tahoe resort announced today it will open nearly a month earlier than scheduled, so that means the slopes will be open this friday. this is video from today at palisades. tahoe officials say this is the only time only the third time and it's 72 year history. it is opened in october, palisades received 3.5 ft of fresh snow from that recent storms and heavy rain right now is drenching the attorneys say this is not uncommon and has been happening even with an eviction moratorium still in place. new attend tonight. investigative reporter brooks jarocz joins us now with a look at how protections can vary and why some tenants are still getting kicked out. brooks. well the state eviction moratorium was aimed at preventing homelessness and financial suffering and expired at the beginning of the month and in many counties next month. landlords can sue for background but in places like alameda county, oakland and berkeley bands are still in place. no one can be thrown out for unpaid rent. but it hasn't stopped some landlords from trying. under lock and key for fear of getting kicked out renters. wilson wise in his partner, dj are packed and prepared. we've just been having everything in boxes, so our stuff's not just thrown out on the street because this year during the covid 19 pandemic they were landlord has delivered several eviction notices among other things, constant harassment with emails late at night. threats to come and get our stuff with just people he's hired to pull us out. i mean, we called the police. barricaded our own door at night. got cameras. it escalated following what tenants say was a water leak and this mold found early this year inside their apartment near hayward. for months, it went unfixed. until they say they began withholding rent in april in hopes of paying for repairs themselves. the landlord did make some fixes, but also more attempts to kick them out, claiming he wanted to repair the property for future sale. you have three days to get out. you have 60 days to get out. you have 30 days, so it was like we didn't even know what day. we needed to be out, so they hired a lawyer and threatened a lawsuit. we have people reaching out to us all the time with stories like this, so i believe this is happening and it's happening a lot and tonic. omura is the executive director of the eviction defense center. she considers these notices unlawful, especially with some local eviction bands still in place. the laws are only as good as enforcement, right? and if these landlords try to take these eviction cases to court, then as lawyers we can step in and we can stop him and judges can stop them. the problem is this is all happening outside of court. the threats, the notices that never see the light of day but may actually scare someone into moving it scared the #### out of me. i've never had somebody actively threatened. it seemed to me. like to break into our home. we just want to get your side of the story. they say you're harassing them. i just tell you, that's not true. i asked him to get out. back and, you know, february we found mold. we start by to chat with landlord greg hall at his home he claims the homeowners association caused repaired delays and that he, too, is undergoing financial hardship. they stopped paying me rent really last may. if they started paying your rent again, would they won't accept it? because basically, they've been noticed. we want them out. place needs a lot of work. state law says landlords cannot evict unless they've applied for california's rent relief program in alameda county evictions are still illegal for unpaid rent unless there's a threat to health or safety or if the owner wants to put the property on the market can kick them out because we're going to sell the property. that may be true, but it would require the landlord give proper notice, informed the tenants of their rights and provide relocation money. none of that has happened. it's not my job. to assist and not a family member. you know, it's not my job, do it. call the agency that will help. why says he's unemployed and applied for rent relief this month, all while dealing with no flooring and other apartment issues. why not just leave? where would we go? i. i can sleep on my mom's couch. they know where to go there. just milking this right now. the couple says they want to find a new place but are financially strapped. we're trapped here. this was a safe place. that was almost a paradise, and now it's our living nightmare. while their landlord says they're squatting, the tenants argue they've put up with poor conditions and bullying. unfortunately that's really common right now because landlords can't get into court. so what they are relying on is a lot of harassment to get people out. it's not legal. um and clearly when we get involved, we would ask that it stopped instantly and that these tenants be left alone. so you say you weren't threatening them in any way? well i you know, they may have taken it as a threat. but the fact is, this is how the process works. and i said, why don't you leave voluntarily? it is not okay. to do this to people. it's just not ok. those tenants have sued, claiming in part, retaliation and negligence. many landlords say the moratorium leaves them stuck with no rental income for bills or mortgages. they took can apply for relief funding. but we've learned in many cases, both sides are still waiting for money only straining landlord tenant relationships. in the studio. i'm brooks jarocz ktvu, fox two news. the san francisco board of supervisors has extended the city's eviction protections measure through the end of the year. it had expired on september 30th before the board voted unanimously today to keep it in place until december. 