let's get back to cnn's karl penhaul. what do you have for us, karl? >> reporter: the last few moments, i spoke to you a few moments ago, a wide executive-type jet circled an overflu tegucigalpa airport. that raised expectations amok supporters if that is the jet he is traveling on, that is the jet he is trying to land here. but no sooner did that executive jet overfly the airport, now everhead we have at least one military aircraft circling. we also have a military helicopter coming in to overfly the air strip as well. the interim government has said they will try and stop mr. zelaya from landing and what is going on now is the military are putting aircraft overhead in the airspace above the airport to try and physically prevent or physically make it too dangerous for mr. zelaya's jet to land. the interim government and the military has, however, said if he does manage to land, if he defies the danger and manage, to put his aircraft down on the tarmac here at the airport, then we already know that dozens of soldiers are out there the on the air strip,

we're learning more about karl rove. tell us what this report is saying. >> that's been this quiet investigation going on on capitol hill. you might remember there was actually a big fight over executive privilege on this earlier in the year, and the obama white house basically brokered a deal between these former bush administration officials. basically karl rove and harriet miers who was one of bush's attorneys to allow the investigation to go forward and take this issue out of the courts. this is all looking into what role the white house played, and particularly political officials within the white house like karl rove, played in the dismissal of about nine or ten u.s. attorneys back at the end of 2006. >> josh, a great leader looks forward and not back. if i'm barack obama similar to the cia issue we were dealing with a couple weeks ago, don't they want to just leave it alone at this point. we have so many problems. in a strange way, if there's egregious behavior, we have to pay attention to it. the last person i'm

matt, karl rove is never one to create these arguments, is he? never mind.o the heart of what he is doing. is rove suggesting that the stimulus should have been much bigger as paul krugman was arguing? >> i think most of us would say that the stimulus is actually wouldn't work no matter what because it's a kenzian theory. it's deficit spending and that's never worked. what worked is what john f. kennedy and reagan did, which was cutting the rate. if you buy into the kenzian theory that stimulus spending works, president obama hasn't done that. there's been little money spent on things to improve infrastructure and create jobs. we've spent millions on things that have no correlation on creating jobs. >> your response? >> there are some serious arguments you can make about stimulus spending, like it might lead to inflation down the road, but it's not serious to say that stimulus spending doesn't work. that's not a serious critique. you inject money into the economy. it's going to create jobs. the question is, how much money and how fast. the irony is that it w

jonathan karl, abc news, capitol hill. >>> overseas next to israel, which is under pressure from the white house to stop construction of west bank settlements. the president special envoy george mitchell reiterated israel must start dealing with the settlement issue but the president's call a freeze on construction is getting the coldest of shoulders from jerusalem. here's simon mcgregor-wood. >> reporter: this is israel's answer to the obama administration's demands to freeze settlement construction --more building. and the number of settlers is higher than ev before. the israeli military announced today over 3,000 now live on land palestinians want for their new state. israel's refusal to stop the building is putting real strain on relations between the obama administration and prime minister binyamin netanyahu. at this settlement just outside jerusalem, they are building 200 new apartments this year. they want to build 900 next year. unless president obama can persuade the israelis to stop this kind of project, his dream of middle east peace may remain just a dream. >> he will hav

jon karl is joining us from the capitol. jon, is this a surprise, or was it expected? >> reporter: well, charlie, this is the first major defeat for the nra on a congressional vote in ten years, and it comes after an extraordinary winning streak in this democratic congress. already this year, the nra had prevailed three times, including on a bill that lifted the ban on guns in national parks. they had been expected to win on this, as well. >> so why did it go down? >> reporter: well, for one, two republican senators, long-time republican senators, voinovich and lugar in something of a surprise, voted against it, and with that, the vote was just two votes shy of the 60 needed. >> and is this a sign that perhaps the nra's strength, which has been very strong, on capitol hill, is it a sign that might be waning? >> reporter: i wouldn't say that yet. this needed 60 votes. in the end, 20 democratic senators, including the democratic majority leader, harry reid, voted for it. they got 58 votes. far more than those voted against. i would expect the nra would be back on this is

karl, back to the political element here. judge sotomayor has been working hard to win over lawmakers. in our nation's history, about 1/4 of all supreme court nominees have failed to get throughout senate. karl has pointed out just minutes ago by maura lie san during the last program, now republicans are hoping to get just 20 votes against her. >> well, the white house has put a goal of 80 for her confirmation. the senate minority, the republican side only has 40 members to it. and judge sonia sotomayor has definitely made the rowntdz. she has visited 89 of them in the runup to this confirmation process. there have been written answers to questions. there will be more of those. and if there was any senator who would like a little bit of her time, you will bet she dual that as well. great deal of this is day core rum with senators who like very much to be courted. let's not forget, shep, this is their celebrity moment to some extent, too. >> unless you have a complete meltdown, you are going to get confirmed.
