kari hall spearheads our heat coverage, and kari, how long can we expect this heat to continue? >> it will continue throughout the day and we'll start to feel those temperatures coming down tomorrow. before we even hit noon, we are feeling some of the temperatures where we should be for the high temperature throughout the afternoon. right now in concord, it's 82 degrees, and all clear there. the excessive heat warning continues until 9:00 this evening. it mostly includes the inland hills and elevations above 1,000 feet. that's where we will have the driest conditions and also the highest fire danger. for the interior valleys, we have a heat advisory in effect. that's all of these areas shaded in red where we could reach up to 103 degrees. and we are going to continue to have unhealthy air quality so the spare the air alert continues for today, especially for the east bay and south bay. we'll talk more about this and how hot it gets coming up a little bit later. >>> thank you, kari. >>> firefighters are battling the wildfire and the heat in the east bay. crews spent their time at this fire, the mines fire, just south of livermore. there are no homes nearby but there are high voltage power lines, so it is a critical fight. we just checked and cal tran says the fire is 40% contained but the progress of the fire is contained. fire crews are also in petaluma where this fire is 85% contained. these are the only two active wildfires in the bay area, and hopefully despite the heat, it will stay that way. >>> our nbc bay area app san excellent way to keep updated on the weather. download today and we'll send out alerts when the temperatures spike. you can also get personalized forecasts for your neighborhood. >>> a san francisco police officer finds himself in trouble with the law. authorities say they found child pornography on his home computer. today that officer was in court. nbc bay area's pete suratos was live at the courthouse. pete, what have you been able to fi

kari. and as kari mentioned we have some severe weather here in the bay area as well with an excessive heat warning. >> "today in the bay's" kris sanchez to explain why firefighters really worried about today's extreme heat, kris. >> reporter: we just saw the temperature dip on that gauge back there to 59 degrees. that's normal when the sun is coming up for the heat goes away. we know the gauge will be 50 degrees higher during the hottest part of the day. things are so dry. alameda county battled south of livermore. they did it by air and on the ground. it is steep and rugged terrain. the progress of the fire was only stalled and not stopped. the fire is creeping into the regional park. you might want to steer clear of there during the heat of the day. triple digit heat during lunch time hour. firefighters could get a handle on it. the good news here is these are the only two wildfires burning here in the bay area. now as kari mentioned temperatures will start to come down tomorrow but once that grass is dry and the brush is dry, it is dry and is continuing to be a fire danger. i posted safety tips on facebook because often we think wild land fires are a problem for people who choose to live near open space but any one of us who drives could spark a wildfire. i did post some tips on my facebook page and twitter feed. in livermore, chris czyz, "today in the bay." >> thank you, kris. i'm sure you'll be shedding that jacket later. >> keep track of the heat even when we're not on air. download our nbc bay area app. >>> at 6:08 this morning happening today, a hearing on judge aaron persky's recall, santa clara judge who sentenced former swimmer brock turner to six months in jail for sexually assaulting a woman. he has filed a lawsuit to stop the recall effort against him claiming the county does not have jurisdiction but rather the secretary of state does. his lawsuit has temporarily stopped the campaign from co

kari hall has been tracking that. kari, you were covering hurricane katrina, you were in it. this sounds like it's on par to be almost as bad. >> the bad thing about this hurricane is it won't just move in and move on, it's just going to sit over the next several days. so even into next tuesday and wednesday, we could still be talking about this hurricane. by then it will most likely be downgraded but still looking at a very powerful system, and they did not have a lot of time to prepare because this did strengthen so quickly. so we'll continue to monitor that. as we bring you back home, we're looking at some nice conditions. as our inland temperatures get ready to heat up, places like this will be very popular over the next couple of days. the mendocino coast, the clouds and fog have rolled away, and we're also seeing that live in tiburon and it will be all clear there. livermore at 74 degrees and san jose at 72 degrees. oakland at 63 and our high temperatures in the south bay heading into the upper 80s for gilroy, and east san jose 86 degrees and for the east bay a few more 90s than we had yesterday, and hayward will be up to 75 degrees. at 79, daly city at 66 degrees. mission district expecting a high of 68 degrees there. novato looking at a high of 85 degrees, skpand as we head intoe day tomorrow, excessive heat waves for the san fernando valley. a heat advisory on sunday. where we do see the brighter reds, that does show where we'll have the higher temperatures for the weekend, and some spots may get as hot as 108 degrees. in oakland we have the chinese street festival going on and our highs will be up to 80 degrees. warmer