31st there are, however, still legal reasons that renters can be evicted, including non payment of rent or violence. under state law, tenants can also face eviction if the landlord decides to get out of the rental business and some more good news for renters in san francisco supervisors also approved an ordinance today that bans landlords from taking away storage, parking storage, rather parking or laundry facilities from tenants. as long as tenants have such amenities provided in their rental agreements. the new ordinance strengthens rules that say landlords must provide just cause for removing housing amenities. more stimulus checks are on the way to california residents director positives will be made on friday. checks will be mailed on monday. the majority of the payments are for $600 qualifying, families with children will get another $500. the money comes from federal pandemic recovery funds and the supply dead. yeah three quarters comes from rain, the rest from the russian river and pretty much all of marin. except nevado. depends on it. so people today were jubilant. from sky foxx, phoenix lake, one of seven reservoirs that provide water for almost 200,000 people in central and southern marin county. as promising as this looks from the air. it sounds even better as runoff flows through the mountain milpitas watershed. it was a puddle, and this is only a week ago, and this place is so dry. we're worried about fire. and it was a whole different mindset. miraculous it's october. it never happens in october like this as happy as people were getting 20 inches of rain and some backyard buckets, a storm so extreme is also worrisome. having these unusual. events in october, you know is just as much. the fire is a wake up call to us all that, um, climate has really changed in this changing day by day, and as for a drought buster, we would need about six more of these storms over the year for us to catch up repeats are unlikely, say experts. while the early downpour was dramatic, consistent rain is what's needed. it's a beginning. but it's no guarantee that we're going to have a wet year by any stretch of the imagination, which is why marin municipal and other districts will continue blaring a water conservation message and requiring reductions. those practices that became habit during these last two years. we need to continue them. we don't know when the next three years coming. we really need to be prepared for that, and conservation is just the new normal for us here absolutely 1000% agree, this is a place that we live that is going to require us to be water. smart from here on out. it's a new ballgame. we can't rule the way we used to roll. i'll talk more about that later time, but we had big rain 27 inches from this atmospheric river in six days around mount tam. here's the record that's most impressive as i show you, some more rains totals here. this is san francisco, downtown san francisco downtown. the records go back to 18 49. they got what they get they got four inches of rain in 24 hours. double the all time october record ever double that, and it's a record that goes back to 18 49. and to put it in perspective of mount tam gets 27 inches of rain already so far this season. 25 inches a year is what san francisco gets. so mount tam and for 72 hours garnered as much rain as san francisco gets in an entire rainfall season. this was a big event, but it takes more like come back. we'll look at the forecast. it involves the five day and then the next chance for some rain. all right, we'll see in a bit, bill. thank you about 18,000. customers in the bay area still don't have their power back after the storm. that's down from 68,000 this morning. pg and e says since three pm they have restored power to 18,000 customers in the bay area since the storm began about 646,000 customers lost power. that's about 12% of pg and e s customers. the alameda county fair is back open after part of it was damaged from the storm. the fairground in pleasanton was temporarily shut down after. branches and signs came down. some booths were also up after some neighborhoods were a back, you ated due to flooding. ktvu is tom baker shows us the aftermath from sonoma county. sunday's rain saw small tributary to matanzas creek in santa rosa has been at valley rise well out of its banks that caused the city to order evacuations of 95 homes. two evacuated children now back home told us their experiences. i didn't know how high the water is gonna rise or if who is going to get lower? i just pray that it was going to get lower and evacuated. yeah yeah, because the police told us to move out. yeah. it was scary. just a few days ago. drought and fire were top of mind. i had my clothes for evacuation packed because this is typically are fire season. little did i know i'd have another opportunity to evacuate. that wouldn't have anything to do with fire. it was the only santa rosa creek to run truly amok. this one was in an area we wouldn't have expected to see it. it was very unusual, obviously to have an evacuation of that size for a flood, let alone kind of deep in the heart of the city, santa rosa, there was such an aggressive flow of water, but a lot of the rocks that were in tree lawns and landscaping ended up coming down the road and they kept going down the road sometimes blocks away from where they originally were. oh, my god! local high. it's kidding. just remodeled four plex apartment right beside the creek was flooded and re flooded, causing all its units to be red tagged and the residents put into hotels. you went away for a while, and then suddenly it started to rain harder and within, like 30, or 45 minutes of us almost knee height and is crazy, the only seriously worrisome problems were from two mudslides in a burn scar off your butt buena that, though they did send debris into santa rosa creek. which did cause some street flooding. there was no major problems that came from them just south at ben, um, maya's house in petaluma. it never flooded in 30 years until caltrans put in the sound wall. last june. they kind of land locked us in here without addressing the concerns of a french drain or something. to the backyard wouldn't flood. caltrans told me that it is aware of the general problem and said it was bringing in a pump to his home as a prelude to doing correct drainage for the entire street. tom vacar ktvu fox tune. in the santa cruz mountains. the big concern was the effect of all the rain on the burn scar from the c z. you fire people living in the several areas of the santa cruz and san mateo counties were forced from their homes this past weekend after the national weather service issued a flash flood watch and wind advisory. for portions of the ccu lightning complex burn area areas recently burned by wildfires are especially susceptible to flash floods and debris flows during rainstorms. the storm system dumped several feet of