kara scannell is in miami tonight. and kara scannell, what are you learning? obviously, between now -- it may be until then with -- wait until then to actually have this not under seal. >> yeah, erin burnett, it's a big question of will prosecutors -- unseal this indictment between now and tuesday. and if they don't then on tuesday when he's appearing in court that might be the first time that we learn what these specific charges are, and, in the case of a lot of these indictments, they are known as speaking indictments, that will go through, in some kind of narrative form, with the prosecutors allege the former president had done the violated the law. so, there will be a lot more that we can learn once this -- but on tuesday, as we wait for that, i mean, this will be just like any other arraignment. the former president will come in. he will self-surrender to the fbi. it will process him and then he will appear before a judge here and we asked to enter a plea in this case. now the big question also here is what will that look like here? will this be in the ce

let's go to the courthouse -- no, not to the courthouse, but outside of the courthouse as kara scannell is there, and what are you seeing and hearing? >> well, john, we just saw evan explain that new information hit the docket explaining what these tax-related charges are. one thing that we're looking for next is to see when the judge, which judge is going to be getting this case and when the judge sets date for the arraignment, and when hunter biden comes to the courthouse to enter the date for the crimes he will a elucute to the crimes he has plead guilty to. and we will see if from the biden team they will have any more statements that it is in addition to the addiction that he had as well as the gun charges there that he is avoiding to plead guilty or be sentenced on the felony, the gun possession charge, because he is getting into this diversion program which is going to require him to undergo certain conditions for a set period of time which i am told by one source it is 24 months and if he does that, then the charge will go away. certainly this reaction coming from the republican

cnn's kara scannell is joining us from wilmington. kara, what penalties will hunter biden now face?tax charges you mentioned two misdemeanors failing to pay taxes for 2018 and 2019, prosecutors saying hunter biden didn't pay taxes on $1.5 million in income for each of those years. the trump-apointed u.s. attorney david weiss here has agreed to recommend to the jump that hunter biden get probation under those charges. under the statutory statute, the maximum punishment for those charges is up to a year in prison each. now, there's also that gun possession charge that you mentioned and that is a felony. but in this instance, hunter biden won't plead guilty to that charge, instead, it's going to be diverted. which means if he lives up to certain elements of conditions that are set by this agreement then that chargeological go away. that's a common charge that's used in instances where someone has been under the influence. an addict, it's one way to resolve that kind of case. so, you know, clearly a negotiated deal that has been in the works for some time. this investigation has spanned

let's get right to kara scannell for details on this. there say plea agreement, what have you learned? >> reporter: yeah, john, the five-year investigation coming to a head. we have learned from court filings here, that hunter biden has agreed to plead guilty to multiple charges. these are two counts of filing tax returns in a timely fashion. those are misdemeanors. he's also going to plead guilty to the charge of a firearm offense. this is the possession of a firearm while you are addicted to a controlled substance. now, the firearm offense is going to be diverted. what that means if he meets certain conditions that charge will go away. this will be over a set period of time. otherwise, it's the tax and other misdemeanor charges. this is a plea deal he's been reached with the u.s. attorney, that u.s. attorney david weis is a trump appointee and someone that president joe biden did not replace. one of the reasons he didn't replace them because of this investigation. they wanted to avoid any appearance of political interference. we are se

kara scannell is just outside the courthouse there. ra, what are you learning about the activity you're seeing there, and how the miami grand jury fits into the special counsel's investigation? >> reporter: wolf, we've seen a flurry of activity today. we identified a number of prosecutors from the special counsel's team, including david orbach who is the lead prosecutor on the documents investigation. we saw him leaving to grab lunch. he declined to comment on what he was up to today, and whether they were bringing witnesses in before the grand jury. we saw another prosecutor on the team getting snacks, getting bags of chips and cookies, and going back behind the closed doors where the grand jury meets. now, that is an entirely secretive process. it's unclear to us today if they had any witnesses, if the grand jury was hearing any testimony, but we do know this is the second day in a row that we have seen prosecutors from the special counsel's team working here. yesterday, a former trump aide, ta ta taylor budovich, testified for two ho

