karen brown joins us with an update from orlando, florida. what is the atmosphere there is this we know so many people across the country are upset about the verdict. >> reporter: you know, anne and frank, definitely the anticipation is growing outside the courthouse. security is intense. people who stood in line for hours yesterday are showing up so they can get into the courtroom they can take their seats. we know the defense is already here and it was a strange scene as the public noticed that they were walking up, they raced over to them, of course, there's a lot of security here so everybody was fine. so a lot of anticipation because there are three basic choices this judge can make. one, he can give casey anthony more jail time. two, he can release her on parole. or three, he could set her free for time already served. >> because the maximum is one year for each count and that's four years and she already served almost three. >> reporter: that's absolutely correct, anne. so based on the fact that she has apparently been a model prisoner

karen brown is in florida with a preview of what's to come. >> reporter: casey anthony's defense attorneys have one last chance to explain to the jury why they didn't make good on their promises. in opening statements, they told the seven women and five men that anthony's 2-year-old daughter, caylee, accidentally drowned. but in 33 days of testimony, never offered firm proof to support the claim. they also told the jury that anthony behaved badly when they are daughter was missing because she was sexually abused by her father. but he denied it. >> i said they needed to throw a hail mary and every time they seem to have attempted that they fumbled. >> reporter: still the burden of proof lies with the prosecution. they contend 25-year-old anthony suffocated her daughter. but offered only circumstantial evidence. no dna on caylee's body, no proof exactly of how she died. what they have going for them is anthony's erratic behavior in the weeks caylee was missing. her lies and partying. and the prosecution may have got one of its biggest breaks when the final witness's testimony suggested that

we go back to karen brown who is live outside that courthouse. and karen, what was the reaction from that crowd which had almost expected another verdict when they heard the words not guilty? >> yeah, you know derek, there was an audible outcry. folks had come here from all around the world. folks that have been watching this on television and felt like they wanted to be here. that's not what they expected. many of them angry, still walking around this area wanting to talk to anybody that will listen. so many of them that watched the evidence on television felt like she definitely had something to do with her daughter's death and obviously many of these people, parents i spoke to a lot of moms that felt like somebody needed to be speaking for caylee and she had been lost in all of this. definitely folks are stunned and in fact, derek, i want to tell you that george anthony, the man that the defense said was really responsible for covering up an accident death. he issued a statement saying even though we're never going to know what happened to cayl

in orlando, florida, i'm karen brown, back to you. >> karen, florida does allow cameras in the courtroom, as you know, and that only contributed to the big media frenzy surrounding this case. we started to see scenes like this one from back on june 17. folks got into it outside the courthouse just trying to get some of the limited tickets that would let you get to the gallery. joining me now with more on the case, former prosecutor now turned defense attorney, jacob frankel. thanks for coming in. you have been on both sides in the courtroom. if you were a betting man, would you have won or lost? >> i wouldn't have bet. all of the discussion pretrial is just that. you don't get a chance to not only see the evidence that is going to come in during the case, but you also don't get a chance to feel for how these witnesses are going to play. so i would not have bet on the case at all. >> after you did see it all go down, were you shocked by the verdict and how strong was the prosecution case? >> the prosecution case was built on circumstantial evidence and i believe this jury wanted to convic

karen brown reports for wjz now from orlando. >> casey anthony's fate will soon be in the hands of the jury. jurors must discoid if the 25- year-old murdered her 2-year- old daughter caylee. this morning they heard prosecutors present their rebuttal to the defense's closing arguments. >> our position is that the facts in this case show beyond a reasonable doubt that this was a premeditated murder of a young child. >> prosecutor jeff ashton first focused on the case's forensic evidence trying to convince jurors that casey anthony killed her daughter more than three years ago by covering her face with duct tape. >> that tape had to have been on that skull before she decomposed. >> defense has tried to inject doubt into the case by saying caylee accidentally drowned in the family's pool and that casey anthony's father covered it up and they say the prosecution is smearing her character by claiming she killed her daughter because she got in the way of her hard partying lifestyle. >> the reason you don't have that evidence that they're desperately trying to find is because it's an unprovabl

karen brown is in florida with a preview of what's to come. >> reporter: casey anthony's defense attorneys have one last chance to explain to the jury on why they didn't make good on their promises. in opening statements, they said caylee accidentally drowned, but any never offered firm proof to support that claim. they also told the jury the anthony behaved badly when her daughter went missing because he was schoolly abused by her father. >> i've said for a -- that that needed to throw a hail mary and every time they attempted that, they failed. >> they contend anthony suffocated their caught but offered only circumstantial evidence. no proof of exactly how caylee died. what they have going for them is anthony's erratic behavior. in the weeks caylee was missing, her lies, she party -- partied. >>> it was suggested that casey anthony's mother lied on the stand to protect her. cindy anthony's boss testified she was at work when the chloroform took place which puts the spotlight back on her daughter. anthony never took the stand in her own defense, and shortly her faith will be in the hands

as karen brown tells us, the defense has been pressing its argument that the death was an accident. >rter: casey anthony's defense spent its final hours in front of the jury trying to convince them there is not enough evidence to convict her of murder. >> the reason you don't have that evidence that they're desperately trying to find is because it's an unprovable case. >> reporter: in their closing arguments they try today discredit the state's charge that the 25-year-old suffocated her 2-year-old daughter, caylee, with chloroform and duct tape by meticulously attacking the forensic evidence. then they pointed the finger at anthony's father saying he covered up an accidental drowning. they were not allowed to bring up allegations that he molested his daughter as an explanation of her bizarre behavior because the judge ruled they'd failed to prove it. >> i don't think anybody here can justify her actions, but they do not constitute murder. >> reporter: many of the seven women and five men on the jury appeared tired as the day wore on. they've now been sequestered for six weeks and are