fresh snow in the sierra and early start to the winter like weather that brought warnings, dangerous road conditions and sierra after wildfires just last week, the caldo fire was fully contained. now drivers are pulling out their chains and ski resorts are covered with 2 to 3 ft. of fresh snow. snow and slick roads in the sierra monday brought the plows out and sent vehicles spinning out. lot of snow. bad conditions. yeah it's ice. it's slippery. just be careful on i 80 near sugar bowl, a big rig got stuck in the snow and had to be towed and near donner summit, a jeep facing the wrong way, slid into a snow bank because when it's wet, it's just. you never know what's going to happen. you can lose traction very easily for sierra ski resorts the early snow was a welcome sign for the season, palisades tahoe said more than three ft of snow fell on the upper mountain by monday morning as they prepare to open november 24th. alpine meadows got two ft of snow at its base area speed resort from sugar all to mount roast the squash valley, the marathon or reporting up to 48 inches in the last 24 hours. so it's the perfect setup to the south. heavenly got more than two ft of snow as they prepare for a november 19th opening and mammoth mountain decided to open this friday two weeks early, with a heavy snowfall, bringing more than two ft of fresh powder. the early snow had various ski shops busy over the weekend at california ski company in berkeley. people were gearing up, hoping to go up to tahoe mew no. four or five times at least. and uh, yeah, yeah, maybe do a couple of day trips. couple of weekend trips. many say they're glad to get out. there was kind of strange to be out and you know, heroin. at least 12 people were detained, leaving that location. police also arrested the suspected operator of that casino. the effort to recall san francisco district attorney chase a. boudin has some new support to prosecutors have quit. their jobs are now working to get the former boss out of office and as ktvu henry lee reports, the prosecutors say boudin is a danger to the city. i urge san francisco voters to recall a chase of routine, he selectively enforces laws in the state of california. according to his own political priorities. brooke jenkins and donald cobain both quit as san francisco prosecutors. they say their former boss chase a boudin is putting san francisco at risk. now the two have joined the campaign to recall the self described progressive prosecutor, his policies and approach is anything but progressive. to the contrary, his approach has been extreme and radical. jenkins who was a homicide prosecutor, says boudin, a former public defender, still has an allegiance with his ex colleagues in that office. he allows public defenders and his former colleagues to simply contact him. directly in order to achieve the result that they desire he releases criminal offenders prematurely. and impetuously du bain was a former solano county d a before prosecuting domestic violence cases in san francisco. he blessed boudin for releasing repeat offender tory election in june. henry lee ktvu fox two news now to idaho, where gunfire erupted inside a busy mall in boise just before two p.m. officers responded to reports of gunshots at the boise towne square mall, the largest shopping center in the city. police say two people were killed and four others, including an officer were hurt. that officer was injured, trying to bring the suspect into custody. shortly after responding on scene. officers encountered an individual matching the suspect's description. and there was a change of gunfire that ensued shortly thereafter. resulting in the officers injury as well as a suspect being taken into custody. the officer was treated and released. the suspect is hospitalized in critical condition so far, police have not commented on a possible motive for that shooting. alrighty back to some of those rain totals from the last 24 hours. not the last couple days, but last 24 hours very impressive. and some of these rain totals representing in some cases, the equivalent of maybe four or five strong winter storms in a place like sauce, alito a good storm and sausalito. inch of rain, half inch of rain. a good storm in vallejo, maybe three quarters of an inch, you know, typical winter storm, and so some of these numbers are just really amazing. when you look at and my tenure i can like i keep saying 82, i remember was very similar to that. and some of those rain accumulations, but i can't remember. certainly in october, a rain event like this certainly can. and of course, that's why the san francisco all time october day rainfall record was broken and crushed actually, by almost two inches. so on the bridge is dry. it was raining all sorts last night, but it's really backed off obviously thunderstorms in the central valley this afternoon. those atmospheric riverd trees all across the bay area in danville. the storm caused a mudslide. you can see some of the remnants here that swept across lagonda way and for one homeowner. a large tree came down, blocking their driveway, and it wasn't just danville crews were busy all around the east bay, cleaning up mud and debris left from the big storm sky. fox took a look this afternoon after mud covered part of mountain boulevard and sequoia road in oakland. the storm also brought down hundreds of trees in san francisco. that's right and public work crews spent the day clearing those trees from streets and parks, and they also cleaned out. dozens of drains clogged with debris. get views christian captain as the story. one of the wettest storms to hit the bay area is now in the rear view the storm flooding roads and knocking down trees and branches throughout san francisco. public works crews are hard at work throughout the city, clearing down trees and branches this monterey, cyprus on edge hill in the west portal neighborhood came crashing down sunday morning. neighbors say they know they live next to a steep slope where the recipe for disaster is just add water, so i was just checking out. look down there. oh, not too bad. a few branches looked over there. and the tree was falling across the road. it slammed into my neighbor's rear windshield and shattered it completely. the city's department of public works, says 700, or so trees and tree limbs came