[laughter] robert: justice, you have spent time in the public and private sectors. most of your work has been devoted to public service. would you share with us -- justice kagan: is that what i'm doing now? robert: yes. pro bono, too. what started you on the path to public service? justice kagan: my father was a lawyer. he had a small firm. sometimes it was one or two or three lawyers. he was a lawyer who put a shingle up, and took whatever came in the door. it is hard to make a living that way. but he managed. he devoted a

bishop: no, we don't think so, justice kagan. justice kagan: and why is that? mr. bishop: and the reason is -- justice kagan: where in the statute do you find that? mr. bishop: the statute says it in three places. it says in section 4 that only habitat of such species can be designated as critical habitat. justice kagan: but we know that habitat mr. bishop: it says it in section 3(5)(c) -- justice kagan: doesn't mean excuse me, i'm sorry. we know that habitat doesn't mean just where a species lives. i mean, that's -- that would be the common understanding of the word "habitat," but this statute clearly goes beyond that, and we know because it says -- it's also where a statute -- where a species could live, right? it's out -- there are also habitats that are outside the geographical area occupied by the species. mr. bishop: but those are -- justice kagan: so we know that the statute is not using the kind of garden-variety definition of habitat. mr. bishop: no, i disagree with that, justice kagan. 3(5)(c) says the critical habitat cannot be designated beyond the enti

justice kagan: so, mr. tripp -- mr. tripp: but, of course, what c says is you can't release him at all. justice kagan: just to think about how these two provisions interact with each other, i'm wondering if you can tell me with respect to a group of people who are not involved here. mr. tripp: ok. justice kagan: as i understand it, these a through d categories include some people who have never been in criminal custody at all. so let's take spouses or children of terrorists. but there are a number of categories of people who have never been in custody at all. mr. tripp: right. justice kagan: so they fit within this a through d category. i'm wondering where you think the authority to detain them comes from? does the authority to detain them come from c or does it come from a? mr. tripp: the authority to -- so i think, actually, for all of them, the authority to do the arrest comes from a. and -- but what happens with c is c1 makes the arrest mandatory, and we do think it makes it mandatory including for those people who

justice kagan: i guess i have -- justice gorsuch: i guess -- justice kagan: two quick -- i'm sorry. justice gorsuch: well, i guess where i get stuck on the preamble argument is that normally -- we, when we're doing statutory interpretation, prefer the more specific statutory provision over the more general. and the specific statutory section dealing with pre-enactment offenders says unambiguously that the attorney general decides whether, how, when, and who, even who. so you don't even know if you're going to be subject to this law. ms. baumgartel: yes. justice gorsuch: how do people even know who is going to be included in this class until they hear from the attorney general? and i'm having trouble thinking of another delegation in which this court has ever allowed the chief prosecutor of the united states to write the criminal law for those he's going to prosecute. we say that vague criminal laws must be stricken. we've just repeated that last term. what's vaguer than a blank check to the attorney general of the united states to determine who he's going to prosecute? ms. baumgarte

please join me in welcoming kagan .[ applause ] >> thank you so much. thank you. thank you greg for all that you do for the supreme court historical society. i does! i noticed that you can do my biography without notes. that might be because of your astonishing memory, but i have a feeling that we have done this before. that would suggest how many years you have been incredibly important to the historical society and because of that, important to the supreme court. what the historical society does is very significant to the court in promoting understanding of the core of the constitution, and i don't know if some of you saw the very sad news today that justice o'connor is retiring from public life because she is in the early stages of dementia . in the statement that she wrote, in very typical justice o'connor fashion, she used the sad occasion to do good. if you haven't read her statement, please do so because she talks about the importance of civic education for our society for the way that we govern ourselves and for the way we live in a democracy, and surely,

justice kagan: mr. jorgensen, so on what you just said, i guess i was a little bit confused in your brief as to the scope of your argument. suppose that the client had, you know, after doing the appeal waiver, but there are some issues that you could still bring, not very many, but some, and the client says, i want you to -- to his attorney -- i want you to appeal. and he does not give any further guidance. in other words, he doesn't say what particular issues or whether those issues are inside or outside the scope of the appeal waiver. he just thinks -- i want to appeal now. does he get to -- at that point, does the attorney have to take the appeal? can you presume prejudice from the fact that the attorney has not taken the appeal? mr. jorgensen: at that point, you can presume neither deficient performance nor prejudice because that may, for example, originate a duty to consult with the client, to actually ascertain whether the client wants to try to vitiate the entire plea agreement, to ascertain whet

i think of justice kagan who were put on the court, within the first year she was put on by president obama, but she voted against president obama's health care plan in a good part, voted to strike some of it down. that's the kind of independence our founders envisioned when it comes to the supreme court, not this kind of, you know, president's lackey thing which the president just tried to do now with the attorney general and i'm sure he's going to try to do with the courts, too. >> and our good friend chuck rosenberg was here pointing out that in, with nixon and with clinton, judges that were were appointed by both men ruled against them in subpoena fights when there were investigations into those two presidents. so, in that way those judges were not protecters of the president of the united states. >>> my other question is slightly different. are we as a society more to blame for this than we're willing to let on, given the way that we talk about judges, given the way that we talk about supreme court nominees, and then justices? this is an obama justice. this is a trump justice. we

the reading in a feasibility here so unusual given the three context contextual signals that justice kagan listed previously? so there are three reasons. one is that that is essentially the interpretation that the court rejected in reynolds, that was squarely the government's argument in reynolds and the court said no, that's not a plausible construction of this statute. the second reason is that in the context of the intelligible principle, it is essential that congress itself state the intelligible principle. the court addressed this in american trucking v. whitman where there, the agency itself had tried to propose a limiting construction to the delegation and the court rejected that and said that the imposition of that limiting construction would be the exercise of the constitutional, the legislative power itself, so the imposition of that limiting construction would be unconstitutional because it's exercising the legislative power. >> can we go back, in reynolds we said that it would have been strange indeed for anyone to imagine that congress intended the a.g., i'm trying to put it,