than today, but still not excessive. so you want to stay in the inner bay and the coastline if you are planning to go to state football game, that will be in the low 90s. some really hot temperatures out there with all the crowds and the sunshine. make sure you're prepared for that. we'll talk about more he events going right away. >> reporter: this woman paige was out walking her dog when we caught up with her. she says violent attacks here are unusual, but she says, she, too, was recently victimized. a mana cost accosted her and tr spit in her face. >> at that point i said i'm going to take uber if it's going to be late and have a stun gun and mace. >> to protect yourself. >> to protect myself, yeah. >> reporter: the neighbors who saw the crime didn't want to talk on camera but said they shared pictures with the police. there is an active and ongoing investigation, but they say they can't tell us attacking a woman walking away. this one happened in pacific heights, and would you believe a year later, no arrest in that case. >>> following up on a story we received here on today in the bay. a professor will not teach any classes this fall. he sexually harassed a student while asking for a date back in 2015. they reinstated him and gave him two classes to teach, but the students protested and his release followed. students are relieved. >> i am relieved those classes are basically out of his hands. >> reporter: the university says vacar still remains a part of the school but they are discussing his future at the university. >>> what could be a chaotic weekend in the bay area. police protesters, counter-protesters. even we are getting ready for several rallies. >> one starts in less than half an hour. pete suratos joins us from outside san francisco city hall, and this is a site of a noon rally. >> reporter: good morning to you, marcus and kris. as you mentioned, at about 12:00 p.m., we're going to have this counter-protest, the first of many of these counter-protests to tomorrow's patriots rally taking place tomorrow afternoon. this is where city leaders will eventually be speaking and they're celebrating the city of san francisco, saying the city is filled with compassion and love. i want to take you guys to my left here. this is where folks are going to be standing behind that media stage. that's where we're expecting folks who are here for the rally to start filing in at least in the next half hour. with all that said, with the event taking place, the city is still preparing for the worst when it comes to that rally tomorrow at christy field. as a matter of fact, we'll show you new video we got on-site earlier this afternoon. crews setting up fencing in the area for what is going to be called the rally zone for protestors. that will be the area fenced off in the park for those taking part in the rally. also offices of emergency services will be activated in the event things get out of hand and there will be extra staff at sf general hospital. i want to point out the people with opposing views who are brought there will be separated. also the public defender and his staff will be on-site serving what they're calling legal observers for protestors. you may need assistance when it comes to knowing their rights. let's take you guys back out here live. you have a band practicing before this rally takes place. we saw glide memorial church. the choirs here are taking part in this rally. it will take place at 12:00 p.m. there will be a flag run across golden gate bridge tomorrow morning with those participating in that prayer rally at christy field. but this anti-hate rally, they're calling it, is going to start at 12:00 p.m. we'll hear from a number of city leaders there. we're live in san francisco, pete suratos, bay area news. >>> as a safety effort, they are temporarily removing a number of mailboxes. the mailboxes are all near cal campus and civic center park where sunday rallies are set to take place. back in february, protestors damaged several mailboxes. >>> protestors are planning on attending rallies in san francisco. there will be an all workday stoppage in the port. they protest the organizers rally in christy field. this will be the one-day work stoppage this year. >>> live to the golden gate bridge where you can expect some changes tomorrow because of that planned alt right rally. the parking lots and the welcome center will be closed. this is on the san francisco side right near christy field where the rally is scheduled. the sidewalks, though, will be open to bicyclists and pedestrians. >>> now to denver where police are getting involved and new videos are surfacing at that incident at a cheerleading camp. >> it was caught on camera forcing a young girl to do the splits while she's begging for them to stop. we have to tell you this video is very hard to watch. >> keep her legs apart. >> reporter: this morning there is growing outrage as new cell phone video shot by one of the cheerleaders shared with nbc affiliate kusa showed teenage girls being pushed to their limits and beyond. coach ozo williams now on leave along with an assistant coach and three administrators is seen here forcing another cheerleader into a painful split. 