down over the weekend were able to remove most of the trees from the roadways off of cars off the power lines all the prioritized calls have been dealt with already. you'll see some caution tape around town. we're expecting at least several days more of cleanup. down trees was only part of the problem around san francisco, catch basins filled with leaves and debris and backed up, sending water onto the roads and sidewalks. fire crews closed down marina boulevard while they work to clear drains and neighbours scrambled to clear drains on their own clearing. catch basins. we have more than 200 of those of localized flooding and intersections. most of those have been cleared, if not all of them. by this time, the storm also impacted the city's power grid. many neighbors were left without electricity for hours. no power. yeah. well, let's happened earlier, the power went out about. because 10 30 definitely out. uh huh. there came on last night. the water damage wasn't limited to san francisco streets. parks in the city also saw some 40 trees come down and water submerged portion of martin luther king jr drive next to mallard lake in golden gate park. the things that people love about parks, all the trees, the lakes. um these are the very things that can be challenging in a storm and the things that we have to keep our eye on in san francisco christian captain ktvu, fox two news. already the rainfall accumulations. pretty significant numbers behind me represent just 24 hour totals. but as i said, these are the result of the, uh, amount of rain we got in 24 hours is about as much as you might see in four or five really strong winter storms and many of these locations so really fortunate 48 hour totals mount tam coming in at 16 almost 7 16.5 inches. kazuhiro and nearly 14 inches amount. tam hit 27 inches over six days. that's more than san francisco gets an entire year, right? 25 25 inches in downtown san francisco for all the rain months dry on the golden gate bridge, no fog out there. i think we have a chance. for a little bit of valley fog is a possibility for some valley fog late tonight and early tomorrow morning in the inland valley. so as we think about that the overnight lows are going to get down. the skies are clear. the winds have died overnight. low is be a little bit chilly. there are some clouds coming in right here. these that's our old storm right so that things moving off to just cause havoc out in the intermountain region out into the plains and then this system weak as it is kind of slides in over tomorrow and creates. partly cloudy, partly sunny day for us for the next couple of days, but mostly tomorrow and then we just sort of warm up from there in the mountains of snow has ended. the reign has ended, and we are starting to dry out when things julian i was just talking about was it's amazing how. um much rain we got and how? when i woke up this morning, my lawn was dry. like how little standing water there is. i mean, that's how sad or how dry the sponge or the earth in the bay area, and the california has been that it would just absorb. over six inches, a half a foot of water, and then i'm sure that happened to your house to 42 tomorrow morning in santa rosa. i think that's your best shot up here for valley fog, right? forestville greenville by healdsburg in those areas may but possible pretty much everywhere. just cause the ground's wet and temperatures are gonna get kind of cool and dew point are pretty. pretty much up there. so the forecast for tomorrow morning. that's it. there's this clouds, maybe a sprinkle, but not really. and then sets tomorrow night and here comes wednesday morning. you see what we got, and here comes wednesday afternoon and then into thursday, so it gets it warms up nicely on wednesday into thursday, so the forecast for tomorrow mid sixties in the warm spots kind of like today. a few more clouds than we had today and then the five day forecast, so it was really quite the event historic event for sure. and why not not the biggest storm we've ever seen, but the biggest storm we've ever seen in october, so that's a big deal. so i'll see you back here at 11. all right, bill. thank you. we're learning new information about the deadly accidental shooting on the set of alec baldwin's film rust. assistant director of the movie was reportedly fired from a previous job two years ago after a gun went off on set and slightly wounded, a member of the film grew, according to an affidavit released by sheriff officials in new mexico. last week, baldwin was pointing the revolver right at the camera when it went off, killing cinematographer alina hutchins. director joel souza was also injured in the shooting. what they should have done when alec baldwin was pointing the gun at the camera. they should have cleared the whole path so that nobody was standing behind the camera. they call that a lockdown? julie julie haener. we have been seeing some strong, gusty winds all across the bay area this afternoon. here's what it looked like in back a bill where you can see tree branches were swaying in the wind. if you were out on the roads, maybe you felt your car being pushed around a little. those dry offshore winds are raising more concerned now about wildfires. all right, here's a live look from a camera on our rooftop of our studios here in jack london square. those flags are in jack london square. you can see them still blowing out there in the wind. can you ever and this morning pgd started targeting power shutoffs aimed at preventing wildfires caused by their electrical equipment about 25,000 customers affected in northern california. the outages are indicated by the purple triangles on the map there in the bay area. they're mostly in napa, solano county were more than. 7000 customers are in the dark. 87 customers had their electricity turned off in northern sonoma county in about 700 contra costa and alameda county's pg and e says it could give the all clear later tonight, depending on the conditions and with more on those conditions, so let's check in with our chief meteorologist. bill martin bill? yes definitely. the winds were up the last couple hours or so last 10 hours. the winds have really been going. some of the wind gusts we've seen up in the higher peaks up over 50 miles an hour. we've got 47 on the top of mount