we should also note that karen friedman agnifilo, the suspect's attorney, used to be affiliated wither law firm. cnn's john miller joins us, too, as does new york city judge george grasso. good to have you all on, john. i want to begin with you because you're learning new details about this tug of war to some degree, between federal and state prosecutors. >> well, that's right. >> and what we've been following today and really, since last night is kind of a tug of war between the united states attorney, the federal prosecutor in manhattan, the place where elie honig used to work, and the manhattan district attorney. so this morning they were set up with barricades in front of 100 center street. the state courthouse. the judge was up on the 13th floor, arranging where a camera would be to shoot the arraignment. there was a special arrangement made to book the prisoner in the district attorney's office, and by mid-morning, they found out he wasn't coming to be arraigned in state court by the district attorney on an indictment of felony murder charges, including murder in the first degr

agnifilo, right. and the family hasn't visited him yet. but what are you looking for in this dynamic? >> okay, so first of all, i promise you. karen friedman agnifilo got to him and said, shut your mouth. no more outbursts, no more of that stuff you did the other day. and there's a couple reasons for that. number one, those outbursts can be used against him at trial. that video of him going in that you just showed john, that can be played if it's relevant to prove his motive or something along those lines. the other thing is, ultimately, if he gets convicted, if he takes a plea, if he gets convicted by a jury, the judge will be sentencing him and there will be some wiggle room, maybe, depending on how the conviction comes down, for the judge to think about things like, is this person remorseful? has this person accepted responsibility? that's way down the line. but generally you want your client, if you're a defense lawyer, to be on good behavior. so i assure you, we know karen has visited and spoken with her client. i promise you, she's a good defense lawyer. she told him, keep it quiet for now. >> yeah, i can't imagine his famil

. >> karen agnifilo was basically saying in that court hearing in federal court, like, what's going on here? are there two separate investigations, federal and state. are they going to be working together? what is happening? the judge didn't really take that time to answer those questions, saying now is not the time. but it was clear she was trying to set up her defense there. right. this double jeopardy defense that legal experts have said basically, i don't think it will hold, but we'll see how this all moves forward. but that is the big question. what we have learned since, as kara scannell is saying, that the manhattan district attorney's case is actually going to take precedence. right. what the big question is now is when will he actually be in a manhattan court? well, let's say manhattan state court, because he was in court yesterday, but in manhattan state court to have an arraignment on those 11 charges, the unsealing of that indictment earlier this week. i can't believe that was earlier this week. but yeah. and and as far as the federal case is concerned, he did appear before

karen friedman agnifilo. we expect that mangione would enter a plea of not guilty once he's arraigned on those charges. also significant here is that it starts the clock. it starts the movement here by his attorneys mangione his attorneys, and decisions need to be made here soon. on whether or not they're going to offer an insanity defense. remember his attorney, karen agnifilo, when she was on as a legal analyst two weeks ago, talked about that possibility. now she's actually his attorney, and perhaps we will start to see maybe even today, some signs of that. if she in fact, in fact, intend to do so. but of course, that's all up in the air. a lot more investigative tools that the police are going to want to do here. like his dna. we could start seeing search warrants to obtain his dna. remember, there's dna that was found on some evidence that police recovered at the scene. they still need to do the dna analysis on that. so a lot could be happening here this morning. and hopefully we'll hear more from his at

karen friedman agnifilo, a former prosecutor in the manhattan district attorney's office. ladies, good morning. thanks so much for being here. karen, let me start with you. your reaction to the fingerprints found at the murder scene apparently matching mangione. what do you think about that? >> look, it's not it's clear that the evidence is piling up against him, that he is looking more and more like they are building a case that he committed this crime. the question is going to be, now, what are the charges from the prosecution standpoint? and will there be some sort of defense to this case? right. some sort of whether it's psychiatric defense, was he not responsible? i mean, given who he was and the family that he came from and the fact that he was this smart, very well-adjusted kid who was a valedictorian of his class, he was brilliant. he wasn't one of these loner recluses, you know, clearly something has happened in his life to put him here. and i think that's where the evidence is going to focus to see. will they be able to prove that he was responsible for this menta