14-year-old shalen walsh is not in the video but said she attended the camp with williams. >> when i was with the coach, i looked up to him and he said this will help you get a better split. so i thought it was a good thing but i didn't know it would hurt that bad. >> reporter: she said she was put through the same excruciating pain that madally wakefield beg for mercy. >> i felt like my hip was going to pop out of place, it hurt so bad. i for sure was crying hysterically. >> reporter: she said the brutal exercise happened in a single cheer practice back in june, the girls forced to line up and then this. the denver police department launched an investigation wednesday when they were made aware of what happened. >> we've been trying since the beginning of june to just get somebody to hear us. >> reporter:ally wakefield and her parents were interviewed by police on thursday, more than two months after they said they sent video and a letter to the school. school officials had no comment about claims the video was sent to them in june, but the dps superintendent said he only learned of the incident on wednesday. >> the administration were all on vacation for the summer, and they kept saying, we're on vacation, we're going to give them oversight. >> reporter: but that oversight never came, according to the wakefield family. and the coach, known for his backflips, was allowed to keep tumbling with the teens through july. in a statement, denver public school superintendent tox volksberg said they are supporting the police department in their investigation and that dps does not allow the use of forcing splits or anything that puts health at risk. too little too late, says washit's mom. >> you can't change the past, but i hope any kind of procedure will be put in place that any dangerous or unsafe situations that may occur in the future will be handled much, much better than it was. >> that was lucy cavanaugh reporting. the school says putting coach williams and others on leave is standard practice when there is an investigation. nbc reached out to coach williams and he referred nbc to his lawyers, but his attorneys did not return request for comment. members of that squad told us that the coach knew about those shocking videos but asked the girls to, quote, keep it under wraps. >> and that's a different set of problems there. >>> we are tracking hurricane harvey as it continues to bear down on when tina went to use the new card, she was told it only had $2 on it, not 79. target told her the card was used in las vegas. tina said she was overseas the day of that transaction. she said she showed target proof that she was not in las vegas but never heard back. so she reached out to us for help. we contacted target and it sent tina a new gift card for $79. target didn't explain what happened. in a statement it just confirmed it had resolved the issue with tina. gift card fraud is rampant. some thieves have even figured out how to steal from your card right after you purchase it and activate it. our best advice is don't let gift cards sit idle. the faster you redeem them, the less time you give criminals to steal from you. if you have a consumer complaint, write to us at nbcbay ar >> we're going shopping today, that's great news. we do have some good weather out there for no matter what you have to do, about to head out and run some errands or getting ready to pick the kids up from school. i want to give you a tour around the bay area. it's 62 degrees right there in tiberon, and 65 degrees in berkeley. as we get a look at a foggy coast in daly city, right now it's 60 and you'll get a little bit of clearing as we go through the day. the 7-day forecast is at the bottom of the screen to show you it will be heating up the next several days. we can still in some spots leave the air-conditioning off. we'll be at 82 degrees today in san jose. a little warmer in gilroy, up to 86 degrees. east bay also looking at some upper 80s there. from concord down to danville, up to 89 degrees, while oakland today up to 72 degrees. also some 70s for much of the peninsula, san carlos at 75 today. and palo alto looking at a high of 77 degrees, 70 in the mission district, and that is where we'll feel just a little bit warmer than it did yesterday. we're also feeling a slight boost in those temperatures in the north bay. napa, we're going to see that high there up to 81 degrees. no matter what you have planned for this afternoon, maybe it's a beach day. if you're going to a spot like santa cruz, it's going to be in the low 70s for much of the early afternoon. we're going to see those temperatures holding steady and then this evening cooling off as soon as the sun sets back into the 60s. in sonoma and napa valleys, into the upper 70s. we could briefly hit the low 80s there but it's mostly going to stay in the low 70s for the afternoon from 3:00 to 6:00, then some upper 60s at 7:00. we'll also feel those winds picking up from the west at about 10 to 15 miles an hour. you won't feel as much of a wind if you're going golfing in the tri-valley. throughout the rest of the evening it's going to be warm, too. today begins that warming trend and will continue to have some higher temperatures heading into the weekend. so if you want to go golfing, today is probably your best day. in the upper 80s for much of the afternoon. make sure you bring some sunscreen. we're also going to see mostly sunny skies in san francisco over the next several days, but we do have to start out with those clouds. we haven't had the deep marine layer giving us the fog that we've seen recently, but still expecting some more low clouds throughout the morning hours. higher humidity kicking in today but we'll feel the humidity dropping tomorrow and for the inland areas. expect highs in the upper 80s to lower 90s through friday. this weekend as you go ahead and make some plans, it is going to be a hot one, so make