tamil pius today. altamont past 43. i think what's unique about this weather offshore wind event is the direction there's a lot of north in this wind. and so we're saying some of the strongest winds in the central valley and we're seeing big winds down at sea level. so like mount diablo came in at 49 miles an hour almost 50 miles an hour, but some of the surface winds out around back of ill fairfield and davis those numbers are up around 50 miles an hour as well, so just a different kind of wind direction. normally we're northeast were more northerly. so it's funneling down the central valley, the wind advisory says, in effect until about eight o'clock tonight. okay and then that's going to be changed, so it's going to drop and then we're gonna be stuck with that red flag warning that last three tours tuesday, but as those wednesday down, so does the fire danger. the red flag warning will be a red flag warning, but it's not going to be as robust and red flag warning because the winds will be significantly less and i think, especially tonight i think tonight we're going to see winds. drop off quite a bit from where they were this afternoon. i think their peak was this afternoon, so the strong winds continue. it's going to be windy and dry as we head into the next 24 hours. so now when kind of takes a back seat. fire danger takes a up front seat. i have seen a couple reports of small fires. there's one to just started about an hour ago, up around the galia outside on college hill by sterling city that's out of paradise. small fire, and then i saw another fire when i see that one gosh, there was. often i'll find i'll dig around for that one. so there are a couple fires have popped up and we'll keep you posted on that as well. all right we'll see in a bit, bill. thank you. well, the strong winds and increased fire risk cab emergency officials on high alert. like other areas, san francisco could see some down trees and power lines. ktvu christien kafton joins us now from san francisco, stern grove or some parking areas are now off limits due to an abundance of caution, christian. yeah, not a lot of strong winds right now in the southern part of san francisco, but officials here in the city not taking any chances. if you take a look, you can see the sign right there, saying that stern grove park is now closed because of the threat that those high winds pose. much of the bay area is under a high wind advisory. and in san francisco, that means a heightened risk of downed trees and tree limbs. the city's department of emergency management is on high alert those type of debris in the roadway. and power outages, some of the things that we're concerned about, so to monitor that the stamps go department of emergency management is keeping an eye on the weather we have our watch center. we have our 911 dispatch center ready and available to respond the city is advising people to secure any outdoor belongings on decks or in their backyards. the steady winds and gusty conditions could also potentially knock out power and regions of the city. so the city is advising people to have fresh batteries and flashlights available. if you see it down tree call, 311 will get a maintenance crew out there. if you see a downed power line called 911, and we'll get the professionals out there to go ahead and take care of it. the city's recreation and parks department is also watching the high winds and has already closed pine lake and veiled parking lot in stern grove park. there's a lot of really tall trees there, and, um, we just don't want to take any chances. stern grove is the same part that had a massive flood following the water main leak in august that leak washing away the soil around the roots of dozens of eucalyptus trees, increasing the danger they would come tumbling down in windy conditions. the concern really revolves around the number of tall trees in the area, and, um, you know, in high winds, a tree could go down and we don't want anyone to get hurt. in san francisco's department of emergency management is urging people living in the city to sign up for alert sf by texting their zip code 2888777 so that they can get timely alerts about any power outages or. damage in their area where live in san francisco. christien kafton ktvu fox two news. already sold for the holidays because that's the really high volume travel time, and they certainly do not want to not only disappoint their customers, but all the families that will be waiting for them. monday was day three for southwest airlines passenger as cancellation held that will improve from the weekend continued with 360 flights so far, in addition to mondays, 10% cancellation rate. a whopping 30% were cancelled on sunday and 24% saturday with more than 2000 flights and all round a taurus was supposed to meet his wife in las vegas sunday morning, and my wife was coming up sunday morning for the radar game in her flight was canceled. and so she couldn't get rebooked until 10 o'clock that night games at one o'clock, so she wasn't coming to vegas. southwest blames the cancellations on bad weather back east and problems with air traffic control. the federal aviation administration says it had adequate staff on the weekend. the faa also says for several airlines, many cancellations were due. to having both aircraft and crews out of position. some reports suggest that southwest was the victim of organized sick outs over vaccination issues, something the airline and the pilots union deny. but in previous months, southwest did blame large and excessive cancellations on staffing shortages. that caused it to reduce its schedule for fewer flights while air travel demand was soaring and continues to build its tied into a lot of the bigger picture issues we're having with the national economy. daniel byrne ham is operations director at scott's cheap flights victims after a small plane crashed there. at least two people are dead, including a ups driver, whose truck was parked near where that cessna went down in the city of santee. it crashed also into two coast of orange county officials say they made the decision to reopen after tests showed there were no detectable toxins in the water. the focus now is trying to determine what caused the crack in that oil pipeline spill was estimated to be between 25,000 to 132,000 gallons of