kadyrbayev and the other two returned to the apartment of the two with the materials. phillipos later recalled all three of them, quote, started to freak out because it became clear from a cnn report they were watching that dzhokhar was one of the boston bombers. he says they decided collectively to throw the backpack and fireworks into the trash because they didn't want tsarnaev to get into trouble, unquote. phillipos says he didn't understand what the other two were talking about because they were speaking in russian. should we get rid of the stuff or words to that effect as phillipos recalled. he said do what you have to do. they put it all with some trash in a big black trash bag and threw it into a dumpster and on friday, april 19th, about 6:00 a.m. the three saw news reports identifying the tsarnaev brothers as the terrorists and reporting that tamerlan tsarnaev, the older brother, was dead. on april 26th, phillipos confessed and law enforcement recovered tsarnaev's backpack from the landfill in new bedford. let's bring in cnn's legal analyst jeffrey toobin to go

this afternoon in boston, tazhayakov and kadyrbayev agreed to voluntary detention. they'll make their next court appearance in two weeks. in a separate hearing, phillipos is scheduled to be back in court on monday. now, here's something interesting, tazhayakov and kadyrbayev are in custody for 11 days and before the charges were announced today, tazhayakov and kadyrbayev were in court this morning on immigration charges. a short time later, they were hit with criminal charges that they exposed of material that could tie dzhokhar to the bombing. according to the fbi, kadyrbayev expected dzhokhar was part of the marathon bombings when he went to the apartment three days after the attacks and noticed several tubes that had been containing fireworks had been empty of their power. also the three men took from the dorm room an emptied out cardboard tube, a jar of vaseline kadyrbayev believed to be, quote, for making bombs, a laptop and backpack. they, quote, did not want tsarnaev to get into trouble. kadyrbayev's lawyer says his client absolutely denies the charges. >> he

he said it was turned over voluntarily by kadyrbayev when he was confronted by the fbi.'s true, it does undercut the idea that this was part of some sinister plot in which these three individuals went there to conceal important evidence from investigators. clearly what they did as alleged in the complaint is stupid and indefensible in light of the enormity of the crime if they had any reason to believe at all that tsarnaev, their friend, was the bomber, there's no justification for what they did but it's hard to square the facts as alleged here and particularly with this new information about the laptop with the idea that there was a large plot here and they were accomplices in it. >> while obviously you can't make any connections right now, we'll let the investigation play out for itself, it's interesting that they removed things like a laptop. it seems like they couldn't have been doing these things in a vacuum with absolutely no knowledge of anything. i'm not sure stupid is enough of an explanation. >> as michael isikoff pointed out in that affidavit, they point to te

and right in the center of the picture, kadyrbayev, the other student arrested, we believe on charges of making false statements to authorities and conspiracy to obstruct justice. charges right now. let's bring in juliette kayyem, a columnist for the "boston globe." what do you make of these dramatic developments? three arrests, two individuals we've identified, we don't know the third person, juliette, but we do know the third person is a u.s. citizen. >> so almost immediately after the bombings and that investigation everyone remembers there was this late-night interviewing and custody of three people in an area called new bedford, that's a southern coastal town from here. that then goes away a little bit. this morning two of those individuals were before an immigration judge. very different than federal criminal charges. this is one of those sort of jurisdictions they were on student visas part of the post-9/11 architecture includes much more stringent guidelines on student immigrants. they have to prove they're still in a university in college. this morning two of them appear befo

we know one of the students, dias kadyrbayev said in the complaint that the u.s. put out today that they also did take the vaseline, that they specifically went over and made sure they got the vaseline as well. and that's why i say it's very telling. >> right. >> it wasn't common to me to know that vaseline was used when i woke up this morning in the creation of any kind of a device, but apparently it was to one of these students. >> you know, we talked a lot about this in the last two weeks or so, that bomb makers have specific signatures and often they can kind of track down where maybe someone learned how to make the bomb based on what kind of a bomb they're making. do we know of any other kinds of cases in the united states in which vaseline has been used? >> we do, nagi bligizzi, an al qaeda bomber who tried to blow up the new york subway, during testimony in his case one of his co-conspirators talked about how they were learning to make bombs at an al qaeda training camp in pakistan and they had a list of ingredients and one of the ingredients was vaseline.

azamat tazhayakov and dias kadyrbayev both from kazakhstan were staying in the u.s. on student visas. the only issue? azamat tazhayakov is no longer a student. he returned to kazakhstan in december, 2012, according to a u.s. government official. his status as a student at u-mass dartmouth was terminated the next month on january 4th and at this point his student visa should have been invalidated. u-mass dartmouth took the proper steps and provided information into the appropriate system for foreign students that he was no longer registered there officials say but customs and border protection never got the message. when azamat tazhayakov returned back to the united states on january 20th he was granted entry. the department of homeland security says that it's reforming the student visa system to ensure customs and border protection is provided with real time updates on all relevant student visa information. as of january, 2012, more than 850,000 foreign students were in the united states and enrolled at over 10,000 u.s. schools. azamat tazhayakov the dhs says was not

tazhayakov and kadyrbayev, both from kazakhstan, were staying in the us on student visas. the only issue? tazhayakov is no longer a student. tazhayakov's returned to kazakhstan in december 2012, according to a us government official. his status as a student at u mass dartmouth was terminated the next month, on january 4th. at this point his student visa should have been invalidated. u mass dartmouth took the proper steps and provided information into the appropriate system for foreign students that he was no longer registered there officials say. but customs and border protection never got the message. when he returned back to the states on january 20th he was granted entry. the department of homeland half reforming the student visa system to ensure that how customs and border protection is provided with real time updates on all relevant student visa information. as of january 2012, more than 850,000 foreign students were in the united states enrolled at over 10,000 u.s. schools. tazhayakov - the dhs says - was not a threat at the time. jake tapper. .. >> new tonight at ei
