neither trump or cruz gets to 1,237, now a contested convention, why is john boehner, john kasich, karl rove, mitt romney and even state gop representatives all suggesting in spite of rule 40 and a rule that states you have to have eight-state majorities to even be considered, i have it right in front of me. seems clear. why are they suggesting that paul ryan could be named on the convention floor and be brought into this? >> well, remember -- yeah. i agree with youment look. when people are supposed to have a belief that when they spent all of this time voting and waiting in line and caucusing and putting up posters that ultimately it mattered. with all the minutia in the mules and the notwithstanding such and such clause in that rule that you referred to, there is just a general sense that the party has to proceed fairly and not that rules don't matter. they matter. but also, the brand and the integrity of the gop is on the line here. so, remember in '64, back in '64, the party did not want goldwater to be the nominee but they took their medicine and they allowed him to be the nominee. he

joining us now on the phone from san juan, puerto rico, karl rove.e on the satellite from p.r. but nothing works counsel there, which is one of the reasons the place is bankrupt so he is on the phone. i believe the only question in new york is whether trump will get his 50% margin, thus the majority of the delegates. am i wrong. >> i think that's even -- i think it's somewhat different than that if he gets 50%, remember, he just gets 14 statewide delegates. if he gets more than 50% in each condition congressional district h"vúz takes all three delegates. so i think frankly, there will be some districts. let's say that there are 5 to 10 districts in which he gets less than 50%. and one of the other candidates. most likely given the polling kasich gets more than 20%. trump would then get two of the delegates. kasich or cruz, depending on who got more than 20%, they would get one. so my sense is trump is likely to come out of the new@ york delegates with between 85 and 90 of the 95 delegates. it might be a little bit less but i think it could be as many

karl rove writing that time is running out to do that. brett baier joining us. how likely would something like that be? time is running out. right? >> it is. let's be clear. trump is trying to be the republican nominee, not an independent candidate. even if he goes to a contested convention and somehow doesn't get that, think obviously everyone thinks there will be a major thing for the republican party, but at that point it will -- karl rove is correct, it will be too late if he has not had the machinery in place to do it. there are a lot of deadlines to get on ballots. may 9th is texas, you need 80,000 signatures to get on the ballot in texas. now we're talking bat general election for an independent candidate in order to get those electoral votes. then you have a flurry of other deadlines in june, colorado, and vermont, and state of state and they all require signatures. so donald trump's organization is focused on delegates and trying to get to the 1237. they're not focused on getting signatures for any other run. >> you know, he has been making much of the