i think what karen friedman agnifilo is doing is saying, let's get the defendant back to new york, where i can start to prepare a defense against a charge that offers a sentence of life without parole. let's get into the discovery. so steps. get him back to new york. steps. get him in front of a state supreme court judge. i think that's going to be gregory carro, very experienced state supreme court judge here in new york. let's dispose of the matter of bail and custody. nobody who's indicted on first degree murder is getting bail. so he'll be held in a new york jail. and let's get to work on getting the discovery. let's see the evidence from the case and let and let that lawyer start to work with her client. in the meantime. importantly, the investigation is going on in the background, with detectives still going through computers, looking at dna, looking at video canvases to piece together his steps. none of that has stopped. >> and of course, that terrorism additional charge now and the elevation gives a broader brush with which to paint this investigation in many ways. scott, let me

karen agnifilo there for the defense, for the defendant there. luigi mangione and the prosecutor who we saw a little bit earlier. let me bring back in our panel john miller, joey jackson with me. joey, let's go over a little bit of what we heard. so she's asking for immediate discovery. she says that her client is being treated like a ping pong between the different courts, and that she has concerns about him getting a fair trial. and she pointed out as one reason that the perp walk that was, in her words, highly choreographed, with lots of law enforcement, but also lots of press. your reaction? >> so in terms of immediate discovery, i think that's very important. we don't play hide the ball in new york state, nor should any state. the fact is, is that if there's information if there's evidence, it should be turned over to the defendant and the counsel immediately so that it could be reviewed, evaluated, scrutinized, and so that he can begin to get a fair trial on the issue of being a human ping pong ball. also a very important point to be made.

so karen friedman agnifilo has her work cut out for her here. she's going to need to get everyone at the table and everyone to agree to something if they want a deal. >> yeah. i mean, to your point, i mean, we heard karen agnifilo yesterday say that she has real concerns about whether her client can get a fair trial because of scenes like this. you know, i mean, in just the sort of spectacle that's been created around him. but on the other side, if you were a prosecutor, ellie, and you have been a prosecutor, would you worry about the fact that mangione has has gained this level of fame, even popularity on social media? i mean, how how hard does that make it to get a fair jury? >> i would be concerned. i wouldn't necessarily lose sleep over it, although you're always a little bit n about t possibility of jury nullification. and for sure, this is the highest risk of nullification that i've seen in a long time, given the fame and fandom that this guy has somehow gained over social media. but it's important to keep in mind there are checks in place

attorney karen agnifilo. and we don't we don't believe or we've learned that they have not visited him in the pennsylvania jail where he has been held for the last week and a half or so. so we know that they are involved in some aspects, but they have not yet made an appearance in front of him on. don't expect them or any family members maybe to be inside that courthouse in pennsylvania for these hearings right now, and it's unclear if they will even appear in new york. it is a media circus there, as you can imagine. now we are dealing with two states, with media all over the place. it probably would not be advised to draw more attention to this family, especially considering who this family is. their status in sort of the maryland community, the maryland community from where they are. but certainly they may appear at some point, but we haven't heard anything from them just yet. >> okay. now let's talk about something we got reporting this morning just a bit ago from katelyn polantz, who reported that federal

and mangione shares an attorney because karen friedman agnifilo husband, marc agnifilo, is also working on this case. he was in court today and he's representing diddy, who has pleaded not guilty to those charges. jake. >> shimon, it was stunning to see the large security presence surrounding mangione when he arrived in new york. i mean, even new york city mayor adams was there for some reason. yeah i've never seen something like that. >> right? i've been covering crime here in new york city for probably over 20 years now. it was really striking to watch all of this unfold and the way in which it unfolded from an nypd plane being used to transport a prisoner who was being extradited to two nypd helicopters. right. they had two nypd helicopters waiting for him at the airport in long island, where the plane landed. and then they transported him to the heliport on wall street. and then we saw that long, long walk of mangione surrounded by nypd detectives, fbi agents. and then you saw the officers with the long guns, bulletproof vests, and just that large crowd of law enforcement officials

