joining me in new york aviation attorney justin green. in washington cnn law enforcement analyst, a washington reporter who has written about flight 370. in atlanta kit darby, commercial pilot with 30 years flight experience. thank you to all of you. kit, let me start with you. what does this new information mean? >> well, there was a theory, like you said, that the programming occurred in advance, which would be a premeditated act. regrettably this information takes away from what we had. there is a possibility of putting an alternate route and not activate it until you need it. we don't know for sure if preprogramming occurred. all we know for sure is it wasn't preprogrammed while the acars was working. >> jason, let me ask you. obviously you've done a lot with commercial airlines and certainly on the airline aviation part of that. you were one of the lead investigators in the 9/11 case. does this say anything about whether or not somebody entered the cockpit? now we know according to the latest information that they were still en route

quest with us before the break and also joining us now is aviation attorney and private pilot justin green, to are part of this conversation. justin, hold on one second. i want to get to richard, because he's going to then have to go. richard, you were talking about whether vietnam, when a plane leaves one airspace and enters another one, meaning it had left the malaysian airspace. it said, all right, good night. and presumably as it entered ve vietnam airspace, maybe a hello and identifying that the plane is now on that track and it would seem that malaysian authorities would hear from vietnam that this plane did not make it to airspace if, indeed, it took that left turn and did not make it into airspace on its regular track. so explain to you now how we would learn whether vietnam had that correspondence with malaysia? >> they'd have to tell us. simple as that. one assumes two things. a, that they didn't make a call. we don't know. they'll no doubt reveal. no, we do know. the malaysians said the last known contact. keep coming back to what you've been told. we've been told the malaysians

with us is justin green and christine vennson to talk about this, particularly the plight of the familiesave dealt with families who suffered through 9/11 and other aviation disasters. how gutting is it and how traumatizing to go through this without any answers, two weeks now of really just no idea what happened and no closure. >> i mean no one can really know what they are going through until you go through it. the other thing is there's cultural issues of how people deal with grieving. there are common issues. one of the most common issues is they are not only dealing with the normal sense of loss, but they are doing it in a very public way. 9/11 victims in new york, the families of the victims, every time they went to a store or looked at a newspaper, they get reminded of their loss. here on top of the media frenzy, you have not knowing what happened. and they really can't go on to the next process. i'm sure they are all hoping that something will come out, that this airplane has been taken, their loved ones are alive. until they know what happened, they can't move to the next step. i

here with us is justin green. i'll do my best to work through this with you.e litigation that has been filed in a moment. but i think one of the questions remains for a lot of people, given the fact that they have not physically got their hands on the wreckage or debris, what can the families pursue in terms of litigation without that debris? >> the only thing the families can really pursue would be claims against malaysia airlines. wa they need to have first is declaration that they're loved one is dead, that have to bring a wrongful death lawsuit against the airline. that lawsuit is going to be governed by an international treaty called the montreal convention. it says, number one, where can you file a lawsuit. have few of the families are going to be able to file lawsuits in the united states. >> bulk from china, several from malaysia. >> unless you bought your ticket in the united states or you're from the united states, all those lawsuits are going to have to be filed in china, malaysia or somewhere else overseas. >> that's where it takes an attorney to c
