karen friedman agnifilo, who was until recently a cnn legal analyst. joining me now is current cnn legal analyst and criminal defense attorney joey jackson. you will give us a heads up if you end up, you know, always representing someone, a high profile case like this. i want to ask you about the extradition. for a while now, i've been wondering as to whether or not the the sort of slowing of the extradition or trying to fight it was because an attorney had not been picked up here in new york. do you think that that is the case and why it may now be stopped? >> so certainly, you know what, sarah? good morning. >> good morning. >> that could have been a strategic move. now an attorney is in place, which is a very good thing. at the end of the day, though, extradition and the fighting of the extradition is anybody's right to do. but it really is an uphill battle and a losing proposition. why in any extradition proceeding which he still has the right there anticipating he will waive. right. but he still has the right. you show that the actual governor's w

what did karen friedman agnifilo say in court is the ping pong battle between. so this arraignment was supposed to happen friday. by then, he would have been booked through the normal process. he would have been brought to court. he would have been back in the cell block. he would have come into court from a side door and left the courtroom the same way. it would all be choreographed strictly as normal. in this case, the the federal authorities at the direction of the united states attorney body, snatched him before his arraignment in state court. they arraigned him in federal court on a complaint, not an indictment. they could have waited until after this whole process and then done the same thing. you'd have to ask them what the reasoning was to get ahead of it. but because of that, he's in federal custody now. so to be arraigned on this indictment, they had to get a writ from the judge saying, can we borrow him to let the wheels of justice turn on the state level? the feds had to say, you can have him for this period. and when you're done, bring him back. so

karen friedman agnifilo might ask for bail for him. but that's just to put on a show. there's zero chance that he gets bail. and then from that point, the prosecutors, the federal prosecutors will have 30 days under the rule and under some readings. 20. it sort of depends on the nuances here. but 20 to 30 days to go to a grand jury and get an indictment. at that point, the case will be assigned to a district judge and will be underway in the familiar normal criminal process. >> and, joey, just explain to our viewers these federal charges versus the state charges. >> yeah. so brian and boris, the federal government has what's called concurrent jurisdiction. what that means in english is that the state can charge. and they have they've indicted him in the 11 counts, which we've talked a lot about, including first degree murder, second degree murder and a number of gun charges. et cetera. the state has done that. however, the federal government also has the jurisdiction to charge, and they have done so. if you look at the distinction in the actual criminal complaint in fe

so the defense lawyer, karen friedman agnifilo has a bit of a point there, a fair point.here's not going to be a double jeopardy concern. it may seem counterintuitive, but a person can be prosecuted simultaneously in both in federal and state court because they're what's called separate sovereigns. the supreme court said that's okay. but if you look at doj's justice manual, which is the internal written guidance to all federal prosecutors, there's a section in there. it's not binding, but it says, generally speaking, if someone's already charged with a crime in a state court, we don't need to pile on. we don't need to add our own charges. on top of that in the federal courts, unless there's exceptional circumstances. and so if and when there's an announcement, i would be interested to hear what the u.s. attorney says are those exceptional circumstances here? it could be the nature of the murder, the brazenness of it, perhaps the terroristic aspect of it as alleged. so it is unusual to see federal charges piled on top of state charges. but it does happen sometimes, pam. i
