the onset of warm weather brought the boy and his two friends to the creek in juniata park. the boy panicked in water trying to cross from one side of the bridge to the other. >> i'm not surprised. it's a tragedy waiting to happen. >> reporter: kim owns a nearby driving range. he says having witnessed a drowning in 2007, he often calls police concerned about the number of children playing in the creek where swimming is not allowed. police say the boy went into the water around 5:30 p.m. near fishers lane and wyoming avenue. his friends told police they saw him panic. reached for him two to three times and lost their grip before he disappeared in the water. fire rescue crews pulled the boy from the water a half hour after he was swept under. he was pronounced dead a short time later. >> this water is dirty. so dirty. w when we go over that side, the water is slowing down. it looks like, you knows, black, dark. somebody has to do something. >> reporter: police say it's dangerous and illegal to swim in all philadelphia creeks. detectives wrapped up their investigation tonight b