crude. well what a difference one month makes around south lake tahoe. this is some video from today at california lodge at heavenly valley ski resort. as you can see some light snow is falling for the second time. in the last week. early last month, thousands of people were evacuated around south like toe because of the caldera fire. the fire is n contained. and while there wasn't enough snow to finally put the fire out every little weather system certainly helps out was it snow, but a dust storm in southern california. caltrans posted this video from a closed section of highway 1 38. if you can see it, that's in lancaster. low visibility made driving. virtually impossible. other roads around lancaster see augusta 35 at fairfield. and you do see the tall till the north. right. so that arrow that's a north wind. that's the north wind. that's a little bit northwest over here. that's west in oakland's events and again has northeast in it. we don't we hardly notice it at the surface. but when you get these north wednesday really come right down, funnel right down through the bay right down through the snows. we just showed you around lake tahoe. that's a lake effect. believe that, you know, you talk about chicago in those areas getting lake effect. snow that was lake effect, snow inch and. in uh, the south lake tahoe around kirkwood as well some areas of the four inches, so there's this system as it goes down through the. basin and down towards vegas. you can see that set spinner so that guy is going to move on off and as it gets further from us the pressure gradient weekends and that's what we're looking for. when was closer to us like 12 hours ago eight hours ago. that's when the pressure gradient was the tightest between the high and the low in vegas is definitely getting some activity down there so. the story. the next couple hours will be the winds should gradually and they the case came after witnesses once willing to talk gave new information leading to three arrests. ktvu south bay reporter jesse gary live at san jose police headquarters. with more on that story, jesse. frank police detectives say they partnered with the district attorney's cold case unit. that pairing allowed for new information to be put into the case. allowing investigators to finally close it. it really demonstrates the tenacity and the relentlessness that are detectives have when it comes to solving homicide cases for nearly 20 years. what happened to me? ha! was a macabre mystery. it starts halloween 2000 and one in front of his apartment complex in the 500 block of avalon e avenue near penitentiary, a creek park. two men stabbed a 22 year old ha multiple times, killing him. the second person was also stabbed, but survived the twowo suspects, and the third man sped away in an suv, and that was it. an unsolved killings set for nearly 20 years. this was a random act of violence this victim and the suspects did not know each other at all. in august, the case was assigned to the joint police and district attorney's office. cold case team. those investigators re interviewed witnesses and decades later, new details, produced clues and captures if they have specific knowledge of the murder. they're going to remember the details, no matter how long it, uh, it is given those statements and interviews, we were able to corroborate some more information which led to this filing and subsequent arrest of these three suspects. october 6th brothers, francis and utopia, dag array and gilbert mary alice were all arrested in san jose. investigators say they continued living in the same city where they committed the crime they had gotten away with murder. it is very important, it's important that it shows that our criminal justice system works. treat the three defendants are all charged with homicide with a gang enhancement. the motive for the murder still unknown. another twist in this case, house family has moved from the bay area, so san jose police are hoping the public can help them reach the family to let them know the relatives. murder has been solved. if you separate ways. the three suspects has said the house ran back to an awaiting vehicles, but the area. investigators say they're looking at surveillance video in hopes of finding the three men who may say drove off in a black sedan. anyone with information is asked to contact palo alto police. two members of antioch city council are proposing legislation that would protect tenants. in a news conference today, the vice mayor monica wilson and council member to misha walker said tenants have been harassed since the state's eviction moratorium. expired at the end of september there now pushing for an anti harassment ordinance that would hold abusive landlords accountable and another law that would make not emergency evictions more difficult. if we do not protect our current tenants as they seek to recover from the economic aftermath of the pandemic, these very families can easily become new members of our regions on housed population. that we cannot allow. the vice mayor. wilson is hoping the issue will be addressed at the next city council meeting. the cdc is going to use tourist volunteers to help track new variants of covid-19. the cdc picked sfo jfk and newark airports to launch that pilot program. the programme establishes enhanced voluntarily. voluntary covid surveillance for international travelers arriving at those three airports. anyone flying to the united states must have a negative covid test no more than three days before arrival. now anyone arriving can also volunteered to take a test after landing so the cdc can study any new variants that are circulating around the world. two new covid treatments could become game changers in the fight to contain the outbreak if they are approved by the fda. fox news alexandria, hoff tells us this comes as federal health officials say parents don't need to be afraid of letting their kids go trick or treating this year. it's a possible breakthrough in the fight to contain the pandemic drugmaker merck asking federal health officials to grant emergency use authorization for its treatment drug, the first covid fighting medicine that comes in a pill form as opposed to the innovators injection, adding an easy to use weapon to the anti covid arsenal that could have a big impact on