is currently on its wheels. we have a total of four patients on the ground with a possible of 26. >> reporter: this man who lives near the crash scene got a tweet from his wife that a bus had overturned nearby. >> she saw a white chauffeur van that had been -- it was upright. they said it rolled and had been involved with another car, but we didn't see anything like that. >> reporter: a group of passers-by had somehow uprighted the shuttle bus. the victim that was kill

julie carey joins us with new details. >> reporter: that suspect identified as 34-year-old justin wingate, he worked in law enforcement in fairfax county's he faces two counts of attempted abduction in connection with those 2007 cases. this was his mug shot that was taken last night. next you're going to get a look at the composite sketch that was created back in 2007 when a sere offense attempted sex assaults had arlington women on edge. police say poe emerged as a suspect in two of those cases recently as they investigated an incident last month near lion village. dna from that incident was sent into the crime lab. it matched dna taken from one of the bags in 2007. there also happened to be a latent fingerprint on one of those bags. other evidence pointed to poe as a possible suspect. they were latent fingerprint to one of those given more recently. he is only charged with two of the cases back in 2007, but more charges are likely. i'll tell you more about his employment status out in fairfax county and we'll look more closely at how police have developed this case and connected these d

julie carey was there as the victim's mother vented her frustration. >> reporter: ann gear walking past her son's killer just after she lashed out in court calling the plea deal that will soon free ex-officer adam torres an insult. >> if i went out and shot somebody, i would never see the light of day. one year in jail is insulting. >> reporter: this was the scene in late august 2013. john gear had guns in his home, but he had his hands up on the screen door when adam torres opened fire, stunning his fellow offic indicted on a second-degree murder charge, but a deal was struck. guilty for involuntarily manslaughter in exchange for a 12-month jail term. today the judge accepted and imposed the sentence. >> it was murder. it was not involuntary manslaughter. >> reporter: but prosecutor ray morrow defended the plea deal, explaining john gear's partner said she was very worried about the couple's oldest daughter having to testify. >> and it would have been a pretty raw trial, and it would have been pretty hard on those children. so i guess i can say i put them ahead of ann gear's opinion. >

. >> julie carey has the information and angie goff is following the restrictive texas law. we begin with the former virginia governor's case. after more than a year of appeals, the supreme court has weighed in on this. >> it appears that former virginia governor bob mcdonnell may be getting a new trial. julie what does this mean? >> this was the last ruling to come down so we're still sorting through all of the details but the jury instructions in this case, the supreme court has ruled, were flawed in the way that official acts were flawed. bob mcdonnell will not have to report to prison to serve his two-year prison sentence today but it doesn't mean that he's completely clear yet. the justices found that the constitutional official act is too broad. that means that governor mcdonnell's conviction is overturned but it's going to be up to the u.s. attorney's office to decide if he will be retried. there's a challenge for the prosecutors because the supreme court ruled that what prosecutors maintain that mcdonnell did, bribes that they say he accepted, they completely ce i ju

a good samaritan called 911 and only on news4 the boy's father spoke to julie carey. she joins us live outside london town elementary. julie? >> reporter: well, after the initial shock that his little boy was able to wander away from this school, his dad became dismayed because the rest of the parents at the school hadn't been notified. that's exactly what happened. this 6-year-old boy has stayed home from school since tuesday. that's when his dad answered a knock at the door around noon to discover police there with his kindergartner who was supposed to be in class at london town elementary. the officers had picked the boy up more than a mile from school. after a good samaritan called 911 to say she'd spotted the child. >> i was like how did he get o >> reporter: his son told him at school that morning he got permission to use the restroom, but when he got back to class the kids were gone. apparently at recess. he walked out the back door and kept going, crossing busy stone road and walking for 1.1 miles before someone saw him near the shopping center and called polic

julie carey live at the courthouse with a new witness who backs the little boy's testimony. jules?> reporter: well, zach castillo was only 6 years old when his mom died. the family service worker who interviewed him three times of that tragedy told jurors today what he confided in her. during their first two meetings, she could hardly get him to say a word. it was in that third meeting that he gave her that information that really boosts the prosecution case. 8-year-old zach castillo testified last week that he saw his dad inside his mother's home the night she died. the couple was estranged going through a bitter divorce. braulio castillo was barred from going to the house. her body was found hanging in the basement bathroom. prosecutors allege braulio killed her and made it look like a suicide. ashley baker says during a videotaped session with zach five months after his mom's death he told her he had been sleeping in his mom's bed. she asked how did your mother look. scared, said zach. the boy left his special blanket gigi behind. he received that his father brought gigi from hi

. >> jula julie carey joins us li from leesburg. >> reporter: the prosecution saved some drama until end, calling three of the people closest to the alleged victim michelle castillo. they were asked to identify a man seen approaching and then leaving the home shortly before michelle castillo was found dead. when this photo was taken for the family christmas card in late 2013, nicholas castillo never imagined it would be the last with his mother. he testified for the prosecution against his father. braulio and michelle castillo were in a bitter divorce battle en in the basement in 2014. a surveillance video shows a man whose face cannot be seen jogging up the street, pausing, then going up the castillo driveway. then at 12:30 a.m., the same figure running away. her body was found hanging in the basement shower. prosecutors say her husband braulio killed her and made the death look like a suicide. his attorneys say michelle took her own life. today the prosecutor asked nicholas, did you recognize anyone in that video. nicholas, i recognize the person in that video as my father. i could

julie carey joins us live outside police headquarters with details. >> reporter: well, we've learned 34-year-old justin wingate poe worked in a probation office. now he is in the arlington county jail charged with two counts of attempted abduction for stalking and attacking young women in articlington nearly a decade ago. it was his job to work with criminals. now he's the one behind bars tied to two attempted abductions of arlington women back in 2007. >> a female was walking down the street. he came up from behind and attempted to put a plastic bag over her face. >> reporter: poe emerged as a suspect in the 2007 cold cases as they investigated an incident last month on north edgeo that's when a man got into a woman's house and attacked her while she was sleeping. dna from that incident was submitted to the state crime lab. it matched dna taken from one of the bags in 2007. there was also a latent fingerprint from one of the 2007 bags and this composite sketch created. investigators kept following leads that pointed to poe as a possible suspect. investigators were able to use that 2