. >> well, and i talked about this with karen agnifilo in the last hour. i want to ask you about this because it's been on my mind and that is, you know, we're seeing there's new images this morning of of wanted posters that have been posted on lampposts and that sort of thing around manhattan. there's all this online chatter elevating, putting this mangione character on a pedestal and so on. and i'm just wondering, as somebody who is a prosecutor, are you worried what might happen at this trial? and could you have a wayward juror who is sympathetic to all of this stuff? >> it's a great question, jim. so i don't think i would be overly concerned as a prosecutor with all this bizarre, in my view, inexplicable elevation of this person who is a cold blooded killer who left a family without a father. and here's why. there's two reasons. first of all, we have a jury selection process. this case will go to trial in all likelihood in manhattan for murder. and so people who are obviously biased, people who are posting these wild sort of, you know, praise of this g

suspect luigi mangione has attained high-powered new york attorney karen friedman agnifilo who has extensivets. joining me now with more on all this is priscilla thompson from pennsylvania. priscilla, welcome. so, walk us through the move to higher agnifilo and how likely is mangione to return to new york soon? >> reporter: yeah, alex, so, agnifilo had previously worked in the manhattan district attorney's office for seven years as the chief district attorney, so she knows the office that is prosecuting this case very well. she has worked in the new york criminal justice system for decades, so she knows all of that very well. and while she has declined nbc's interview request, she was on cnn earlier this week before being hired and she talked about the sheer amount of evidence against her now client, but she also laid out a possible defense strategy, take a listen. >> he was brilliant in his whole life, he comes from this great family, something changed, right? significantly, something changed. and they are going to, i think, potentially have a not guilty by reason of insanity, potential def

karen friedman agnifilo saying she is concerned about her client's right to a fair trial. she specifically cited the very public display when authorities escorted mangione from the heliport to manhattan federal court last week after he waived extradition from pennsylvania. >> they are literally treating him like he is, like, like some sort of political fodder, like some sort of spectacle. he was on display for everyone to see in the biggest staged perp walk i've ever seen in my career. it was perfectly choreographed. and what was the new york city mayor doing at this press conference, your hononor. that made it utterly political. >> reporter: s referenced mayor adams' own legal troubles. >> and frankly, your honor, the mayor should know more than anyone of the presumption of innocence that he, too, is afforded in dealing with his own issues, and i submit he was trying to detract from those issues by making a spectacle of mr. mangione. >> reporter: the state charges against mangione could get him life in prison, but the federal murder charge could mean the death penalty. hi

he is being treated like a human ping pong ball between two warring jurisdictions attorney karen friedman agnifilo specifically calling out officials for that huge show of force last week when he was extradited from pennsylvania. >> upon his arrival in new york, calling it, quote, the biggest staged perp walk she has ever seen. cnn's kara scannell joining me now with more. so, kara, what more did we learn? what did we hear at this arraignment earlier today? >> so the arraignment itself was only about 20 minutes. and as you saw, luigi mangione was escorted into the courthouse with plainclothes officers on both sides of him, their arms interlocked with him as he was shackled at his wrists and at his ankles. now, inside the courtroom, there were four rows that were filled for the public. about roughly 30 members of the public, all relatively young, and the majority of them women, which is just interesting. no one said anything, of course, because the court officers keep a pretty strong hold on the decorum in the courtroom, especially in such a serious charge case. outside the courtroom, there were al

mangione lawyer karen friedman agnifilo, told cnn her client is not going to fight extradition to new york from pennsylvania. how soon could mangione actually be sent to new york? and what happens next from there? >> well, they've got a hearing in pennsylvania on thursday. it's a status conference on his gun arrest when he was captured in that mcdonald's, which will be fairly pro forma. after that, they'll revisit the extradition. if he waives extradition right, then he could be back thursday night. he could be back friday or at the latest on monday. but new york city police detectives will be there standing by and be ready to take him. and then there will be a a hearing before a judge in new york on this indictment, i think from from his lawyers standpoint, his gun charge in pennsylvania, given these charges, really is the least of his problems. i think karen friedman agnifilo wants to get him here to new york so she can get him, you know, here, start working with him as a defendant and a lawyer. start looking at that discovery and start to deal with these charges as quickly as possi