accessibility. though some doctors warn it is not a silver bullet. it does reduce the severity of illness but doesn't prevent it work paid off to the three winners will share the $1 million that comes with winning the nobel prize. lava fountains continuing to bubble inside the kill away a volcano crater. this is video from the winds get blocked out there. if you go out in the ocean, you got a gale warning inside the bay. it's howling as well as we look at the next. six hours or so the wind will be gradually dying down. these are the current wind speeds and these are sea level. he's turned up in the upper atmosphere. so we're up at the tops of mountains. this is 35 miles an hour at fairfield. gusting to 29 nearly 30. it conquered right now. oakland downtown, gusting to 28 significant winds right down to sea level 31 at san jose gusting downtown and sfo westerly wind gusting to 35 miles an hour. so here's what happens again. the contours the colours. watch what they do the reds. obviously the windiest. see a dying down after midnight tonight. kind of goes away now you still have wind yourself yellows, which are in the 25 to 35 mile an hour range, but not you know, the 50 60 kind of range that we could see. and then the winds just kind of die off. so that's i'm encouraged by that. that's why the wind advisories going to go away here in the next few hours. the red flag warning will stay up. but it's going to be a week rendition of that without that wind advisory the red flag warnings not quite as robust so that's good too. right, so it's still be cautious, still pay attention. this story right here is there's the low circle. it's like circling things. there's the low, right and then here's the high and when this low was close to the high, that's where the winds right. you can see. look at the direction around both of those. that's when the winds were falling straight down the. the central valley, and that's why the winds in sacramento or so aggressive wins anything north to south facing. all of us had wind but the really big winds were out back of ill and fairfield. 14 degrees cooler in fairfield. than it was last night. this time tomorrow is going to be a nicer day again. it'll still be a red flag warning, but it's going to be a low grade red flag warning forecast highs tomorrow. yellows are seventies 73 in fairfield, 74. out in antioch 72 in santa rosa. and yeah, so we're doing pretty good so far. and getting that wind advisory going away is a good thing. i suspect the winds will really die down. i think they'll be some gusts tonight. you know 25 30, but i think the 45 fifties are going to be going away, which is really good. coolest day of the week is going to be wednesday, and by the way, we could do have some cool overnight lows overnight lows when these winds die down tomorrow and then again on wednesday morning, they're going to be temperatures are going hello again, everyone i'm julie julie haener. i'm andre. senior in for frank. that big cat was spotted early this morning in the back yard of a home. could he possesses? smith joins us live from police headquarters with more on today's siding as the. andre neighbors say in the past two years, there have been more signings of mountain. area but never this close to home. and at midnight, i had heard my neighbor's dog barking, and we're on the colgate side. so i look closely at the picture. i realized it was actually on our fence. kristin phillips wasn't too concerned when she heard her neighbor's dog barking in the middle of the night, surprised to learn a mountain lion had paid them. a midnight visit was worried about my dog because sometimes he sleeps outside, and there's a lot of kids in the neighborhood. philips neighbor who she shares a fence with captured the big count on home surveillance video on bucknell drive. this man lives right next door. there's not really that much around here other than you know, quiet neighborhood of homes, so it is a little bit.

julie julie haener. the giants defied the odds this season with 109 wins but still heartbreaking end for fans. ktvu christian captain joins us now live he's in san francisco. with reaction from fans tonight, christian. yeah you put a fine point on it. they're heartbreaking night for giants fans. if you take a look around me, you can see there's still a lot of activity around the ballpark right now fans starting to make their way home coming to grips with this loss what it means the end of this season for giants fans and i can tell you that we talked with a lot of fans on both sides. their hearts were in this game just as much as those players on the field. it was a hard fought game in a series that went all five games, and in the end, the dodgers wound up on top headed for the national league championship series. this is great. this is just the best best playoff series i've ever seen. never great. good baseball in which your way yeah. yeah, we're gonna be back. we'll be back then. back back. remember this? julie julie haener. what weather system is moving into the bay area at this hour. ktvu chief meteorologist bill martin is tracking the storm. bill. what's it looking like? we're just starting to get rain on the golden gate bridge. now rain is showing up at sfo in the north may as well take a look behind me and you'll see the live picture and it's just starting to sprinkle out there. we did get up to a half inch of rain up around point arena on the coastal sections there in marin county. we've already seen up to 500 to 1/10 of an inch of rain. most of us in the next hour or two, could see anywhere from 500 to attend. to a quarter of an inch of rain. so really really good news out there as you look at the live picture, let's take a peek at the system as it sits now, and the thing to note with this is it's not the only one. all right. there's look at that thing sitting out there that there's another system coming in, and then another one behind that, so we're into sort of a wet pattern. it's not these aren't uh, goalie washers are massive storms, but they are going to put a big dent in the fire concerns that we have. hopefully this thing tonight will be good. we get something else on wednesday and maybe something else next weekend. the scattered showers could be moderate at times to light in the roads, you know, thinking, speaking of the golden