michigan talked about the $1.2 billion they had to spend on tar sand cleanup because it sank into kalamazoo river, i think these are issues that the state department has every right to raise with the company to get answers on. just recently trans-canada has been redoing some of its pipeline in other areas because it has also found that these the holes the wells on these projects were not sufficient. so the state department is telling them we want a third party validater. no other colleagues would lient lient -- like to interrupt that by saying we know best. i ask my colleagues not to urge the urgency of a process that has been failed from the beginning, that did not allow for the public interest to be adequately afforded their rights that basically is stopping the people who have objections now in south dakota from getting their day in court and a day in process. so i don't understand what the hurry is. i do want to hurry on energy policy but it has much more to do with getting the tax credits clean energy incentives in place that will unleash thousands of more jobs and give predictability.

and i want to add some documents to the record that in this case we had in kalamazoo that the company may have hit its cap and so it may for that kalamazoo spill on tarred maybe -- tar sands maybe asking the liability trust fund to actually recoup benefits that they had to pay out. so to me this is a very important issue. here's a company we have tar sands spilling into the kalamazoo river and actually costing i think it was something like $1.2 billion and instead of this company paying into the trust fund and paying for costs on this, they basically are going to take money that u.s. companies paid into the trust fund and be recouped because of this. i just want to get this right and i hope that we can work with our colleagues on another amendment on that process. and i'd also like to enter into the record an article that just appeared in the paper from the a.p. about how trans-canada is said to -- quote -- "offer landowners a price for their land in nebraska at which point if they don't come to an agreement by this friday but that the company can use imminent domain to take the land.

be built across our land when the spills happen, and it spills in the water as we saw with this kalamazoo spill it leaves a thicker oil behind, it usually sinks to the bottom of water. that makes it hugely expensive to klein and really almost nearly impossible to clean up. so these concerns are driving us to really make sure that as the united states, as canada continues to look at car tar sands production, that we are getting the sec technology to place to deal with this and to make sure that those who are liable for those kinds of spills actually are paying into a fund that will help clean up the mess. so that's why it's so important that the senate take aup action on one of -- take up action on one ever these amendments 10 he that we will be paying into the oil spill liability trust fund nor any pipe pipeline that is carrying this crude material. i want to go back to why this trust fund was created and why it was so important. the spill trust fund was created in 1986 as part of a response. this bill was signed by president reagan. and it took -- but it took four more years and a major

pipeline issue in michigan -- we've had unfortunately a couple of cases very serious pristine river, kalamazoo river, fishing canoeing, 20 years of renewing this river one fell swoop, 800,000 gallons of tar sands. i had the dubious distinction of going in a helicopter over this with the epa administrator right after it happened. stunning. now. the company has come in and, you know cleaned up most of what was there. we still can't fish. people along the river can't use their property their back yards. this is going to take tens of years to clean up. you can go to the other side of the state where we have in detroit mounds of what's called petroleum coke from tar sands that was sitting on the detroit river, now not only blowing into the river, blowing into the school neighborhoods, churches of the southwest side of detroit. now, thanks to my colleague senator peters who's now with us and i was proud to join with him, that pet coke's not sitting there anymore, but it was pet coke from tar sands that blew into huge airreas of detroit. and now we have madam chair, a real concern in the straits of m