sure you keep in mind that you will need to find somewhere to cool off or you may have to get that air-conditioning tuned up, because we'll be in the mid-90s by sunday and it will be slow to cool down next week. we are not completely done with summer even though we are going to have a lot of those kids going back to school over the next few days. i'll have another quick look at the forecast coming up a little bit later, kris and kari hall has been tracking the triple digit temperatures that we can expect today. kari. >> and we'll be watching concourt where our temperatures will be climbing quickly for today. for the morning it feels nice but late morning, early afternoon you can see how these temperatures trend reaching 106 degrees in concord by 4:00 this afternoon. and if you are able to head to a place like assistant an cruise u cruz it's going to be sob nice today, temperatures reaching into the upper 70s there, sunshine, and nice breezes. and that's what you'll want to do as these temperatures inland will be heating up trying to stay cool. we'll have more on that coming up in a few minutes, but mike has more info on the bart problem. >>> we just heard back from the bart spokesperson and she did tell us that the track equipment problem slam switching problem and that's why they're single tracking in the area. that's creating the delay there but then they're back at speed able to restore and get over to the east bay without any other delay and it's better than a half an hour, it's now just down 20-minute delays and that will hold until they can clear that switching problem. we'll track that. make sure you're aware of that. the roadways are a great option right now the peninsula no delays and the delay over in the east bay starting to move around and shift. we're seeing more traffic bill upped in san leandro and the early crash at teniason has cleared. as you're coming off of 238 in the castro valley has no problem right now. we have a 30 foir minute drive from 238 to the dumbarton bridge. prices not so great right now. in fact, a lot of people in the bay area and across the nation are getting ready to hit the road for the labor day holiday weekend but you might notice you're going pay a little bit more at the pump. >> the historic flooding in texas is impacting gas prices all over the country. today in the bay chris san schez live in san jose this morning to explain how this might impact your travel this weekend. >> reporter: morning to you. the gas price here where we are at this arco station in san jose near bran numb high school is about $2.58 per gallon of unload leaded gas but that could go up by 10% by the end. holiday weekend because of hurricane harvey, though we don't get our gas from there. gas production is about a million gallons short of demand because fortunate hurricane. and new this morning we talked with the petroleum analyst for gas buddy.com which tracks gas prices and he said californians are getting squeezed from several different angles, expect and unexpected, though we don't get our gas from the gulf. >> part of it because of intense demand from the pacific northwest due to the eclipse, and part of it because refineries have been knocked out on top of this with har i have, everyone is stretched thin in the is is going to affect california as well. >> reporter: now a side note this morning, they usually track cheap gas but now it's helping folks in texas and louisiana find any gas at all. now, no matter what the gas prices, 80% of folks say they're not going to change their travel plans, they're going to go where they goont. triple "a" stopped doing their travel forecast so woe don't know what the volume is expected to be there weekend but it seems like a lot of folks are looking forward to getting out of town. in the meantime, if i look at the south bay. much hotter than yesterday. and the south county up to 102 degrees. for the east bay we're looking at 106 in concord, fremont 93 degrees, and the seven-day forecast is now coming up at the bottom of the screen showing some more intoens heat over the next several days. in redwood city expect a high of 90 while half moon bay that will be nice, 71 degrees. and san francisco up to 78 degrees and in the mission district. and for the north bay looking at mid to upper 90s with a few spots hitting over 100 degrees today. as you're getting ready to head out for school this morning, throw an extra bottle of water in the kid's backpack today. it will be nice and comfortable going to school but at recess it will be heating up quicklily and then for 1:00 as you're in the pickup line it will be in the 90s inland and 70s for the coast. we've about keeping you up to date on what's happening with harvey, now a tropical depression, still bringing a lot of rain over louisiana. we can see is that rain has spread out and now tapping into some gulf moisture. so it will continue to bring in the possibility of more flooding for parts of the south over the of school looking at napa valley this weekend it will be in the upper 80s on friday and then a touch cooler for the rest of the weekend but still a very nice weekend ahead in napa valley looking for hotter temperatures. why not go to shasta lake up to 100 degrees on friday. and saturday 98. and if you're looking for some beach weather heading to santa barbara upper 60s to lower 70s. we'll have a kari hall. we have some cloudy skies out there, kari. >> we'll see the clouds for a little while longer in san jose and it does clear out for a beautiful afternoon. as we get a look at high temperatures