gate bridge and the roads but hasn't rained in awhile, right? so the roads are gonna be super slick. this is all done in the next couple of hours. so for the most part this rain happening now is going to just wind down. but then we get going tomorrow with a cold start and maybe a little valley fog to talk about. so when i come back, we'll put it all together, but just know we're getting rain, and it's just moving into the san francisco metropolitan area right now. yeah good to see it, bill. thank you. well, this week will mark a major milestone in bay area history. tuesday will be the 30th anniversary of the devastating fire storm that tore through the oakland and berkeley hills. it was one of the most devastating fires in the nation. ktvu is. greg liggins went to a commemoration ceremony this afternoon and he joins us now with this report, greg. schedule e. it began on a saturday a small fire that grew into an inferno or what we now call a firestorm. within days. 25 people were killed and thousands saw their homes reduced to ash. in the 30 years since homes and lives have been rebuilt, but the fire has left a permanent scar. these homes in the oakland hills represent a small fraction of the more than 3000 dwellings that have risen from the ashes of the 1991. oakland berkeley hills firestorm, a devastating event that began saturday october 1930 years ago. a tragedy sue piper will never forget my family lost our home in 1991. we had to escape the fire. it was a harrowing experience. it was surreal. it was like being in the movies. only it was real and it was hot. piper is secretary of the north hills community association, a sponsor of sunday's 30 year. firestorm commemoration picnic at oakland's lake to moscow, where people gathered to reflect on the fire's impact to the community, john grant. they rang a bell and read the names of each of the 25 lives. lost the city of oakland lost two of our family members. we recommit ourselves to doing everything we can to prevent these tragedies from striking again. mayor libby schaaf and other officials, like oakland's new fire chief spoke about the importance of prevention and togetherness. chief freeman says a lesson learned is the importance of having defensible space of 30 ft. around once home something the department and many homeowners take. seriously we come out. we do our annual inspections. i'm proud of the fact that we have 93% compliance this year. that's the highest percentage we've had in years. homeowner michael's atkin can attest to the department's dedication. the city. comes by and checks at least once a year to make sure that the brushes clear to certain amount of distance from the from the homes that can lives in one of the many rebuilt homes. he was a mere teenager when his mother's home was swallowed by the fire. the immediate aftermath. i mean, it looked like a war zone. there was nothing left in the entire neighborhood. but chimneys. aerial photos on display at the commemoration revealed the massive swath of scorched earth where about 2800 homes and 400 plus apartments were erased from the landscape. the event motivated piper to dedicate her life to preparedness with an emphasis on educating the sizable number of newer residents who weren't around and lack of appreciation for what happened for those who did witness the event firsthand. the memories from 30 years ago are still fresh. it's been awhile, but it does in some ways seems like yesterday. because it's such a. it's a seared into your memory, something like that to lose to lose a home. if you're interested in personal perspectives on the fire and aftermath, and north hills community association has an area on its website called community come back then. and now there you will find several compelling interviews with survivors and others, including ktvu zone, rob roth, who is reporting on the fire, just as it began to explode. we'll have a link at ktvu .com. julie yes, it is really hard to believe. it's been 30 years, greg. thank you. today marks 32 years since the most powerful earthquake since 19 oh, six rocked the bay area. second base. so the oakland a's take, take julie haener. wow the loma prieta earthquake struck just after five p.m. on october 17th 1989 the 6.9 quake hit justice game three of the world series between the giants and age was getting underway at candlestick park. 63 people died and more than 3400 were injured. this week. emergency officials are urging people to participate in the world's largest earthquake drill. international shakeout. day is always the third thursday of october. this thursday morning, people all across our state will take part in the great california shakeout. it's an angle reminder to be prepared for the next big quake. be ready to drop, cover and hold on. state emergency agencies say everyone should check their homes and businesses to see if it can withstand a powerful quake. cal fire says firefighters

julie julie haener. and hi, everyone. i'm frank mallicoat. and from frank somerville tonight all evacuation warnings tied to this fire have been lifted. fire broke out this evening near newell drive in american canyon quickly grew to more than 150 acres. ktvu jana katsuyama joins us live from american canyon high school near the fires location with what she's learning about the investigation. janna. well julie, this was the command center but they since moved out, just about a half an hour ago. new this hour. i do have an update. the police have reopened, american canyon wrote in both directions. but the fire crews remain out here. there is still a wind and they are worried about containment and any hotspots. the sheriff's. sheriff's deputies did go to the scene where the fire started, and the sheriff says they found a stolen vehicle that was in flames near where that fire began. he said that they are investigating this right now as an arson residents, meantime, say that they are very glad that crews were able to keep the fire away from their homes. the fire was really close. right over here is really close by flames close to homes in american canyon had residents scrambling when fire crews issued the evacuation warning. we saw the firefighters. they're doing their sweep of the fire that was company right back here by the high school. building smoke from the flames could be seen from a pg a