sara murray and kara scannell join us. more are you learning about the sheriff sending teams to miami and new york? ? >> we knew a while ago that they went to new york but wanted to keep it quiet. they sent a team to miami as well. they want to feel out how the different courthouses are dealing with the security issues and how they are working with their local and federal partners during a trump indictment because frankly they are bracing for the possibility of that to happen in fulton county. in addition to wanting to ensure that donald trump and any other potential defendants are safe if they are indicted and have to show up in court, they also want to make sure that the da and her staff are safe. she's a black woman, has received a number of threats, has talked openly about that. i think that's top of mind. >> what is the latest with the investigation in fulton county? >> we are still waiting on the charges. we are expecting an announcement on whether anyone will face charges sometime in these first three weeks of augus

cnn's kara scannell joins us now. what did these whistleblowers say? >> yes.wo whistleblowers testified in private and the transcripts were released today by house republicans. they have documents, exhibits embedded in these transcripts. they showed the irs investigators were recommending far more serious charges, a total of 11 counts, obviously a lot more serious than this deal with hunter biden reaching with the government where he'll plead guilty to two misdemeanors and according to our sources, prosecutors will recommend he doesn't serve prison time. that was kind of the overarching headline here, that there were career officials in the department of justice that backed that decision. there can always be differences between what investigators want and what ultimately becomes a resolution. they're cutting a deal, resolving this case, but that was a key piece of this. one of the whistleblowers is a supervisory agent, gary shapley. his main allegation he says, "i'm alleging with evidence doj provided preferential treatment, slow walked the investigation and d

and over to kara scannell outside of the court who has been tracking this with us. and kara, you have fresh reporting with this deal will bring what punishment? >> yes, so our understanding according to the sources is that the u.s. attorney's office here has agreed as part of the plea agreement to recommend to the judge that hunter biden serve no prison time and he be put on probation for a set period of time and that is about 24 months. we have not seen the details yet, but the court findings indicate that the details including this plea agreement deal be placed before the court when it is set, and we have learned that he is not going to be facing any jail time or prison time as a result of pleading guilty to the two tax-related misdemeanors and it is drawing a reaction from former president trump who is posting that this is a deal that equates to a mere traffic ticket, and that is something that m manu raja is hearing up the hill. and so, we will be hearing of when that is going t o allow cute what went wrong with that and so, we will see if that is dropped if he m

. >> kara scannell, has anyone watching knows has been a big part of this. see the former president appear in miami to answer to this indictment at 3:00 p.m. on tuesday. >> well, so erin, one question here is on venue. one of the areas that prosecutors look to when they're bringing a case is trying to put it in the place where the alleged crime took place. mar-a-lago is about 70 miles north of where i'm standing right now, and, you know, that is where a lot of the allegations that have -- we don't know what the actual charges are right now, but that's what this investigation has been looking at the handling of these documents. some of them are classified since the former president left office. and he brought those documents here to florida. so that is in essence of where some of this investigation can be. you'll remember that a lot of this investigation, one of the things that came out in some of the early court filings is that they're looking at possible obstruction of justice. there were a number of subpoenas sent to the president's legal team here in flor

i want to go to cnn's kara scannell. she is live outside that courthouse in miami that evan was referencing there. kara, what does it look like right now? did it seem quiet before the former president posted on truth social that he has in fact been told that he has been indicted here? >> yeah, kaitlan, it is very quiet here. it is only really a handful of media that were still in place when trump made that posting. i mean, all day it was pretty quiet. well did see some of the key prosecutors who were on the special counsel's team working on the documents case, and we saw one of them going out to get lunch. we saw them going back into the cafeteria to get some snacks, some chips and cookies. and then we also had heard at the end of the day, after everyone had gone that there were a bunch of pizza boxes back in the grand jury room. but we weren't sure if the grand jury had met or even that they had voted. but it has been a relatively tranquil scene here today. of course, if you remember back in new york after trump was indi
