>> reporter: kate, this is a significant step to the fulton county d.a.ump allies in before the special grand jury to testify, and now in fact trump's former personal lawyer, rudy giuliani, has just been ordered to appear before that special grand jury next month, in just a few weeks, august 9th. so this is all part of that sprawling investigation into possible election crimes. it's coming from the district attorney. rudy giuliani has been fighting this subpoena in a new york court but it turns out when he failed to return to court for a hearing last week on the subpoena, the judge ruled that giuliani must appear and testify before the special grand jury in georgia next month on august 9th. so we haven't gotten in iresponse from giuliani yet or his lawyers, but this is a significant move forward to the d.a.'s investigation. we know that she began her probe investigating that phone call from trump to georgia's secretary of state when he asked him to find more votes so trump could win the state. we know that in addition to giuliani, the d.a. has asked for a