today we'll be in the upper 80s in morgan hill and coup earp tino up to 82 degrees. mid to upper 80s for much of the east bay and the valley. hayward at 75. oakland, 72. san carlo 72. san francisco low to mid-60s with a little bit of clearing this afternoon and sunshine expected in the north bay with highs in the mid-80s. let's check in with mike for an update on the roadways. >> our palo alto camera. heading to marsh where a crash was reported. we don't see anything disturbing the flow. look at your map in same area on the peninsula. a great commute showing up. the crash located there, we don't see any additional slowing. the closure of bay road between mar marsh and willow, that purple route. use middle field for your alternate. slow through san mateo building and the bay bridge metering lights. back to you. >> all right, mike. thank you for that overview. that's it for us right now. ♪ >>> we're back, now. >>> we're back now, 7:30 wednesday morning, 9th of august, 2017, otherwise known as hoda's birthday. we have a lot of headlines to get to. the u.s. and north korea are trading escalating threats. north korea says it is now examining plans to attack the u.s. territory of guam. secretary of state rex tillerson, who is returning from asia, actually landed in guam this morning. he told reporters he did not believe there was any imminent threat and never considered rerouting the longstanding fueling stop. president trump said any attack from north korea would be met with fire and tfury like the wod has never seen. >> french soldiers were leaving their barracks when a driver plowed his car into the group, injuring six of them. witnesses say the man appeared to be waiting for them to come out of the building. an arrest has been made. >> the reigning super bowl champs are now the first nfl teams to buy their own planes to fly to games. the team bought a pair of boeing 767s. one will be used as the main plane for the season, the other as backup. that is a perk. >> they decked them out, nothing but first class seats inside. they're going to arrive in style. they've got their lombardi trophies on the tail of that plane. >> that is going to drive other football teams nuts. >> absolutely. >> the man at the center of the taylor swift groping trial heads back to trial after testifying he never touched taylor swift inappropriately. joe, good morning. >> reporter: good morning. the very first witness was david muell mueller, the former radio d.j. saying he never touched taylor swift and her accusations cost him his career. >> david mueller testifying as music superstar taylor swift looked on in the courtroom. what happened when they posed for this photo. mueller testified as he moved to get into the picture his hand was closed and came into contact with part of her body. i felt what appeared or seemed to be a rib cage or rib or ribs. mueller described it as jostling, adding our hands touched and our arms touch and said he never lifted her skirt or grabbed her behind. his lawyer argues that the photo supports mule are because her skirt is not visibly ruffled. two days later, mueller was fired. he sued swift and members of her team saying the groping allegation cost him a job that pays more than $150,000 a year. he said it's a horrible thing eye accus-- i'm accused of and t to clear my name. swift countersued. and at one point swift's mother and co-defendant, andrea, broke down in tears. their attorney asked what's wrong with this picture? a woman is assaulted, a woman reports it and she gets sued? it just doesn't make sense. he said swift is asking for $1 in damages telling the jury she's not trying to bankrupt this man, she trying to tell people out there you can say no when someone puts their hand on you. spectator lined up at 4 a.m. hoping to get just one of 32 courtroom seats. >> it's awesome that people of her status can come and be brave and stand up for herself. >> an eight-member jury have been selected, six women and two men. both swift and mueller have been in the courtroom, even during jury selection. swift is expected to testify at some point during this trial. >> thank you. >> there is growing concern in hollywood about that high-profile cyber attack on hbo. the hacks aers have now release ransom note threatening more leaks. >> reporter: this morning the hbo cyber attack getting bigger with news of a second data dump and it's targeting more than just hit hbo shows like "game of tloe thrones." >> this is a terrifying situation for people in hollywood. >> reporter: matt bellamy said hackers e-mailed them what appear to be internal documents. an upcoming episode and this ransom note addressed to hbo. in the five-month video set to ominous music from "game of thrones", the hackers call themselves mr. smith and demand hbo pay them millions of dollars or face even more leaks of sensitive company materials. in a statement, hbo says a forensic review is ongoing. it's working with cyber security firms and law enforcement to resolve the incident and the company has there is no reason to believe their e-mail system as a whole has been compromised. >> so far the damaging information has not been significant. >> it's unclear how deep this cyber rabbit hole will go and how it will compare to the hack that rocked sony pictures. in 2014 cyber crooks released m embarrassi embarrassing e-mails, personal information and the salary of thousands of employees. >> with sony, it was a purely hurtful damaging leak. the goal was the leak. >> reporter: now it's unscripted territory. >> do they have more e-mails?
